Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. MEMORANDUM OF UNDERSTANDING TO AD-3
DRESS POTENTIAL IMPACTS OF A CERTAIN 4
RECORD OF DECISION ON THE UPPER COLO-5
RADO RIVER BASIN FUND. 6
(a) I
NGENERAL.—As soon as practicable after the 7
date of enactment of this Act, the Secretary of the Inte-8
rior, acting through the Commissioner of Reclamation, 9
and the Secretary of Energy, acting through the Adminis-10
trator of the Western Area Power Administration, in con-11
sultation with the Glen Canyon Dam Adaptive Manage-12
ment Work Group, shall enter into a memorandum of un-13
derstanding to explore and address the impact that the 14
record of decision entitled the ‘‘Supplement to the 2016 15
Glen Canyon Dam Long-Term Experimental and Manage-16
ment Plan Record of Decision’’ and dated July 2024 (re-17
ferred to in this section as the ‘‘record of decision’’) has 18
on the Upper Colorado River Basin Fund (referred to in 19
this section as the ‘‘Fund’’). 20
(b) R
EQUIREDPLAN.—The memorandum of under-21
standing entered into under subsection (a) shall, using in-22
formation derived from existing hydropower contracts, in-23
clude the establishment of a plan to— 24

(1) address the effects that the record of deci-1
sion may have on Fund obligations including routine 2
operations, maintenance, and replacement of critical 3
infrastructure; 4
(2) address the impact that the record of deci-5
sion has on hydropower production at Glen Canyon 6
Dam, including costs to replace hydropower re-7
sources and grid reliability; and 8
(3) identify impacts that the record of decision 9
has had on species listed as a threatened species or 10
an endangered species under section 4 of the Endan-11
gered Species Act of 1973 (16 U.S.C. 1533). 12
(c) S
AVINGSCLAUSES.—Nothing in this Act shall 13
preempt rights or obligations under subchapter II of chap-14
ter 5 of title 5, United States Code (commonly referred 15
to as the ‘‘Administrative Procedure Act’’). 16
