IMPOSITION OF SANCTIONS WITH RESPECT TO FOR-5 EIGN PERSONS AND AGENCIES AND INSTRU-6 MENTALITIES OF FOREIGN STATES SUP-7 PORTING HAMAS, THE PALESTINIAN ISLAMIC 8 JIHAD, OR ANY AFFILIATE OR SUCCESSOR 9 THEREOF. 10 (a) I NGENERAL.—Not later than 180 days after the 11 date of the enactment of this Act, the President shall impose 12 the sanctions described in subsection (c) with respect to any 13 foreign person and any agency or instrumentality of a for-14 eign state that the President determines knowingly— 15 (1) provides significant financial or material 16 support to any person described in subsection (b); or 17 (2) engages in a significant transaction with 18 any person described in subsection (b). 19 (b) P ERSONDESCRIBED.—A person described in this 20 subsection is a foreign person that the President deter-21 mines— 22 (1) is a senior member of Hamas, the Pales-23 tinian Islamic Jihad, or any affiliate or successor 24 thereof; 25 VerDate Sep 11 2014 07:14 May 08, 2024 Jkt 049200 PO 00000 Frm 00032 Fmt 6652 Sfmt 6203 E:\BILLS\S3874.RS S3874 kjohnson on DSK7ZCZBW3PROD with $$_JOB 33 •S 3874 RS (2) is a senior member of the Al-Aqsa Martyr’s 1 Brigade or any affiliate or successor thereof; 2 (3) is a senior member of a foreign terrorist or-3 ganization designated pursuant to section 219 of the 4 Immigration and Nationality Act (8 U.S.C. 1189) 5 whose members directly or indirectly support any of 6 the activities of, knowingly engage in a significant 7 transaction with, or provide financial or material 8 support for Hamas, the Palestinian Islamic Jihad, 9 any affiliate or successor thereof, or any person de-10 scribed in paragraph (1) or (2); or 11 (4) knowingly provides assistance or financial or 12 material support that supports the terrorist activities 13 of any foreign person described in paragraph (1), (2), 14 or (3). 15 (c) S ANCTIONSDESCRIBED.— 16 (1) F OREIGN PERSONS.—With respect to a for-17 eign person subject to sanctions under subsection (a), 18 the President shall exercise all powers granted to the 19 President by the International Emergency Economic 20 Powers Act (50 U.S.C. 1701 et seq.) (except that the 21 requirements of section 202 of such Act (50 U.S.C. 22 1701) shall not apply) to the extent necessary to block 23 and prohibit all transactions in all property and in-24 terests in property of the foreign person if such prop-25 VerDate Sep 11 2014 07:14 May 08, 2024 Jkt 049200 PO 00000 Frm 00033 Fmt 6652 Sfmt 6203 E:\BILLS\S3874.RS S3874 kjohnson on DSK7ZCZBW3PROD with $$_JOB 34 •S 3874 RS erty and interests in property are in the United 1 States, come within the United States, or are or come 2 within the possession or control of a United States 3 person. 4 (2) A GENCIES OR INSTRUMENTALITIES OF A 5 FOREIGN STATE.—With respect to an agency or in-6 strumentality of a foreign state subject to sanctions 7 under subsection (a), the President shall impose 2 or 8 more of the following: 9 (A) The President may direct the Export- 10 Import Bank of the United States not to give ap-11 proval to the issuance of any guarantee, insur-12 ance, extension of credit, or participation in the 13 extension of credit in connection with the export 14 of any goods or services to the agency or instru-15 mentality, and the Export-Import Bank of the 16 United States shall comply with any such direc-17 tion. 18 (B) The President may prohibit the sale of 19 any defense articles, defense services, or design 20 and construction services under the Arms Export 21 Control Act (22 U.S.C. 2751 et seq.) to the agen-22 cy or instrumentality. 23 (C) The President may prohibit the 24 issuance of licenses for export of any item on the 25 VerDate Sep 11 2014 07:14 May 08, 2024 Jkt 049200 PO 00000 Frm 00034 Fmt 6652 Sfmt 6203 E:\BILLS\S3874.RS S3874 kjohnson on DSK7ZCZBW3PROD with $$_JOB 35 •S 3874 RS United States Munitions List under section 1 38(a)(1) of the Arms Export Control Act (22 2 U.S.C. 2778(a)(1)) that include the agency or in-3 strumentality as a party to the license. 