Be it enacted by the Senate and House of Representa-1 tives of the United States of America in Congress assembled, 2 SECTION 1. PROHIBITION ON FLAGS OTHER THAN THE FLAG OF 1 THE UNITED STATES. 2 (a) P ROHIBITIONS.—No flag that is not the flag of 3 the United States may be flown, draped, or otherwise dis-4 played— 5 (1) on the exterior of a covered public building; 6 or 7 (2) in an area of a covered public building that 8 is fully accessible to the public, including an 9 entryway or hallway. 10 (b) E XCEPTIONS.—The prohibitions under subsection 11 (a) shall not apply to— 12 (1) a National League of Families POW/MIA 13 flag (as designated by section 902 of title 36, United 14 States Code); 15 (2) a Hostage and Wrongful Detainee flag (as 16 designated by section 904 of title 36, United States 17 Code); 18 (3) any flag that represents the nation of a vis-19 iting diplomat or a representative of the government 20 of such nation visiting the public building at which 21 the flag is displayed; 22 (4) in the case of a Member of Congress, the 23 State flag of the State represented by such Member 24 that is located outside or within the office of the 25 Member; 26 VerDate Sep 11 2014 17:08 Mar 15, 2025 Jkt 059200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H1313.IH H1313 kjohnson on DSK7ZCZBW3PROD with $$_JOB 3 •HR 1313 IH (5) any flag that represents a unit or branch of 1 the Armed Forces or a flag supporting the Armed 2 Forces; 3 (6) any flag of historical significance to the 4 United States, including the Betsy Ross flag, the 5 Gadsden flag, and the Bennington flag; 6 (7) a flag representing public safety; 7 (8) a flag commemorating a specific national 8 observance, including the 9/11 Memorial flag and 9 the Remembrance Day flag; 10 (9) in the case of a religious liturgy or cere-11 mony at a military installation or facility, any flag 12 that represents a religious organization or church 13 that is covered by section 501(c)(3) of the Internal 14 Revenue Code of 1986 and exempt from tax under 15 section 501(a) of such Code; 16 (10) in the case of a Federal agency, a flag rep-17 resenting such agency; 18 (11) any flag that represents an Indian Tribe 19 (as defined in section 4 of the Indian Self-Deter-20 mination and Education Assistance Act (25 U.S.C. 21 5304)); or 22 (12) any flag that represents the State, terri-23 tory, county, city, or local jurisdiction in which the 24 public building is located. 25 VerDate Sep 11 2014 17:08 Mar 15, 2025 Jkt 059200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H1313.IH H1313 kjohnson on DSK7ZCZBW3PROD with $$_JOB 4 •HR 1313 IH (c) DEFINITIONS.—In this section: 1 (1) F LAG OF THE UNITED STATES .—The term 2 ‘‘flag of the United States’’ has the meaning given 3 the term in section 700(b) of title 18, United States 4 Code. 5 (2) C OVERED PUBLIC BUILDING .— 6 (A) I N GENERAL.—The term ‘‘covered 7 public building’’ has the meaning given the 8 term in section 3301(a) of title 40, United 9 States Code. 10 (B) I NCLUSION.—The term ‘‘public build-11 ing’’ includes— 12 (i) a building in use by the Senate or 13 the House of Representatives, or otherwise 14 under the jurisdiction of the Architect of 15 the Capitol; 16 (ii) a military installation (as defined 17 in section 2801(c) of title 10, United 18 States Code); and 19 (iii) any embassy or consulate of the 20 United States. 21 Æ VerDate Sep 11 2014 17:08 Mar 15, 2025 Jkt 059200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\H1313.IH H1313 kjohnson on DSK7ZCZBW3PROD with $$_JOB
