Be it enacted by the Senate and House of Representa-1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘State Immigration En-4 forcement Act’’. 5 SEC. 2. STATE ENFORCEMENT OF IMMIGRATION LAWS. 6 States, or political subdivisions of States, may enact, 7 implement and enforce criminal penalties that penalize the 8 same conduct that is prohibited in the criminal provisions 9 of immigration laws (as defined in section 101(a)(17) of 10 the Immigration and Nationality Act (8 U.S.C. 11 VerDate Sep 11 2014 23:41 Jan 30, 2025 Jkt 059200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H218.IH H218 ssavage on LAPJG3WLY3PROD with BILLS 2 •HR 218 IH 1101(a)(17))), as long as the criminal penalties do not ex-1 ceed the relevant Federal criminal penalties (without re-2 gard to ancillary issues such as the availability of proba-3 tion or pardon). States, or political subdivisions of States, 4 may enact, implement and enforce civil penalties that pe-5 nalize the same conduct that is prohibited in the civil pro-6 visions of immigration laws (as defined in such section 7 101(a)(17)), as long as the civil penalties do not exceed 8 the relevant Federal civil penalties. 9 SEC. 3.
