ANALYSIS OF ONLY TWO ALTERNATIVES (ACTION 1 VERSUS NO ACTION) IN PROPOSED COLLABO-2 RATIVE FOREST MANAGEMENT ACTIVITIES. 3 (a) A PPLICATION TOCERTAINENVIRONMENTAL AS-4 SESSMENTS AND ENVIRONMENTAL IMPACTSTATE-5 MENTS.—This section shall apply whenever the Secretary 6 concerned prepares an environmental assessment or an en-7 vironmental impact statement pursuant to section 102 of 8 the National Environmental Policy Act of 1969 (42 U.S.C. 9 4332) for a forest management activity that— 10 (1) will occur on lands identified as the Sec-11 retary concerned as suitable for timber production; 12 and 13 (2) meets at least one of the following condi-14 tions: 15 (A) The forest management activity will 16 occur on lands designated by the Secretary (or 17 designee thereof) pursuant to section 602(b) of 18 the Healthy Forests Restoration Act of 2003 19 (16 U.S.C. 6591a(b)), notwithstanding whether 20 such forest management activity is initiated 21 prior to the date of enactment of this Act. 22 (B) The forest management activity is de-23 veloped through a collaborative process. 24 (C) The forest management activity is pro-25 posed by a resource advisory committee. 26 VerDate Sep 11 2014 04:03 Jan 30, 2025 Jkt 059200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H184.IH H184 kjohnson on DSK7ZCZBW3PROD with $$_JOB 3 •HR 184 IH (D) The forest management activity is cov-1 ered by a community wildfire protection plan. 2 (b) C ONSIDERATION OFALTERNATIVES.—In the case 3 of an environmental assessment or environmental impact 4 statement described in subsection (a), the Secretary con-5 cerned shall study, develop, and describe only the following 6 two alternatives: 7 (1) The forest management activity. 8 (2) The alternative of no action. 9 (c) E LEMENTS OF NOACTIONALTERNATIVE.—In 10 the case of the alternative of no action described in sub-11 section (b)(2), the Secretary concerned shall consider 12 whether to evaluate— 13 (1) the effect of no action on— 14 (A) forest health; 15 (B) potential losses of life and property; 16 (C) habitat diversity; 17 (D) wildfire potential; 18 (E) insect and disease potential; and 19 (F) timber production; and 20 (2) the implications of a resulting decline in 21 forest health, loss of habitat diversity, wildfire, or in-22 sect or disease infestation (given fire and insect and 23 disease historic cycles) on— 24 (A) potential losses of life and property; 25 VerDate Sep 11 2014 04:03 Jan 30, 2025 Jkt 059200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H184.IH H184 kjohnson on DSK7ZCZBW3PROD with $$_JOB 4 •HR 184 IH (B) domestic water supply in the project 1 area; 2 (C) wildlife habitat loss; and 3 (D) other economic and social factors. 4 (d) D EFINITIONS.—In this section: 5 (1) C OLLABORATIVE PROCESS .—The term ‘‘col-6 laborative process’’ means a process relating to the 7 management of National Forest System lands or 8 public lands by which a project or forest manage-9 ment activity is developed and implemented by the 10 Secretary concerned through collaboration with in-11 terested persons, as described in section 12 603(b)(1)(C) of the Healthy Forests Restoration Act 13 of 2003 (16 U.S.C. 6591b(b)(1)(C)). 14 (2) C OMMUNITY WILDFIRE PROTECTION 15 PLAN.—The term ‘‘community wildfire protection 16 plan’’ has the meaning given the term in section 101 17 of the Healthy Forests Restoration Act of 2003 (16 18 U.S.C. 6511). 19 (3) R ESOURCE ADVISORY COMMITTEE .—The 20 term ‘‘resource advisory committee’’ has the mean-21 ing given the term in section 201 of the Secure 22 Rural Schools and Community Self-Determination 23 Act of 2000 (16 U.S.C. 7121). 24 VerDate Sep 11 2014 04:03 Jan 30, 2025 Jkt 059200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H184.IH H184 kjohnson on DSK7ZCZBW3PROD with $$_JOB 5 •HR 184 IH (4) SECRETARY CONCERNED .—The term ‘‘Sec-1 retary concerned’’ means— 2 (A) the Secretary of Agriculture, with re-3 spect to National Forest System lands; and 4 (B) the Secretary of the Interior, with re-5 spect to public lands. 6 Æ VerDate Sep 11 2014 04:03 Jan 30, 2025 Jkt 059200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6301 E:\BILLS\H184.IH H184 kjohnson on DSK7ZCZBW3PROD with $$_JOB
