poses. 
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE; TABLE OF CONTENTS. 3

SEC. 2. ESTABLISHMENT OF FEMA AS CABINET-LEVEL

INDEPENDENT AGENCY. 2
(a) I
NGENERAL.—The Federal Emergency Manage-3
ment Agency is established as a cabinet-level independent 4
establishment in the executive branch. 5
(b) M
ISSION.—The primary mission of the Agency is 6
to reduce the loss of life and property and protect the Na-7
tion from all hazards, including natural disasters, acts of 8
terrorism, and other man-made disasters, by leading and 9
supporting the Nation in a risk-based, comprehensive 10
emergency management system of preparedness, protec-11
tion, response, recovery, and mitigation. 12
SEC. 3. DIRECTOR; DEPUTY DIRECTORS; REGIONAL OF-13
FICES. 14
(a) D
IRECTOR.— 15
(1) I
N GENERAL.—The Agency shall be headed 16
by a Director, who shall be appointed by the Presi-17
dent, by and with the advice and consent of the Sen-18
ate, and who shall report directly to the President. 19

(2) QUALIFICATIONS.—The Director shall be 1
appointed from among individuals who have— 2
(A) a demonstrated ability in and knowl-3
edge of emergency management and homeland 4
security; and 5
(B) not less than 5 years of executive lead-6
ership and management experience in the public 7
sector and 5 years of such experience in the pri-8
vate sector. 9
(3) E
XECUTIVE SCHEDULE .—Title 5, United 10
States Code, is amended— 11
(A) in section 5312 by adding at the end 12
the following: 13
‘‘Director of the Federal Emergency Management 14
Agency.’’; and 15
(B) in section 5313 by striking the item 16
relating to ‘‘Administrator of the Federal 17
Emergency Management Agency.’’. 18
(b) D
EPUTYDIRECTORS.— 19
(1) I
N GENERAL.—The President may appoint, 20
by and with the advice and consent of the Senate, 21
not more than 4 Deputy Directors to assist the Di-22
rector in carrying out the functions and authorities 23
of the Director. 24

(2) EXECUTIVE SCHEDULE .—Section 5314 of 1
title 5, United States Code, is amended by striking 2
‘‘Deputy Administrators, Federal Emergency Man-3
agement Agency’’ and inserting ‘‘Deputy Directors, 4
Federal Emergency Management Agency’’. 5
(c) R
EGIONALOFFICES.— 6
(1) I
N GENERAL.—There shall be in the Agency 7
10 Regional Offices, as identified by the Director. 8
(2) R
EGIONAL DIRECTORS.—Each Regional Of-9
fice shall be headed by a Regional Director who shall 10
be chosen by the Director. 11
SEC. 4. AUTHORITY AND RESPONSIBILITIES. 12
(a) I
NGENERAL.—The Director shall provide the 13
Federal leadership necessary to prepare for, respond to, 14
recover from, and mitigate hazards. 15
(b) S
TAFFORDACT.—The Director shall assist the 16
President in carrying out the functions under the Robert 17
T. Stafford Disaster Relief and Emergency Assistance Act 18
(42 U.S.C. 5121 et seq.) and carrying out all functions 19
and authorities given to the Administrator of the Federal 20
Emergency Management Agency under that Act. 21
(c) M
ISSION.—The responsibilities of the Director 22
shall include carrying out the mission of the Agency by 23
leading and supporting the Nation in a comprehensive 24
emergency management system of— 25

(1) mitigation, by taking sustained actions to 1
reduce or eliminate long-term risks to people and 2
property from hazards and their effects; 3
(2) preparedness, by planning, training, con-4
ducting exercises, and building the emergency man-5
agement profession to prepare effectively for miti-6
gating, responding to, and recovering from any haz-7
ard; 8
(3) response, by conducting emergency oper-9
ations to save lives and property through positioning 10
emergency equipment, personnel, and supplies, 11
through evacuating potential victims, through pro-12
viding food, water, shelter, and medical care to those 13
in need, and through restoring critical public serv-14
ices; and 15
(4) recovery, by rebuilding communities so indi-16
viduals, businesses, and governments can function 17
on their own, return to normal life, and protect 18
against future hazards. 19
(d) R
ESPONSEDUTIES.—In carrying out subsection 20
(c)(3), the Director, at a minimum, shall— 21
(1) help to ensure the effectiveness of emer-22
gency response providers in responding to a hazard; 23
(2) coordinate and provide the Federal Govern-24
ment’s response to hazards; 25

