A BILL 
To require the establishment within the Department of De-
fense of a pilot program on arsenal workload 
sustainment, and for other purposes. 
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Arsenal Workload 4
Sustainment Act’’. 5
SEC. 2. PILOT PROGRAM ON ARSENAL WORKLOAD 6
SUSTAINMENT. 7
(a) F
INDINGS.—Congress finds the following: 8
(1) The United States has a long and proud 9
history of manufacturing defense products. 10

(2) Factories and arsenals of the Department 1
of the Army that are owned and operated by the 2
United States Government are a critical component 3
of the organic industrial base. 4
(3) The first ever National Defense Industrial 5
Strategy released in 2024 recognized the need of the 6
Department of Defense to more strategically utilize 7
the organic industrial base in order to maintain a 8
competitive military advantage. 9
(4) Sufficient workload at arsenals of the De-10
partment of the Army that are owned and operated 11
by the United States Government ensure cost effi-12
ciency and technical competence in peacetime, while 13
preserving the ability to provide an effective and 14
timely response to mobilizations, national defense 15
contingency situations, and other emergency require-16
ments. 17
(b) E
STABLISHMENT OF PILOTPROGRAM.—Not 18
later than 90 days after the date of the enactment of this 19
Act, the Secretary of Defense shall establish a pilot pro-20
gram to be known as the ‘‘Arsenal Workload Sustainment 21
Pilot Program’’ (in this section referred to as the ‘‘pilot 22
program’’). 23
(c) D
URATION.—The pilot program shall be con-24
ducted for a period of five years. 25

(d) PREFERENCES FOR PROCUREMENT ACTIONS OR 1

OLICITATIONS.— 2
(1) I
N GENERAL.—In carrying out the pilot 3
program, the Secretary of Defense shall give a pref-4
erence described in paragraph (2) for any procure-5
ment action or solicitation by a non-public partner 6
who has entered into a public-private partnership 7
with the Secretary in the source selection process if 8
such non-public partner uses an arsenal of the De-9
partment of the Army that is owned and operated by 10
the United States Government as a partner in any 11
type of contractual agreement with the United 12
States Government. 13
(2) P
REFERENCE DESCRIBED .—A preference 14
described in this paragraph is the addition of 20 15
percent to the price of any offer by a non-public 16
partner that does not use an arsenal of the Depart-17
ment of the Army that is owned and operated by the 18
United States Government as a partner in its bid for 19
the same procurement action or solicitation de-20
scribed in paragraph (1). 21
(3) F
URTHER PREFERENCE .—In selecting non- 22
public partners under paragraph (1), the Secretary 23
of Defense shall give preference to non-public part-24
ners that— 25

(A) utilize the Advanced Manufacturing 1
Center of Excellence of the Army; and 2
(B) ensure not less than 25 percent of the 3
activities under the partnership are performed 4
by employees of the Department of Defense. 5
(e) R
EPORTREQUIRED.— 6
(1) I
N GENERAL.—Not later than one year 7
after the date of the enactment of this Act, the Sec-8
retary of Defense shall submit to the appropriate 9
congressional committees a report on the activities 10
carried out under the pilot program, including a de-11
scription of any operational challenges identified. 12
(2) E
LEMENTS.—The report required under 13
paragraph (1) shall include the following: 14
(A) A breakout, by relevant budget ac-15
counts, of workload at an arsenal of the De-16
partment of the Army that is owned and oper-17
ated by the United States Government that was 18
achieved in the prior fiscal year, whether di-19
rectly or through public-private partnerships 20
under the pilot program. 21
(B) An assessment of relevant budget ac-22
counts where such an arsenal can be utilized to 23
meet future procurement needs of the Depart-24
ment of Defense, irrespective of cost. 25

(C) An outlook of expected workload at 1
each such arsenal during the period covered by 2
the future-years defense program submitted to 3
Congress under section 221 of title 10, United 4
States Code. 5
(D) The capital investments required to be 6
made at each such arsenal to ensure compliance 7
and operational capacity. 8
(f) D
EFINITIONS.—In this section: 9
(1) A
PPROPRIATE CONGRESSIONAL COMMIT -10
TEES.—The term ‘‘appropriate congressional com-11
mittees’’ means— 12
(A) the Committee on Armed Services and 13
the Subcommittee on Defense of the Committee 14
on Appropriations of the Senate; and 15
(B) the Committee on Armed Services and 16
the Subcommittee on Defense of the Committee 17
on Appropriations of the House of Representa-18
tives. 19
(2) N
ON-PUBLIC PARTNER.—The term ‘‘non- 20
public partner’’ means a corporation, individual, uni-21
versity, or nonprofit organization that is not part of 22
the United States Government. 23