4 (D) The President may prohibit the export 5 of any goods or technologies controlled for na-6 tional security reasons under the Export Admin-7 istration Regulations under subchapter C of 8 chapter VII of title 15, Code of Federal Regula-9 tions, or successor regulations, to the agency or 10 instrumentality, except that such prohibition 11 shall not apply to any transaction subject to the 12 reporting requirements of title V of the National 13 Security Act of 1947 (50 U.S.C. 3091 et seq.). 14 (E) The President may prohibit any United 15 States financial institution from making loans 16 or providing any credit or financing totaling 17 more than $10,000,000 to the agency or instru-18 mentality, except that this subparagraph shall 19 not apply to— 20 (i) any transaction subject to the re-21 porting requirements of title V of the Na-22 tional Security Act of 1947 (50 U.S.C. 3091 23 et seq.); 24 VerDate Sep 11 2014 07:14 May 08, 2024 Jkt 049200 PO 00000 Frm 00035 Fmt 6652 Sfmt 6203 E:\BILLS\S3874.RS S3874 kjohnson on DSK7ZCZBW3PROD with $$_JOB 36 •S 3874 RS (ii) the provision of medicines, medical 1 equipment, and humanitarian assistance; or 2 (iii) any credit, credit guarantee, or fi-3 nancial assistance provided by the Depart-4 ment of Agriculture to support the purchase 5 of food or other agricultural commodities. 6 (F) The President may exercise all powers 7 granted to the President by the International 8 Emergency Economic Powers Act (50 U.S.C. 9 1701 et seq.) (except that the requirements of sec-10 tion 202 of such Act (50 U.S.C. 1701) shall not 11 apply) to the extent necessary to block and pro-12 hibit all transactions in all property and inter-13 ests in property of the agency or instrumentality 14 if such property and interests in property are in 15 the United States, come within the United 16 States, or are or come within the possession or 17 control of a United States person. 18 (d) C ONGRESSIONALREQUESTSWITHRESPECT TO 19 F OREIGNPERSONSSUBJECT TOSANCTIONS.—Not later 20 than 120 days after receiving a request from the chairman 21 and ranking member of one of the appropriate congressional 22 committees with respect to whether a foreign person is sub-23 ject to sanctions under subsection (a) pursuant to the cri-24 teria set forth in that subsection, the President shall— 25 VerDate Sep 11 2014 07:14 May 08, 2024 Jkt 049200 PO 00000 Frm 00036 Fmt 6652 Sfmt 6203 E:\BILLS\S3874.RS S3874 kjohnson on DSK7ZCZBW3PROD with $$_JOB 37 •S 3874 RS (1) determine if the person meets those criteria; 1 and 2 (2) submit a classified or unclassified report to 3 such chairman and ranking member with respect to 4 the determination under paragraph (1) that includes 5 a statement of whether or not the President has im-6 posed or intends to impose sanctions with respect to 7 that person. 8 (e) P ENALTIES.— 9 (1) I N GENERAL.—The penalties provided for in 10 subsections (b) and (c) of section 206 of the Inter-11 national Emergency Economic Powers Act (50 U.S.C. 12 1705) shall apply to a person that knowingly violates, 13 attempts to violate, conspires to violate, or causes a 14 violation of regulations prescribed under section 12(b) 15 to carry out paragraph (1) or (2)(F) of subsection (c) 16 to the same extent that such penalties apply to a per-17 son that knowingly commits an unlawful act de-18 scribed in section 206(a) of that Act. 19 (2) A UTHORITIES.—The President may exercise 20 all authorities provided to the President under sec-21 tions 203 and 205 of the International Emergency 22 Economic Powers Act (50 U.S.C. 1702 and 1704) for 23 purposes of carrying out paragraphs (1) and (2)(F) 24 of subsection (c). 25 VerDate Sep 11 2014 07:14 May 08, 2024 Jkt 049200 PO 00000 Frm 00037 Fmt 6652 Sfmt 6203 E:\BILLS\S3874.RS S3874 kjohnson on DSK7ZCZBW3PROD with $$_JOB 38 •S 3874 RS (f) EXCEPTION.