(3) build a comprehensive national incident 1
management system with Federal, State, and local 2
government personnel, agencies, and authorities to 3
respond to hazards; 4
(4) consolidate existing Federal Government 5
emergency response plans into a single, coordinated 6
plan to be known as the National Response Plan; 7
(5) administer and ensure the implementation 8
of the National Response Plan, including coordi-9
nating and ensuring the readiness of each emergency 10
support function under the National Response Plan; 11
and 12
(6) help ensure the acquisition of operable and 13
interoperable communications capabilities by Fed-14
eral, State, local, and tribal governments and emer-15
gency response providers. 16
(e) C
ONTINUITY OF GOVERNMENT.—The Director 17
shall prepare and implement the plans and programs of 18
the Federal Government for— 19
(1) continuity of operations; 20
(2) continuity of Government; and 21
(3) continuity of plans. 22
(f) O
THERDUTIES.—The Director shall— 23
(1) coordinate the National Advisory Council; 24

(2) maintain and operate within the Agency the 1
National Response Coordination Center (or its suc-2
cessor); 3
(3) develop and maintain a national emergency 4
management system that is capable of preparing for, 5
responding to, recovering from, and mitigating haz-6
ards of all magnitudes, including catastrophic disas-7
ters; and 8
(4) supervise grant programs administered by 9
the Agency. 10
(g) A
LL-HAZARDSAPPROACH.—In carrying out the 11
responsibilities under this section, the Director shall co-12
ordinate the implementation of an all-hazards strategy 13
that builds those common capabilities necessary to prepare 14
for, respond to, recover from, and mitigate hazards. 15
SEC. 5. OFFICE OF THE INSPECTOR GENERAL. 16
The Agency shall have an Office of the Inspector 17
General, headed by an Inspector General, in accordance 18
with chapter 4 of title 5, United States Code (commonly 19
known as the ‘‘Inspector General Act of 1978’’). 20
SEC. 6. TRANSFER OF FUNCTIONS. 21
(a) I
NGENERAL.—There shall be transferred to the 22
Director all functions of the Federal Emergency Manage-23
ment Agency, as such Agency was constituted on the day 24
before the date of enactment of this Act. 25

(b) INSPECTORGENERAL.—There shall be trans-1
ferred to the Inspector General all functions relating to 2
the Inspector General that were transferred from the Fed-3
eral Emergency Management Agency to the Department 4
of Homeland Security on or after January 1, 2003. 5
(c) T
RANSITIONPERIOD.—The transfers under this 6
section shall be carried out not later than 365 days fol-7
lowing the date of enactment of this Act. During the tran-8
sition period, the Secretary of Homeland Security shall 9
provide to the Director such assistance, including the use 10
of personnel and assets, as the Director may request in 11
preparing for the transfer. 12
SEC. 7. PERSONNEL AND OTHER TRANSFERS. 13
(a) P
ERSONNELAPPOINTMENTS.—The Director may 14
appoint and fix the compensation of such officers and em-15
ployees as may be necessary to carry out the respective 16
functions transferred by section 6. 17
(b) T
RANSFER AND ALLOCATIONS OF APPROPRIA-18
TIONS ANDPERSONNEL.—Except as otherwise provided 19
in this Act, the personnel employed in connection with, 20
and the assets, liabilities, contracts, property, records, and 21
unexpended balances of appropriations, authorizations, al-22
locations, and other funds employed, used, held, arising 23
from, available to, or to be made available in connection 24
with the functions transferred by section 6, subject to sec-25

