OFFICE OF CHILDREN’S HEALTH PROTECTION. 1 (a) I NGENERAL.—The Administrator of the Envi-2 ronmental Protection Agency shall maintain, within the 3 Agency, the Office of Children’s Health Protection. 4 (b) D IRECTOR.— 5 (1) I N GENERAL.—The Office shall be headed 6 by a Director. 7 (2) A PPOINTMENT.—The Director of the Office 8 shall be appointed by, and report to, the Adminis-9 trator of the Environmental Protection Agency. In 10 making such appointment, the Administrator shall 11 take into consideration the recommendations of the 12 Children’s Health Protection Advisory Committee. 13 (3) C O-CHAIR OF PRESIDENT’S TASK FORCE.— 14 The Administrator of the Environmental Protection 15 Agency shall delegate to the Director of the Office 16 responsibility to serve as Co-Chair, on behalf of the 17 Administrator, of the President’s Task Force on En-18 vironmental Health Risks and Safety Risks to Chil-19 dren established by Executive Order 13045. 20 (c) D UTIES.—The Director of the Office shall— 21 (1) identify and assess environmental health 22 risks and safety risks that may disproportionately 23 affect infants, children, and adolescents; 24 (2) work to ensure that Federal policies, pro-25 grams, activities, and standards address dispropor-26 VerDate Sep 11 2014 05:31 Apr 02, 2025 Jkt 059200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H2339.IH H2339 kjohnson on DSK7ZCZBW3PROD with $$_JOB 3 •HR 2339 IH tionate risks to infants, children, and adolescents 1 that result from environmental health risks or safety 2 risks, including consideration of the unique environ-3 mental justice concerns affecting infants, children, 4 and adolescents; 5 (3) coordinate Federal research and programs, 6 including grant programs, to advance the activities 7 described in paragraphs (1) and (2); 8 (4) advise other offices of the Environmental 9 Protection Agency and other Federal agencies on all 10 matters related to and concerning environmental 11 health risks to infants, children, and adolescents; 12 (5) carry out other duties as the Administrator 13 determines appropriate, including any responsibil-14 ities of the Administrator under Executive Order 15 13045; and 16 (6) carry out national activities to— 17 (A) reduce negative environmental impacts 18 on infants, children, and adolescents through 19 involvement in rulemaking, policy, enforcement 20 actions, research, and applications of science 21 that focuses on prenatal and childhood 22 vulnerabilities; 23 VerDate Sep 11 2014 05:31 Apr 02, 2025 Jkt 059200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H2339.IH H2339 kjohnson on DSK7ZCZBW3PROD with $$_JOB 4 •HR 2339 IH (B) help protect infants, children, and ado-1 lescents through promoting and issuing guid-2 ance for safe chemicals management; 3 (C) coordinate community-based programs 4 to eliminate threats to infants’, children’s, and 5 adolescents’ health; 6 (D) increase the environmental health lit-7 eracy of health care providers through support 8 of pediatric environmental health specialty 9 units; 10 (E) evaluate and communicate trends in 11 environmental contaminants that may con-12 tribute to childhood disease; 13 (F) develop and publish resources for local 14 educational agencies to establish, maintain, or 15 enhance a school environmental health program; 16 and 17 (G) otherwise protect infants, children, and 18 adolescents from environmental health risks or 19 safety risks. 20 (d) T RANSITION.—The Administrator of the Environ-21 mental Protection Agency shall make such changes to the 22 Office of Children’s Health Protection of the Environ-23 mental Protection Agency, as in existence on the day be-24 fore the date of enactment of this Act, as may be nec-25 VerDate Sep 11 2014 05:31 Apr 02, 2025 Jkt 059200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H2339.IH H2339 kjohnson on DSK7ZCZBW3PROD with $$_JOB 5 •HR 2339 IH essary for such Office to become the Office required by 1 subsection (a). 2 (e) A UTHORIZATION OFAPPROPRIATIONS.—To carry 3 out this section, there is authorized to be appropriated 4 $7,842,000 for fiscal year 2026 and each subsequent fiscal 5 year. 6 SEC. 3. CHILDREN’S HEALTH PROTECTION ADVISORY COM-7 MITTEE. 8 (a) E STABLISHMENT.—The Administrator of the En-9 vironmental Protection Agency shall maintain an advisory 10 committee, to be known as the Children’s Health Protec-11 tion Advisory Committee, to— 12 (1) provide advice and recommendations to the 13 Administrator and other officials of the Environ-14 mental Protection Agency regarding the programs 15 and activities of the Office; 16 (2) advise the Administrator and other officials 17 of the Environmental Protection Agency on regula-18 tions, research, and communications related to in-19 fant’s, children’s and adolescent’s health; and 20 (3) support the Environmental Protection 21 Agency, including the Office, in implementing Exec-22 utive Order 13045 and other issues related to in-23 fants’, children’s, and adolescents’ health protection 24 as deemed appropriate by the Administrator. 25 VerDate Sep 11 2014 05:31 Apr 02, 2025 Jkt 059200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\H2339.IH H2339 kjohnson on DSK7ZCZBW3PROD with $$_JOB 6 •HR 2339 IH (b) APPLICABILITY OF FACA.—The Children’s 1 Health Protection Advisory Committee shall be subject to 2 chapter 10 of title 5, United States Code, except that the 3 Children’s Health Protection Advisory Committee shall be 4 a permanent advisory committee and shall not terminate 5 under section 1013 of such title. 6 (c) T RANSITION.—The President, acting through the 7 Administrator of the Environmental Protection Agency, 8 shall make such changes to the Children’s Health Protec-9 tion Advisory Committee established pursuant to Execu-10 tive Order 13045 as may be necessary for such Advisory 11 Committee to become the advisory committee required by 12 this section. 13 SEC. 4. DEFINITIONS. 14 In this Act: 15 (1) C HILDREN’S HEALTH PROTECTION ADVI -16 SORY COMMITTEE .—The term ‘‘Children’s Health 17 Protection Advisory Committee’’ means the advisory 18 committee maintained pursuant to section 3. 19 (2) E XECUTIVE ORDER 13045.—The term ‘‘Ex-20 ecutive Order 13045’’ means Executive Order 10345 21 (relating to protection of children from environ-22 mental health risks and safety risks) published in 23 the Federal Register on April 23, 1997 (62 Fed. 24 Reg. 19885). 25 VerDate Sep 11 2014 05:31 Apr 02, 2025 Jkt 059200 PO 00000 Frm 00006 Fmt 6652 Sfmt 6201 E:\BILLS\H2339.IH H2339 kjohnson on DSK7ZCZBW3PROD with $$_JOB 7 •HR 2339 IH (3) LOCAL EDUCATIONAL AGENCY .—The term 1 ‘‘local educational agency’’ has the meaning given to 2 such term in section 8101 of the Elementary and 3 Secondary Education Act of 1965 (20 U.S.C. 7801). 4 (4) O FFICE.—The term ‘‘Office’’ means the Of-5 fice of Children’s Health Protection maintained pur-6 suant to section 2. 7 SEC. 5.