—The President shall not be required 1 to impose sanctions under this section with respect to a for-2 eign person or an agency or instrumentality of a foreign 3 state if the President certifies in writing to the appropriate 4 congressional committees that— 5 (1) the foreign person or agency or instrumen-6 tality (as the case may be)— 7 (A) is no longer carrying out activities or 8 transactions subject to sanctions under this sec-9 tion; or 10 (B) has taken and is continuing to take sig-11 nificant verifiable steps toward terminating ac-12 tivities or transactions subject to sanctions under 13 this section; and 14 (2) the President has received reliable assurances 15 from the foreign person or agency or instrumentality 16 (as the case may be) that it will not carry out any 17 activities or transactions subject to sanctions under 18 this section in the future. 19 (g) W AIVER.—The President may waive, on a case-by- 20 case basis and for renewable periods of not more than 180 21 days, a requirement under this section to impose or main-22 tain sanctions with respect to a foreign person or agency 23 or instrumentality of a foreign state if the President— 24 VerDate Sep 11 2014 07:14 May 08, 2024 Jkt 049200 PO 00000 Frm 00038 Fmt 6652 Sfmt 6203 E:\BILLS\S3874.RS S3874 kjohnson on DSK7ZCZBW3PROD with $$_JOB 39 •S 3874 RS (1) determines that the waiver is in the national 1 security interest of the United States; and 2 (2) not less than 15 days before granting the 3 waiver, submits to the appropriate congressional com-4 mittees a report on the waiver and the justification 5 for the waiver. 6 (h) E FFECTIVEDATE.—This section shall take effect 7 on the date that is 180 days after the date of enactment 8 of this Act and apply with respect to activities and trans-9 actions described in subsection (a) that are carried out on 10 or after such date of enactment. 11 (i) S UNSET.—This section shall terminate on the ear-12 lier of— 13 (1) 30 days after the date on which the President 14 certifies to the appropriate congressional committees 15 that Hamas and the Palestinian Islamic Jihad, or 16 any successor or affiliate thereof— 17 (A) are no longer designated as a foreign 18 terrorist organization pursuant to section 219 of 19 the Immigration and Nationality Act (8 U.S.C. 20 1189); and 2 (ii) Executive Order 13224 (50 U.S.C. 3 1701 note; relating to blocking property and 4 prohibiting transactions with persons who 5 commit, threaten to commit, or support ter-6 rorism); and 7 (C) meet the criteria described in para-8 graphs (1) through (4) of section 9 of the Pales-9 tinian Anti-Terrorism Act of 2006 (Public Law 10 109–446; 22 U.S.C. 2378b note); or 11 (2) 3 years after the date of the enactment of this 12 Act. 13 SEC. 5. IMPOSITION OF SANCTIONS WITH RESPECT TO FOR-14 EIGN GOVERNMENTS THAT PROVIDE MATE-15 RIAL SUPPORT FOR THE TERRORIST ACTIVI-16 TIES OF HAMAS, THE PALESTINIAN ISLAMIC 17 JIHAD, OR ANY AFFILIATE OR SUCCESSOR 18 THEREOF. 19 (a) I DENTIFICATION.— 20 (1) I N GENERAL.—Not later than 180 days after 21 the date of the enactment of this Act, and every 180 22 days thereafter, the President shall submit to the ap-23 propriate congressional committees a report that 24 identifies the following: 25 VerDate Sep 11 2014 07:14 May 08, 2024 Jkt 049200 PO 00000 Frm 00040 Fmt 6652 Sfmt 6203 E:\BILLS\S3874.RS S3874 kjohnson on DSK7ZCZBW3PROD with $$_JOB 41 •S 3874 RS (A) Each government of a foreign country 1 that— 2 (i) the Secretary of State determines 3 has repeatedly provided support for acts of 4 international terrorism pursuant to section 5 1754(c) of the Export Control Reform Act of 6 2018 (50 U.S.C. 4813(c)), section 40 of the 7 Arms Export Control Act (22 U.S.C. 2780), 8 section 620A of the Foreign Assistance Act 9 of 1961 (22 U.S.C. 2371), or any other pro-10 vision of law; and 11 (ii) the President determines has pro-12 vided direct or indirect material support for 13 the terrorist activities of Hamas, the Pales-14 tinian Islamic Jihad, or any affiliate or 15 successor thereof. 