To amend title 18, United States Code, to prohibit child
pornography produced using artificial intelligence.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Protecting Our Chil-4
dren in an AI World Act of 2025’’. 5
SEC. 2. CHILD PORNOGRAPHY PRODUCED USING ARTIFI-6
CIAL INTELLIGENCE. 7
(a) E
LIMINATION OFAFFIRMATIVEDEFENSE.—Sec-8
tion 2252A(c) of title 18, United States Code, is amend-9
ed— 10

(1) in subsection (c)— 1
(A) paragraph (1), by striking ‘‘; or’’ at 2
the end; and 3
(B) by striking paragraph (2); and 4
(2) in the matter following subsection (c), by 5
striking ‘‘No affirmative defense under subsection 6
(c)(2) shall be available in any prosecution that in-7
volves child pornography as described in section 8
2256(8)(C).’’. 9
(b) D
EFINITION OF SEXUALLYEXPLICITCON-10
DUCT.—Section 2256(2)(B) of title 18, United States 11
Code, is amended— 12
(1) in clause (ii)(III), by striking ‘‘or’’ at the 13
end; 14
(2) in clause (iii), by adding ‘‘or’’ at the end; 15
and 16
(3) by adding at the end the following: 17
‘‘(iv) actual or simulated obscene exhi-18
bition of the clothed or unclothed genitals, 19
pubic area, buttocks, or female nipple;’’. 20

EVERABILITY.—If any provision of this Act, or 21
any amendment made by this Act, or the application of 22
such provision to any person, entity, government, or cir-23
cumstance, is held to be unconstitutional, the remainder 24
of this Act, or any amendment made thereby, or the appli-25
