A BILL
To prevent use of United Nations facilities located in the
United States by the ICC, and for other purposes.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Move the ICC Out 4
of NYC Act of 2025’’. 5
SEC. 2. FINDINGS. 6
Congress finds the following: 7
(1) The Senate ratified the Charter of the 8
United Nations in 1945, finalizing the accession of 9
the United States to the United Nations. 10

(2) Congress enacted the Joint Resolution of 1
August 4, 1947 (61 Stat. 756, chapter 482; 22 2
U.S.C. 287 note) (commonly known as the ‘‘United 3
Nations Headquarters Agreement Act’’) to authorize 4
the United Nations headquarters in New York, New 5
York. 6
(3) The Senate has not ratified the Rome Stat-7
ute of the International Criminal Court. 8
(4) The International Criminal Court has no ju-9
risdiction within the United States or over United 10
States persons. 11
(5) The International Criminal Court maintains 12
an office within the United Nations headquarters in 13
New York, New York. 14
(6) Since its approval by Congress, the United 15
Nations Headquarters Agreement has been amended 16
through supplemental agreements, with the United 17
States Ambassador to the United Nations serving as 18
representative of the United States. 19
SEC. 3. DEFINITIONS. 20
In this Act: 21

NTERNATIONAL CRIMINAL COURT ; ROME 22
STATUTE.—The terms ‘‘International Criminal 23
Court’’ and ‘‘Rome Statute’’ have the meaning given 24

those terms in section 2013 of the American Service- 1
Members’ Protection Act (22 U.S.C. 7432). 2
(2) U
NITED NATIONS HEADQUARTERS AGREE -3
MENT.—The term ‘‘United Nations Headquarters 4
Agreement’’ means the Agreement regarding the 5
Headquarters of the United Nations, signed at Lake 6
Success on June 26, 1947, and entered into force on 7
November 21, 1947, between the United Nations 8
and the United States. 9
SEC. 4. SUPPLEMENT TO UNITED NATIONS HEADQUARTERS 10
AGREEMENT. 11
Not later than 30 days after the opening date of the 12
80th session of the United Nations General Assembly, the 13
United States Ambassador to the United Nations shall 14
seek to open negotiations at the United Nations for a sup-15
plemental agreement to the United Nations Headquarters 16
Agreement to prohibit the United Nations from hosting, 17
leasing, or otherwise allowing use of its facilities within 18
the United States by the International Criminal Court. 19
