To amend the Export Control Reform Act of 2018 relating
to licensing transparency.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Maintaining American 4
Superiority by Improving Export Control Transparency 5
Act’’. 6
SEC. 2. LICENSING TRANSPARENCY. 7
Section 1756 of the Export Control Reform Act of 8
2018 (50 U.S.C. 4815) is amended by adding at the end 9
the following: 10

‘‘(e) REPORT.— 1
‘‘(1) I
N GENERAL.—Not later than one year 2
after the date of the enactment of this subsection, 3
and not less frequently than annually thereafter, the 4
Secretary, shall, subject to the availability of appro-5
priations, submit to the appropriate congressional 6
committees a report on license applications, enforce-7
ment actions, and other requests for authorization 8
for the export, reexport, release, and in-country 9
transfer of items controlled under this part to cov-10
ered entities. 11
‘‘(2) E
LEMENTS.—The report required by para-12
graph (1) shall include, with respect to the one year 13
preceding the previous one-year period, the fol-14
lowing: 15
‘‘(A) For each license application or other 16
request for authorization, the name of the enti-17
ty submitting the application, a brief descrip-18
tion of the item (including the Export Control 19
Classification Number (ECCN) and level of 20
control, if applicable), the name of the end-user, 21
the end-user’s location, a value estimate, deci-22
sion with respect to the license application or 23
authorization, and the date of submission. 24

‘‘(B) The date, location, and result of any 1
related enforcement activities, such as end-use 2
checks, to ensure compliance with United 3
States export controls. 4
‘‘(C) Aggregate statistics on all license ap-5
plications and other requests for authorization 6
as described in subparagraph (A). 7
‘‘(3) C
ONFIDENTIALITY OF INFORMATION .— 8
The information required to be provided in the re-9
ports required by this subsection (other than the in-10
formation required by paragraph (2)(C)) shall be ex-11
empt from public disclosure pursuant to section 12
1761(h)(1). 13
‘‘(4) D
EFINITIONS.—In this subsection— 14
‘‘(A) the term ‘appropriate congressional 15
committees’ means— 16
‘‘(i) the Committee on Foreign Affairs 17
of the House of Representatives; and 18
‘‘(ii) the Committee on Banking, 19
Housing, and Urban Affairs of the Senate; 20
and 21
‘‘(B) the term ‘covered entity’ means any 22
entity that— 23
‘‘(i) is located or operating in a coun-24
try listed in Country Group D:5 under 25

‘‘(ii) is included on— 3
‘‘(I) the list maintained and set 4
forth in Supplement No. 4 to part 5
744 of the Export Administration 6
Regulations; or 7
‘‘(II) the list maintained and set 8
forth in Supplement No. 7 to part 9
744 of the Export Administration 10
Regulations.’’. 11
