A BILL 
To require a report on the effect of the phase-out of the 
reduction of Survivor Benefit Plan survivor annuities 
by the amount of dependency and indemnity compensa-
tion. 
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. REPORT ON EFFECT OF PHASE-OUT OF REDUC-3
TION OF SURVIVOR BENEFIT PLAN SURVIVOR 4
ANNUITIES BY AMOUNT OF DEPENDENCY 5
AND INDEMNITY COMPENSATION. 6
(a) I
NGENERAL.—The Secretary of Defense shall 7
submit to Congress a report on the effect of section 622 8

of the National Defense Authorization Act for Fiscal Year 1
2020 (Public Law 116–92; 133 Stat. 1427) and the 2
amendments made by such section. 3
(b) C
ONTENTS.—The report submitted pursuant to 4
subsection (a) shall include the following: 5
(1) An assessment on the effect that section 6
622 of the National Defense Authorization Act for 7
Fiscal Year 2020 (Public Law 116–92; 133 Stat. 8
1427) and the amendments made by such section 9
had on beneficiaries and any unintended con-10
sequences that were a result of such section or 11
amendments. 12
(2) An evaluation of the authority that the Sec-13
retary has in a situation when the Defense Finance 14
Accounting Service cannot verify the eligibility of a 15
spouse and payments are paused for the child. 16
(3) Recommendations for legislative action to 17
ensure the Secretary has the flexibility to make pay-18
ments under subchapter II of chapter 73 of title 10, 19
United States Code, to dependent children that are 20
under the guardianship of someone other than the 21
surviving spouse. 22
(4) An assessment of the process of the Depart-23
ment for determining eligibility for survivor benefits 24
under subchapter II of chapter 73 of title 10, United 25
