PROHIBITION ON USE OF FUNDS SUPPORTING ANY 1 ACTIVITIES WITHIN THE XINJIANG UYGHUR 2 AUTONOMOUS REGION OF THE PEOPLE’S RE-3 PUBLIC OF CHINA. 4 (a) I NGENERAL.—No funds available to the Depart-5 ment of State or the United States Agency for Inter-6 national Development may be used to develop, design, 7 plan, promulgate, implement, or execute a policy, pro-8 gram, or contract that knowingly uses goods, wares, arti-9 cles, or merchandise mined, produced, or manufactured 10 wholly or in part in the Xinjiang Uyghur Autonomous Re-11 gion of the People’s Republic of China or produced by a 12 covered entity, unless such activity is specifically author-13 ized pursuant to subsection (b). 14 (b) S PECIFICAUTHORIZATION.—The Secretary of 15 State may specifically authorize an activity otherwise pro-16 hibited by subsection (a) if— 17 (1) the Secretary— 18 (A) obtains in writing an assurance from 19 the relevant program partner, implementor, or 20 contractor that such partner, implementor, or 21 contractor— 22 (i) will not use goods, wares, articles, 23 or merchandise mined, produced, or manu-24 factured wholly or in part in Xinjiang 25 VerDate Sep 11 2014 02:58 Mar 15, 2025 Jkt 059200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H1724.IH H1724 kjohnson on DSK7ZCZBW3PROD with $$_JOB 3 •HR 1724 IH Uyghur Autonomous Region of the PRC 1 with respect to the program; and 2 (ii) will develop a system to ensure 3 compliance with the requirements in sub-4 section (a); and 5 (B) provides notice to the Chair and Rank-6 ing Member of the Committee on Foreign Af-7 fairs of the House of Representatives and the 8 Chair and Ranking Member of the Committee 9 on Foreign Relations of the Senate not later 10 than 15 days before authorizing the activity; 11 and 12 (2) the activity is not otherwise prohibited. 13 (c) R EPORT.—The Secretary of State shall submit to 14 the Committee on Foreign Affairs of the House of Rep-15 resentatives and the Committee on Foreign Relations of 16 the Senate a report on an annual basis for three years 17 that describes— 18 (1) all activities prohibited by subsection (a) 19 that were carried out in violation of such prohibition 20 and not specifically authorized pursuant to sub-21 section (b) in the previous year; 22 (2) any challenges in enforcing the require-23 ments of this section; and 24 VerDate Sep 11 2014 02:58 Mar 15, 2025 Jkt 059200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H1724.IH H1724 kjohnson on DSK7ZCZBW3PROD with $$_JOB 4 •HR 1724 IH (3) a plan to improve enforcement of the re-1 quirements of this section. 2 (e) D EFINITIONS.—In this section: 3 (1) The term ‘‘covered entity’’ means an entity 4 listed pursuant to clause (i), (ii), (iv), or (v) of sec-5 tion 2(d)(2)(B) of Public Law 117–78 (135 Stat. 6 1527) under the strategy developed by section 2(c) 7 of such Public Law 117–78. 8 (2) The term ‘‘forced labor’’ has the meaning 9 given that term in section 307 of the Tariff Act of 10 1930 (19 U.S.C. 1307). 11 Æ VerDate Sep 11 2014 02:58 Mar 15, 2025 Jkt 059200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\H1724.IH H1724 kjohnson on DSK7ZCZBW3PROD with $$_JOB