16 (B) Each government of a foreign country 17 that— 18 (i) is not identified under subpara-19 graph (A); and 20 (ii) the President determines know-21 ingly engaged in a significant transaction 22 that contributes to the efforts by the govern-23 ment of a foreign country described in sub-24 paragraph (A)(i) to provide direct or indi-25 VerDate Sep 11 2014 07:14 May 08, 2024 Jkt 049200 PO 00000 Frm 00041 Fmt 6652 Sfmt 6203 E:\BILLS\S3874.RS S3874 kjohnson on DSK7ZCZBW3PROD with $$_JOB 42 •S 3874 RS rect material support for the terrorist ac-1 tivities of Hamas, the Palestinian Islamic 2 Jihad, or any affiliate or successor thereof. 3 (2) F ORM OF REPORT.—Each report submitted 4 under paragraph (1) shall be submitted in unclassi-5 fied form but may contain a classified annex. 6 (b) I MPOSITION OFSANCTIONS.—The President shall 7 impose the following sanctions with respect to each govern-8 ment of a foreign country identified under subparagraph 9 (A) or (B) of subsection (a)(1): 10 (1) The United States Government shall suspend, 11 for a period of one year, United States assistance to 12 the government of the foreign country. 13 (2) The Secretary of the Treasury shall instruct 14 the United States Executive Director to each appro-15 priate international financial institution to oppose, 16 and vote against, for a period of one year, the exten-17 sion by that institution of any loan or financial or 18 technical assistance to the government of the foreign 19 country. 20 (3) No item on the United States Munitions List 21 under section 38(a)(1) of the Arms Export Control 22 Act (22 U.S.C. 2778(a)(1)) or the Commerce Control 23 List set forth in Supplement No. 1 to part 774 of title 24 15, Code of Federal Regulations (or any successor 25 VerDate Sep 11 2014 07:14 May 08, 2024 Jkt 049200 PO 00000 Frm 00042 Fmt 6652 Sfmt 6203 E:\BILLS\S3874.RS S3874 kjohnson on DSK7ZCZBW3PROD with $$_JOB 43 •S 3874 RS list), may be exported to the government of the foreign 1 country for a period of one year. 2 (c) I MPOSITION OFADDITIONALSANCTIONSWITHRE-3 SPECT TOCERTAINFOREIGNGOVERNMENTS.—The Presi-4 dent shall impose the following additional sanctions with 5 respect to each government of a foreign country identified 6 under subsection (a)(1)(A): 7 (1) The President shall, pursuant to such regula-8 tions as the President may prescribe, prohibit any 9 transactions in foreign exchange that are subject to 10 the jurisdiction of the United States and in which the 11 government of the foreign country has any interest. 12 (2) The President shall, pursuant to such regula-13 tions as the President may prescribe, prohibit any 14 transfers of credit or payments between one or more 15 financial institutions or by, through, or to any finan-16 cial institution, to the extent that such transfers or 17 payments are subject to the jurisdiction of the United 18 States and involve any interest of the government of 19 the foreign country. 20 (d) M ILITARYUSEEXCEPTION.—The President shall 21 not be required to impose sanctions with respect to the gov-22 ernment of a foreign country pursuant to subsection (b)— 23 (1) with respect to materials intended to be used 24 by military or civilian personnel of the Armed Forces 25 VerDate Sep 11 2014 07:14 May 08, 2024 Jkt 049200 PO 00000 Frm 00043 Fmt 6652 Sfmt 6203 E:\BILLS\S3874.RS S3874 kjohnson on DSK7ZCZBW3PROD with $$_JOB 44 •S 3874 RS of the United States at military facilities in the coun-1 try; or 2 (2) if the application of such sanctions would 3 prevent the United States from meeting the terms of 4 any status of forces agreement to which the United 5 States is a party or otherwise would not further the 6 national security interests of the United States. 7 (e) W AIVER.—The President may waive the applica-8 tion of sanctions under this section on a case-by-case basis 9 and for renewable periods of not more than 180 days if 10 the President— 11 (1) determines that the waiver is in the national 12 security interests of the United States; and 13 (2) not less than 15 days before the granting of 14 the waiver, submits to the appropriate congressional 15 committees a report on the waiver and the justifica-16 tion for the waiver. 