Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SEC. 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Promoting Responsible 4
Oversight To Eliminate Communist Teachings for Our 5
Kids Act’’ or the ‘‘PROTECT Our Kids Act’’. 6
SEC. 2. PROHIBITION ON AVAILABILITY OF FUNDS. 7
(a) P
ROHIBITION.—Notwithstanding any other provi-8
sion of law, no funds may be made available under an ap-9
plicable program to any elementary school or secondary 10
school that— 11
(1) has a partnership in effect with a cultural or 12
language institute directly or indirectly funded by the 13
Government of the People’s Republic of China, includ-14
ing a Confucius Institute; 15
(2) operates a learning center directly or indi-16
rectly supported by the Government of the People’s 17
Republic of China (commonly referred to as a ‘‘Con-18
fucius Classroom’’); or 19
(3) otherwise receives support from an indi-20
vidual or entity acting directly or indirectly on behalf 21
of the Government of the People’s Republic of China, 22
including support in the form of teaching materials, 23
personnel, funds, or other resources. 24

(b) EFFECTIVEDATE.—The prohibition under sub-1
section (a) shall take effect on the date that is one year after 2
the date of the enactment of this Act. 3

ONTRACTSMADEPRIOR TODATE OFENACT-4
MENT.— 5
(1) I
N GENERAL.— 6
(A) W
AIVER REQUEST SUBMISSION .—In the 7
case of an elementary school or a secondary 8
school that is a party to a contract described in 9
paragraph (2), the school timely shall submit to 10
the Secretary a request for a waiver of the prohi-11
bition under subsection (a) that includes— 12
(i) the complete and unredacted text of 13
the contract, and if the contract is not in 14
English, a translated copy of the text into 15
English; and 16
(ii) a statement demonstrating that the 17
contract is for the benefit of the school’s 18
mission and students and will promote the 19
security, stability, and economic vitality of 20
the United States. 21
(B) W
AIVER ISSUANCE.—the Secretary, 22
upon receipt of a request submitted under sub-23
paragraph (A), may issue a waiver to the school 24
for a period beginning on the effective date speci-25

fied in subsection (b) and ending the date on 1
which the contract terminates. 2
(2) C
ONTRACTS DESCRIBED.—A contract is de-3
scribed in this paragraph if the contract— 4
(A) takes effect before the date of the enact-5
ment of this Act; 6
(B) continues to be effective after the effec-7
tive date specified in subsection (b); and 8
(C) relates to at least one of the cir-9
cumstances described in paragraph (1), (2), or 10
(3) of subsection (a). 11
(d) N
OTICE TOAFFECTEDSCHOOLS.—Not later than 12
90 days after the date of the enactment of this Act, the Sec-13
retary shall provide notice to elementary and secondary 14
schools of the requirements of this section together with 15
guidance for achieving compliance with such requirements. 16
SEC. 3. DEFINITIONS. 17
In this Act: 18
(1) A
PPLICABLE PROGRAM.—The term ‘‘applica-19
ble program’’ has the meaning given that term in sec-20
tion 400(c)(1) of the General Education Provisions 21
Act (20 U.S.C. 1221(c)(1)). 22
(2) E
SEA TERMS.—The terms ‘‘elementary 23
school’’, ‘‘secondary school’’, and ‘‘Secretary’’ have the 24
meanings given those terms in section 8101 of the El-25