tion 1531 of title 31, United States Code, shall be trans-1
ferred to the Agency. Unexpended funds transferred pur-2
suant to this subsection shall be used only for the purposes 3
for which the funds were originally authorized and appro-4
priated. 5
(c) I
NCIDENTALTRANSFERS.—The Director of the 6
Office of Management and Budget, in consultation with 7
the Director of the Federal Emergency Management 8
Agency, may make such determinations as may be nec-9
essary with regard to the functions transferred by section 10
6, and may make such additional incidental dispositions 11
of personnel, assets, liabilities, grants, contracts, property, 12
records, and unexpended balances of appropriations, au-13
thorizations, allocations, and other funds held, used, aris-14
ing from, available to, or to be made available in connec-15
tion with such functions, as may be necessary to carry out 16
the provisions of this Act. The Director of the Office of 17
Management and Budget shall provide for the termination 18
of the affairs of all entities terminated by this Act and 19
for such further measures and dispositions as may be nec-20
essary to effectuate the purposes of this Act. 21
(d) E
FFECT ONPERSONNEL.— 22
(1) I
N GENERAL.—Except as otherwise pro-23
vided by this Act, the transfer pursuant to this Act 24
of full-time personnel (except special Government 25

employees) and part-time personnel holding perma-1
nent positions shall not cause any such employee to 2
be separated or reduced in grade or compensation 3
for 1 year after the date of transfer of such em-4
ployee under this Act. 5
(2) E
XECUTIVE SCHEDULE POSITIONS .—Except 6
as otherwise provided in this Act, any person who, 7
on the day preceding the date of the transfers of 8
functions by section 6, held a position compensated 9
in accordance with the Executive Schedule pre-10
scribed in chapter 53 of title 5, United States Code, 11
and who, without a break in service, is appointed in 12
the Agency to a position having duties comparable to 13
the duties performed immediately preceding such ap-14
pointment shall continue to be compensated in such 15
new position at not less than the rate provided for 16
such previous position, for the duration of the serv-17
ice of such person in such new position. 18
SEC. 8. SAVINGS PROVISIONS. 19
(a) C
ONTINUINGEFFECT OFLEGALDOCUMENTS 20
ANDACTIONS.— 21
(1) I
N GENERAL.—The legal documents and ac-22
tions described in paragraph (2) shall continue in ef-23
fect according to their terms until modified, termi-24
nated, superseded, set aside, or revoked in accord-25

ance with law by the President, the Director, other 1
authorized official, a court of competent jurisdiction, 2
or by operation of law. 3
(2) L
EGAL DOCUMENTS AND ACTIONS DE -4
SCRIBED.—The legal documents and actions de-5
scribed in this paragraph are all orders, determina-6
tions, rules, regulations, permits, agreements, 7
grants, contracts, certificates, licenses, registrations, 8
privileges, and other administrative actions that 9
both— 10
(A) have been issued, made, granted, or al-11
lowed to become effective by the President, any 12
Federal agency or official thereof, or by a court 13
of competent jurisdiction, in the performance of 14
functions that are transferred by section 6; and 15
(B) are in effect on the date of the trans-16
fers of functions by section 6, or were final be-17
fore such date and are to become effective on 18
or after such date. 19
(b) P
ROCEEDINGSNOTAFFECTED.—The provisions 20
of this Act shall not affect any proceedings, including no-21
tices of proposed rulemaking, or any application for any 22
license, permit, certificate, or financial assistance pending 23
before the Agency on the date of the transfers of functions 24
by section 6, with respect to functions transferred by sec-25

