Be it enacted by the Senate and House of Representa-1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Fort Ontario Holo-4 caust Refugee Shelter National Historical Park Establish-5 ment Act’’. 6 SEC. 2. DEFINITIONS. 7 In this Act: 8 (1) M AP.—The term ‘‘map’’ means the map en-9 titled ‘‘Fort Ontario Holocaust Refugee Shelter Na-10 VerDate Sep 11 2014 00:04 Apr 09, 2025 Jkt 059200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H1031.IH H1031 ssavage on LAPJG3WLY3PROD with BILLS 2 •HR 1031 IH tional Historical Park Proposed Boundary’’, num-1 bered 962/194,681, and dated September 2024. 2 (2) N ATIONAL HISTORICAL PARK .—The term 3 ‘‘National Historical Park’’ means the Fort Ontario 4 Holocaust Refugee Shelter National Historical Park 5 established by section 3(a)(1). 6 (3) S ECRETARY.—The term ‘‘Secretary’’ means 7 the Secretary of the Interior. 8 (4) S TATE.—The term ‘‘State’’ means the State 9 of New York. 10 SEC. 3. ESTABLISHMENT OF FORT ONTARIO HOLOCAUST 11 REFUGEE SHELTER NATIONAL HISTORICAL 12 PARK. 13 (a) E STABLISHMENT.— 14 (1) I N GENERAL.—Subject to paragraph (3), 15 there is established in the State as a unit of the Na-16 tional Park System the Fort Ontario Holocaust Ref-17 ugee Shelter National Historical Park. 18 (2) P URPOSE.—The purpose of the National 19 Historical Park is to preserve, protect, and interpret 20 for the benefit of present and future generations re-21 sources associated with the stories of the 982 refu-22 gees from World War II who were housed at Fort 23 Ontario from August of 1944 until February of 24 1946. 25 VerDate Sep 11 2014 00:04 Apr 09, 2025 Jkt 059200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H1031.IH H1031 ssavage on LAPJG3WLY3PROD with BILLS 3 •HR 1031 IH (3) CONDITIONS OF ESTABLISHMENT .— 1 (A) D ETERMINATION BY THE SEC -2 RETARY.—The National Historical Park shall 3 not be established until the date on which the 4 Secretary determines that a sufficient quantity 5 of land or interests in land has been acquired 6 from land identified as ‘‘Proposed Boundary’’ 7 on the map to constitute a manageable park 8 unit. 9 (B) N OTICE.—Not later than 30 days 10 after the date on which the Secretary makes a 11 determination under subparagraph (A), the 12 Secretary shall publish in the Federal Register 13 notice of the establishment of the National His-14 torical Park. 15 (4) M AP.—The map shall be on file and avail-16 able for public inspection in the appropriate offices 17 of the National Park Service. 18 (5) B OUNDARY.—The boundary of the National 19 Historical Park shall include any land or interests in 20 land acquired by the Secretary under this section. 21 (b) A DMINISTRATION.— 22 (1) I N GENERAL.—The Secretary shall admin-23 ister the National Historical Park in accordance 24 with— 25 VerDate Sep 11 2014 00:04 Apr 09, 2025 Jkt 059200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H1031.IH H1031 ssavage on LAPJG3WLY3PROD with BILLS 4 •HR 1031 IH (A) this section; and 1 (B) the laws generally applicable to units 2 of the National Park System, including— 3 (i) sections 100101(a), 100751(a), 4 100752, 100753, and 102101 of title 54, 5 United States Code; and 6 (ii) chapters 1003 and 3201 of title 7 54, United States Code. 8 (2) A GREEMENTS.— 9 (A) C OOPERATIVE AGREEMENTS .—In ac-10 cordance with section 101702 of title 54, 11 United States Code, the Secretary may enter 12 into cooperative agreements with the State or 13 other public and private entities to provide in-14 terpretive and educational services within the 15 National Historical Park. 16 (B) I NTERPRETATION AND RESTORATION 17 AGREEMENTS.—The Secretary may enter into 18 agreements to identify, interpret, and restore 19 nationally significant historic or cultural re-20 sources located on non-Federal land within the 21 boundary of, or in close proximity to, the Na-22 tional Historical Park. 23 (C) P UBLIC ACCESS.—Any cooperative 24 agreement entered into under subparagraph (B) 25 VerDate Sep 11 2014 00:04 Apr 09, 2025 Jkt 059200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H1031.IH H1031 ssavage on LAPJG3WLY3PROD with BILLS 5 •HR 1031 IH to provide assistance to non-Federal land shall 1 provide for reasonable public access to the non- 2 Federal land. 3 (3) A CQUISITION OF LAND.— 4 (A) I N GENERAL.—Subject to subpara-5 graph (B), the Secretary may acquire land and 6 interests in land located within the boundary of 7 the National Historical Park by— 8 (i) donation; 9 (ii) purchase with donated or appro-10 priated funds; or 11 (iii) exchange. 12 (B) L IMITATION.—Any land owned by the 13 State or a political subdivision of the State may 14 be acquired for inclusion in the National His-15 torical Park only by donation. 16 (4) M ANAGEMENT PLAN .—Not later than 3 fis-17 cal years after the date on which funds are made 18 available to carry out this section, the Secretary, in 19 consultation with the State, shall complete a general 20 management plan for the National Historical Park 21 in accordance with— 22 (A) section 100502 of title 54, United 23 States Code; and 24 VerDate Sep 11 2014 00:04 Apr 09, 2025 Jkt 059200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\H1031.IH H1031 ssavage on LAPJG3WLY3PROD with BILLS 6 •HR 1031 IH (B) any other applicable laws. 1 Æ VerDate Sep 11 2014 00:04 Apr 09, 2025 Jkt 059200 PO 00000 Frm 00006 Fmt 6652 Sfmt 6301 E:\BILLS\H1031.IH H1031 ssavage on LAPJG3WLY3PROD with BILLS