17 (f) E FFECTIVEDATE.—This section shall take effect 18 180 days after the date of the enactment of this Act and 19 apply with respect to activities and transactions described 20 in subparagraph (A) or (B) of subsection (a)(1) that are 21 carried out on or after such date of enactment. 22 (g) T ERMINATION ANDSUNSET.— 23 (1) T ERMINATION OF SANCTIONS.—The President 24 may terminate any sanctions imposed with respect to 25 VerDate Sep 11 2014 07:14 May 08, 2024 Jkt 049200 PO 00000 Frm 00044 Fmt 6652 Sfmt 6203 E:\BILLS\S3874.RS S3874 kjohnson on DSK7ZCZBW3PROD with $$_JOB 45 •S 3874 RS the government of a foreign country under subsection 1 (b) or (c) if the President determines and notifies the 2 appropriate congressional committees that the govern-3 ment of the foreign country is no longer carrying out 4 activities or transactions for which the sanctions were 5 imposed and has provided assurances to the United 6 States Government that it will not carry out those ac-7 tivities or transactions in the future. 8 (2) S UNSET.—This section shall terminate on the 9 earlier of— 10 (A) 30 days after the date on which the 11 President certifies to the appropriate congres-12 sional committees that Hamas and the Pales-13 tinian Islamic Jihad, or any successor or affil-14 iate thereof— 15 (i) are no longer designated as a for-16 eign terrorist organization pursuant to sec-17 tion 219 of the Immigration and Nation-18 ality Act (8 U.S.C. 1189); and 2 (II) Executive Order 13224 (50 3 U.S.C. 1701 note; relating to blocking 4 property and prohibiting transactions 5 with persons who commit, threaten to 6 commit, or support terrorism); and 7 (iii) meet the criteria described in 8 paragraphs (1) through (4) of section 9 of 9 the Palestinian Anti-Terrorism Act of 2006 10 (Public Law 109–446; 22 U.S.C. 2378b 11 note); or 12 (B) 2 years after the date of the enactment 13 of this Act. 14 SEC. 6. REPORT ON ACTIVITIES OF FOREIGN COUNTRIES 15 TO DISRUPT GLOBAL FUNDRAISING, FINANC-16 ING, AND MONEY LAUNDERING ACTIVITIES 17 OF HAMAS, THE PALESTINIAN ISLAMIC 18 JIHAD, OR ANY AFFILIATE OR SUCCESSOR 19 THEREOF. 20 (a) R EPORT.— 21 (1) I N GENERAL.—Not later than 180 days after 22 the date of the enactment of this Act, the President 23 shall submit to the appropriate committees of Con-24 gress a report that includes— 25 VerDate Sep 11 2014 07:14 May 08, 2024 Jkt 049200 PO 00000 Frm 00046 Fmt 6652 Sfmt 6203 E:\BILLS\S3874.RS S3874 kjohnson on DSK7ZCZBW3PROD with $$_JOB 47 •S 3874 RS (A) a list of foreign countries that provide 1 significant financial support for Hamas, the 2 Palestinian Islamic Jihad, or any affiliate or 3 successor thereof, or in which Hamas maintains 4 significant portions of its financial networks; 5 (B) with respect to each foreign country on 6 the list required by subparagraph (A)— 7 (i) an assessment of whether the gov-8 ernment of the country is taking measures 9 to restrict or block access to the assets of 10 Hamas, the Palestinian Islamic Jihad, or 11 any affiliate or successor thereof within the 12 territory of the country; and 13 (ii) in the case of a country the govern-14 ment of which is not taking measures to 15 freeze the assets of Hamas— 16 (I) an assessment of the reasons 17 that government is not taking adequate 18 measures to freeze those assets; and 19 (II) a description of measures 20 being taken by the United States Gov-21 ernment to encourage that government 22 to freeze those assets; 23 (C) a list of foreign countries in which 24 Hamas, the Palestinian Islamic Jihad, or any 25 VerDate Sep 11 2014 07:14 May 08, 2024 Jkt 049200 PO 00000 Frm 00047 Fmt 6652 Sfmt 6203 E:\BILLS\S3874.RS S3874 kjohnson on DSK7ZCZBW3PROD with $$_JOB 48 •S 3874 RS affiliate or successor thereof, conducts