To amend the Immigration and Nationality Act to eliminate
the Optional Practical Training Program, and for other
purposes.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Fairness for High- 4
Skilled Americans Act of 2025’’. 5

SEC. 2. ELIMINATING THE OPTIONAL PRACTICAL TRAINING 1
PROGRAM. 2
Section 274A(h) of the Immigration and Nationality 3
Act (8 U.S.C. 1324a) is amended by adding at the end 4
the following: 5
‘‘(4) E
MPLOYMENT AUTHORIZATION FOR 6
ALIENS NO LONGER ENGAGED IN FULL -TIME STUDY 7
IN THE UNITED STATES .—Notwithstanding any 8
other provision of law, no alien present in the United 9
States as a nonimmigrant under section 10
101(a)(15)(F)(i) may be provided employment au-11
thorization in the United States pursuant to the Op-12
tional Practical Training Program, or any such suc-13
cessor program, without an express Act of Congress 14
authorizing such a program.’’. 15
