A BILL 
To require Federal employee health benefit plans to include 
assisted reproductive treatment benefits, and for other 
purposes. 
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Family Building 4
FEHB Fairness Act’’. 5
SEC. 2. FERTILITY TREATMENT BENEFITS. 6
(a) I
NGENERAL.—Section 8904 of title 5, United 7
States Code, is amended— 8
(1) in subsection (a)— 9

(A) in paragraph (1), by adding at the end 1
the following new subparagraph: 2
‘‘(G) Fertility treatment benefits.’’; and 3
(B) in paragraph (2)— 4
(i) by redesignating subparagraph (F) 5
as subparagraph (G); and 6
(ii) by inserting after subparagraph 7
(E) the following new subparagraph: 8
‘‘(F) Fertility treatment benefits.’’; and 9
(2) by adding at the end the following new sub-10
section: 11
‘‘(c) In this section, the term ‘fertility treatment’ 12
means— 13
‘‘(1) preservation of human oocytes, sperm, or 14
embryos for later reproductive use; 15
‘‘(2) artificial insemination, including 16
intravaginal insemination, intracervical insemination, 17
and intrauterine insemination; 18
‘‘(3) assisted reproductive technology, including 19
in vitro fertilization and other treatments or proce-20
dures in which reproductive genetic material, such as 21
oocytes, sperm, fertilized eggs, and embryos, are 22
handled, when clinically appropriate; 23
‘‘(4) genetic testing of embryos; 24

‘‘(5) medications prescribed or obtained over- 1
the-counter, as indicated for fertility; 2
‘‘(6) gamete donation; and 3
‘‘(7) such other information, referrals, treat-4
ments, procedures, medications, laboratory services, 5
technologies, and services relating to fertility as the 6
Director of the Office of Personnel Management, in 7
coordination with the Secretary of Health and 8
Human Services, determines appropriate.’’. 9
(b) E
FFECTIVEDATE.—The amendments made by 10
this Act shall take effect on the date that is 1 year after 11
the date of the enactment of this Act. 12