significant 1 fundraising, financing, or money laundering ac-2 tivities; 3 (D) with respect to each foreign country on 4 the list required by subparagraph (C)— 5 (i) an assessment of whether the gov-6 ernment of the country is taking measures 7 to disrupt known fundraising, financing, or 8 money laundering activities of Hamas, the 9 Palestinian Islamic Jihad, or any affiliate 10 or successor thereof within the territory of 11 the country; and 12 (ii) in the case of a country the govern-13 ment of which is not taking measures to 14 disrupt those activities— 15 (I) an assessment of the reasons 16 that government is not taking measures 17 to disrupt those activities; and 18 (II) a description of measures 19 being taken by the United States Gov-20 ernment to encourage that government 21 to improve measures to disrupt those 22 activities; and 23 (E) a list of foreign countries from which 24 Hamas, the Palestinian Islamic Jihad, or any 25 VerDate Sep 11 2014 07:14 May 08, 2024 Jkt 049200 PO 00000 Frm 00048 Fmt 6652 Sfmt 6203 E:\BILLS\S3874.RS S3874 kjohnson on DSK7ZCZBW3PROD with $$_JOB 49 •S 3874 RS affiliate or successor thereof, acquires surveil-1 lance equipment, electronic monitoring equip-2 ment, or other means to inhibit communication 3 or political expression in Gaza. 4 (2) F ORM.—The report required by paragraph 5 (1) shall be submitted in unclassified form to the 6 greatest extent possible and may contain a classified 7 annex. 8 (b) B RIEFING.—Not later than 180 days after the date 9 of the enactment of this Act, and every 180 days thereafter 10 for the following 3 years, the Secretary of State, the Sec-11 retary of the Treasury, and the heads of other applicable 12 Federal departments and agencies (or their designees) shall 13 provide to the appropriate committees of Congress a brief-14 ing on the disposition of the assets and activities of Hamas, 15 the Palestinian Islamic Jihad, or any successor or affiliate 16 thereof related to fundraising, financing, and money laun-17 dering worldwide. 18 (c) A PPROPRIATECOMMITTEES OF CONGRESSDE-19 FINED.—In this section, the term ‘‘appropriate committees 20 of Congress’’ means— 21 (1) the Committee on Foreign Relations, the 22 Committee on Banking, Housing, and Urban Affairs, 23 and the Select Committee on Intelligence of the Sen-24 ate; and 25 VerDate Sep 11 2014 07:14 May 08, 2024 Jkt 049200 PO 00000 Frm 00049 Fmt 6652 Sfmt 6203 E:\BILLS\S3874.RS S3874 kjohnson on DSK7ZCZBW3PROD with $$_JOB 50 •S 3874 RS (2) the Committee on Foreign Affairs, the Com-1 mittee on Financial Services, and the Permanent Se-2 lect Committee on Intelligence of the House of Rep-3 resentatives. 4 SEC. 7. SANCTIONS WITH RESPECT TO THREATS TO CUR-4 RENT OR FORMER UNITED STATES OFFI-5 CIALS. 6 (a) I NGENERAL.—On and after the date that is 180 7 days after the date of the enactment of this Act, the Presi-8 dent shall impose the sanctions described in subsection (b) 9 with respect to any foreign person the President determines 10 has, on or after such date of enactment, ordered, directed, 11 or taken material steps to carry out any use of violence 12 or has attempted or threatened to use violence against any 13 current or former official of the Government of the United 14 States. 15 (b) S ANCTIONSDESCRIBED.—The sanctions described 16 in this subsection are the following: 17 (1) I NADMISSIBILITY TO UNITED STATES .—In 18 the case of a foreign person who is an individual— 19 (A) ineligibility to receive a visa to enter 20 the United States or to be admitted to the United 21 States; or 22 (B) if the individual has been issued a visa 23 or other documentation, revocation, in accord-24 ance with section 221(i) of the Immigration and 25 VerDate Sep 11 2014 07:14 May 08, 2024 Jkt 049200 PO 00000 Frm 00056 Fmt 6652 Sfmt 6203 E:\BILLS\S3874.RS S3874 kjohnson on DSK7ZCZBW3PROD with $$_JOB 57 •S 3874 RS Nationality Act (8 U.S.C. 1201(i)), of the visa or 1 other documentation. 