To amend the Defense Production Act of 1950 with respect
to foreign investments in United States agriculture, and
for other purposes.

SECTION 1. SHORT TITLE. 1
This Act may be cited as the ‘‘Protecting American 2
Agriculture from Foreign Adversaries Act of 2025’’. 3
SEC. 2. INCLUSION OF SECRETARY OF AGRICULTURE ON 4
COMMITTEE ON FOREIGN INVESTMENT IN 5
UNITED STATES AND CONSIDERATION OF 6
CERTAIN AGRICULTURAL LAND TRANS-7
ACTIONS. 8
(a) I
NCLUSION ON THE COMMITTEE.—Section 9
721(k) of the Defense Production Act of 1950 (50 U.S.C. 10
4565(k)) is amended by adding at the end the following: 11
‘‘(8) I
NCLUSION OF THE SECRETARY OF AGRI -12
CULTURE.—The Secretary of Agriculture shall be a 13
member of the Committee with respect to a covered 14
transaction that involves— 15
‘‘(A) agricultural land; 16
‘‘(B) agriculture biotechnology; or 17
‘‘(C) the agriculture industry, including ag-18
ricultural— 19
‘‘(i) transportation; 20
‘‘(ii) storage; and 21
‘‘(iii) processing.’’. 22

ANDTRANSACTIONS.—Section 721(b)(1) of the Defense 24
Production Act of 1950 (50 U.S.C. 4565(b)(1)) is amend-25
ed by adding at the end the following: 26

‘‘(I) CONSIDERATION OF CERTAIN AGRI -1
CULTURAL LAND TRANSACTIONS .— 2
‘‘(i) I
N GENERAL.—After receiving no-3
tification from the Secretary of Agriculture 4
of a reportable agricultural land trans-5
action, the Committee shall determine— 6
‘‘(I) whether the transaction is a 7
covered transaction; and 8
‘‘(II) if the Committee deter-9
mines that the transaction is a cov-10
ered transaction, whether the Com-11
mittee should initiate a review pursu-12
ant to subparagraph (D), or take an-13
other action authorized under this sec-14
tion, with respect to the reportable ag-15
ricultural land transaction. 16
‘‘(ii) R
EPORTABLE AGRICULTURAL 17
LAND TRANSACTION .—In this subpara-18
graph, the term ‘reportable agricultural 19
land transaction’ means a transaction— 20
‘‘(I) that the Secretary of Agri-21
culture has reason to believe is a cov-22
ered transaction; 23
‘‘(II) that involves the acquisition 24
of an interest in agricultural land by 25

a foreign person of the People’s Re-1
public of China, the Democratic Peo-2
ple’s Republic of Korea, the Russian 3
Federation, or the Islamic Republic of 4
Iran; and 5
‘‘(III) with respect to which a 6
person is required to submit a report 7
to the Secretary of Agriculture under 8
section 2(a) of the Agricultural For-9
eign Investment Disclosure Act of 10
1978. 11
‘‘(iii) S
UNSET.—The requirements 12
under this subparagraph shall terminate, 13
with respect to a foreign person of the re-14
spective foreign country, on the date that 15
the People’s Republic of China, the Demo-16
cratic People’s Republic of Korea, the Rus-17
sian Federation, or the Islamic Republic of 18
Iran, as the case may be, is removed from 19
the list of foreign adversaries in section 20
791.4 of title 15, Code of Federal Regula-21
tions.’’. 22