tion 6, but such proceedings and applications shall con-1
tinue. Orders shall be issued in such proceedings, appeals 2
shall be taken therefrom, and payments shall be made pur-3
suant to such orders, as if this Act had not been enacted, 4
and orders issued in any such proceedings shall continue 5
in effect until modified, terminated, superseded, or re-6
voked by a duly authorized official, by a court of com-7
petent jurisdiction, or by operation of law. Nothing in this 8
paragraph shall be considered to prohibit the discontinu-9
ance or modification of any such proceeding under the 10
same terms and conditions and to the same extent that 11
such proceeding could have been discontinued or modified 12
if this Act had not been enacted. 13
(c) C
AUSES OFACTIONNOTAFFECTED.—The provi-14
sions of this Act shall not affect any cause of action com-15
menced before the date of the transfers of functions by 16
section 6, and in all such causes of action, proceedings 17
shall be had, appeals taken, and judgments rendered in 18
the same manner and with the same effect as if this Act 19
had not been enacted. 20
(d) N
ONABATEMENT OF CAUSES OFACTION.—No 21
cause of action commenced by or against the Agency, or 22
by or against any individual in the official capacity of such 23
individual as an officer of the Agency, shall abate by rea-24
son of the enactment of this Act. 25

(e) ADMINISTRATIVEACTIONSRELATING TOPRO-1
MULGATION OF REGULATIONS.—Any administrative ac-2
tion relating to the preparation or promulgation of a regu-3
lation by the Agency relating to a function transferred by 4
section 6 may be continued by the Agency with the same 5
effect as if this Act had not been enacted. 6
SEC. 9. REFERENCES. 7
(a) R
EFERENCES TO FEMA.—Any reference to the 8
Federal Emergency Management Agency in any law, Ex-9
ecutive order, rule, regulation, certificate, directive, in-10
struction, delegation of authority, or other official paper 11
shall be considered to refer and apply to the Agency estab-12
lished by section 2. 13
(b) R
EFERENCES TODIRECTOR ORADMINISTRATOR 14
OFFEMA.—Any reference to the Director or the Admin-15
istrator of the Federal Emergency Management Agency 16
in any law, Executive order, rule, regulation, certificate, 17
directive, instruction, delegation of authority, or other offi-18
cial paper shall be considered to refer and apply to the 19
Director established by section 3(a)(1). 20

EFERENCES TO INSPECTORGENERAL.—Any 21
reference to the Inspector General of the Federal Emer-22
gency Management Agency or to the functions relating to 23
such office that were transferred from the Federal Emer-24
gency Management Agency to the Department of Home-25

(a) R

the Homeland Security Act of 2002 (6 U.S.C. 601 et seq.) 3
is amended— 4

Management Reform Act of 2006 (6 U.S.C. 727(a)) is 7
amended by striking ‘‘, in coordination with the Chief In-8
formation Officer of the Department,’’. 9

HIEFFINANCIALOFFICER.—Section 901(b)(2) 10
of title 31, United States Code, is amended by adding at 11
the end the following: 12
‘‘(H) The Federal Emergency Management 13
Agency.’’. 14
(c) R
EFERENCES.—Subsection (c) of section 612 of 15
the Post-Katrina Emergency Management Reform Act of 16
2006 (6 U.S.C. 313 note) is repealed. 17
(d) E
FFECTIVEDATE.—The amendments made by 18

SEC. 13. REPORT ON RECOMMENDED LEGISLATION. 21

UBMISSION TOCONGRESS.—Not later than 90 3
days after the last day of the transition period referred 4
to in section 6(c), the Director shall submit to Congress 5
the report referred to in subsection (a). 6
SEC. 14. DEFINITIONS. 7
In this Act: 8
(1) A
GENCY.—The term ‘‘Agency’’ means the 9
Federal Emergency Management Agency established 10
by section 2. 11
(2) D
IRECTOR.—The term ‘‘Director’’ means 12
the Director of the Federal Emergency Management 13
Agency established by section 3(a). 14
(3) H
AZARD.—The term ‘‘hazard’’ has the 15
meaning given that term in section 602(a) of the 16
Robert T. Stafford Disaster Relief and Emergency 17
Assistance Act (42 U.S.C. 5195a(a)) and includes 18
any major disaster or emergency. 19
(4) I
NSPECTOR GENERAL .—The term ‘‘Inspec-20
tor General’’ means the Inspector General of the 21
Federal Emergency Management Agency established 22
by section 5. 23