2 (2) B LOCKING OF PROPERTY .—The blocking, in 3 accordance with the International Emergency Eco-4 nomic Powers Act (50 U.S.C. 1701 et seq.), of all 5 transactions in all property and interests in property 6 of a foreign person if such property and interests in 7 property are in the United States, come within the 8 United States, or are or come within the possession 9 or control of a United States person. 10 (c) E NFORCEMENT OF BLOCKING OFPROPERTY.—A 11 person that violates, attempts to violate, conspires to vio-12 late, or causes a violation of a sanction described in sub-13 section (b)(2) that is imposed by the President or any regu-14 lation, license, or order issued to carry out such a sanction 15 shall be subject to the penalties set forth in subsections (b) 16 and (c) of section 206 of the International Emergency Eco-17 nomic Powers Act (50 U.S.C. 1705) to the same extent as 18 a person that commits an unlawful act described in sub-19 section (a) of that section. 20 (d) W AIVER.— 21 (1) I N GENERAL.—The President may waive the 22 application of sanctions under this section for renew-23 able periods not to exceed 180 days if the President— 24 VerDate Sep 11 2014 07:14 May 08, 2024 Jkt 049200 PO 00000 Frm 00057 Fmt 6652 Sfmt 6203 E:\BILLS\S3874.RS S3874 kjohnson on DSK7ZCZBW3PROD with $$_JOB 58 •S 3874 RS (A) determines that such a waiver is in the 1 vital national security interests of the United 2 States; and 3 (B) not less than 15 days before the grant-4 ing of the waiver, submits to the appropriate 5 congressional committees a notice of and jus-6 tification for the waiver. 7 (e) T ERMINATION ANDSUNSET.— 8 (1) T ERMINATION OF SANCTIONS.—The President 9 may terminate the application of sanctions under this 10 section with respect to a person if the President deter-11 mines and reports to the appropriate congressional 12 committees not later than 15 days before the termi-13 nation of the sanctions that— 14 (A) credible information exists that the per-15 son did not engage in the activity for which 16 sanctions were imposed; 17 (B) the person has credibly demonstrated a 18 significant change in behavior, has paid an ap-19 propriate consequence for the activity for which 20 sanctions were imposed, and has credibly com-21 mitted to not engage in an activity described in 22 subsection (a) in the future; or 23 VerDate Sep 11 2014 07:14 May 08, 2024 Jkt 049200 PO 00000 Frm 00058 Fmt 6652 Sfmt 6203 E:\BILLS\S3874.RS S3874 kjohnson on DSK7ZCZBW3PROD with $$_JOB 59 •S 3874 RS (C) the termination of the sanctions is in 1 the vital national security interests of the United 2 States. 3 (2) S UNSET.—The requirement to impose sanc-4 tions under this section shall terminate on the date 5 that is 4 years after the date of the enactment of this 6 Act. 7 SEC. 10. RESOURCES FOR SANCTIONS IMPLEMENTATION AT 8 THE DEPARTMENT OF STATE. 9 (a) S ENSE OFCONGRESS.—It is the sense of Congress 10 that sanctions are a vital foreign policy and national secu-11 rity tool, and as such, it is critical that the Department 12 of State and other agencies with responsibilities relating to 13 sanctions across the executive branch— 14 (1) are fully staffed, including through the 15 prompt confirmation by the Senate of a qualified 16 head of the Office of Sanctions Coordination of the 17 Department of State; and 18 (2) have the resources and infrastructure nec-19 essary for the successful development and implementa-20 tion of sanctions. 21 (b) I NCREASINGRESOURCES AND IMPROVINGMOD-22 ERNIZATION FORSANCTIONSIMPLEMENTATION.—The Sec-23 retary of State shall take steps to modernize the sanctions 24 VerDate Sep 11 2014 07:14 May 08, 2024 Jkt 049200 PO 00000 Frm 00059 Fmt 6652 Sfmt 6203 E:\BILLS\S3874.RS S3874 kjohnson on DSK7ZCZBW3PROD with $$_JOB 60 •S 3874 RS infrastructure and increase resources dedicated to imple-1 menting sanctions, including by— 2 (1) ensuring the Department of State has nec-3 essary subscriptions and access to open-source data-4 bases for purposes of making determinations to sup-5 port the designation of persons for the imposition of 6 sanctions; 7 (2) equipping bureaus involved in drafting and 8 reviewing evidentiary packages to support such des-9 ignations with sufficient technical resources to do so, 10 including an adequate number of workstations that 11 can be used to review classified information; and 12 (3) increasing the number of personnel dedicated 13 to making and reviewing such designations. 14 (c) R EPORT ONMODERNIZATIONSEFFORTS.—Not 15 later than 180 days after the date of the enactment of this 16 Act, the Secretary of State shall submit to the appropriate 17 congressional committees a report describing steps the De-18 partment of State is taking to address challenges in the 19 ability of the Department to support the designation of per-20 sons for the imposition of sanctions. 21 (d) A UTHORIZATION OF APPROPRIATION.—There is 22 authorized to be appropriated to the Secretary of State for 23 fiscal year 2025 $15,000,000 to carry out this section. 24 VerDate Sep 11 2014 07:14 May 08, 2024 Jkt 049200 PO 00000 Frm 00060 Fmt 6652 Sfmt 6203 E:\BILLS\S3874.RS S3874 kjohnson on DSK7ZCZBW3PROD with $$_JOB 61 •S 3874 RS SEC. 11. REPORT ON IMPACTS ON THE ISLAMIC REPUBLIC 1 OF IRAN OF SANCTIONS IMPOSED BY THE 2 UNITED STATES. 3 (a) I NGENERAL.—Not later than 90 days after the 4 date of the enactment this Act, the Secretary of State, in 5 consultation with the Secretary of the Treasury and draw-6 ing on subject-matter experts including economists and stat-7 isticians from the Department of State and the Department 8 of the Treasury, shall submit to the appropriate congres-9 sional committees a report on the impacts on the Islamic 10 Republic of Iran of sanctions imposed by the United States. 11 (b) E LEMENTS.—The report required by subsection (a) 12 shall include an assessment of the following: 13 (1) The impact of sanctions imposed by the 14 United States on the following: 15 (A) Problematic activities and policies of 16 the Islamic Republic of Iran, including ballistic 17 missile development, proliferation of Iranian 18 drones and missiles to state and non-state actors, 19 uranium enrichment, and funding of terrorist 20 groups in the ‘‘Axis of Resistance’’, and how 21 sanctions have meaningfully impacted the ability 22 of such groups to operate. 23 (B) Key officials of the Iranian regime, in-24 cluding their access to alternative financial mar-25 VerDate Sep 11 2014 07:14 May 08, 2024 Jkt 049200 PO 00000 Frm 00061 Fmt 6652 Sfmt 6203 E:\BILLS\S3874.RS S3874 kjohnson on DSK7ZCZBW3PROD with $$_JOB 62 •S 3874 RS kets, their standard of living, and impacts to 1 their personal wealth. 2 (C) The operations of independent civil so-3 ciety organizations in Iran, including the ability 4 of such organizations to access products that 5 would allow them to document and share human 6 rights abuses, promote democratic norms, and 7 engage in political dissent. 8 (D) The efficacy of licensing actions aimed 9 at ensuring the people of Iran have access to cir-10 cumvention technologies around Iranian regime 11 firewalls and censors to promote internet free-12 dom, including General License D-2 of the De-13 partment of the Treasury. 14 (E) The standard of living of the people of 15 Iran, including— 16 (i) the impact on the purchasing power 17 of the people of Iran and their ability to af-18 ford and acquire food and medicine; and 19 (ii) changes in the size of the working 20 and middle classes in Iran, including im-21 pacts to the poverty rate in Iran. 22 (F) The growth of unofficial economies con-23 trolled by officials of the Iranian regime and 24 VerDate Sep 11 2014 07:14 May 08, 2024 Jkt 049200 PO 00000 Frm 00062 Fmt 6652 Sfmt 6203 E:\BILLS\S3874.RS S3874 kjohnson on DSK7ZCZBW3PROD with $$_JOB 63 •S 3874 RS members of the Islamic Revolutionary Guard 1 Corps. 2 (2) What industries in Iran remain unaffected 3 by such sanctions. 4 SEC. 12.
