Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘IVF for Military Fami-4
lies Act’’. 5

SEC. 2. FERTILITY TREATMENT FOR CERTAIN MEMBERS OF 1
THE UNIFORMED SERVICES AND DEPEND-2
ENTS. 3
(a) F
ERTILITYTREATMENT.—Chapter 55 of title 10, 4
United States Code, is amended by inserting after section 5
1074o the following new section: 6
‘‘§ 1074p. Fertility treatment for certain active duty 7
members of the uniformed services and 8
their dependents 9
‘‘(a) C
OVERAGE.—The Secretary shall ensure that 10
fertility-related care for a member of the uniformed serv-11
ices on active duty (or a dependent of such a member) 12
shall be covered under TRICARE Prime and TRICARE 13
Select. 14
‘‘(b) I
NVITROFERTILIZATION.—In the case of in 15
vitro fertilization treatment furnished to an individual 16
pursuant to subsection (a)— 17
‘‘(1) not more than three completed oocyte re-18
trievals may be furnished; and 19
‘‘(2) unlimited embryo transfers may be pro-20
vided in accordance with the guidelines of the Amer-21
ican Society for Reproductive Medicine. 22
‘‘(c) D
EFINITIONS.—In this section: 23
‘‘(1) The term ‘infertility’ means a disease, con-24
dition, or status characterized by— 25

‘‘(A) the failure to establish a pregnancy 1
or to carry a pregnancy to live birth after reg-2
ular, unprotected sexual intercourse in accord-3
ance with the guidelines of the American Soci-4
ety for Reproductive Medicine; 5
‘‘(B) the inability of an individual to repro-6
duce without medical intervention either as a 7
single individual or with the partner of the indi-8
vidual; or 9
‘‘(C) the findings of a licensed physician 10
based on the medical, sexual, and reproductive 11
history, age, physical findings, or diagnostic 12
testing, of the individual. 13
‘‘(2) The term ‘fertility-related care’ means— 14
‘‘(A) the diagnosis of infertility; and 15
‘‘(B) fertility treatment. 16
‘‘(3) The term ‘fertility treatment’ includes the 17
following: 18
‘‘(A) In vitro fertilization or other treat-19
ments or procedures in which human oocytes, 20
embryos, or sperm are handled when clinically 21
appropriate. 22
‘‘(B) Sperm retrieval. 23
‘‘(C) Egg retrieval. 24

‘‘(D) Preservation of human oocytes, em-1
bryos, or sperm. 2
‘‘(E) Artificial insemination, including 3
intravaginal insemination, intracervical insemi-4
nation, and intrauterine insemination. 5
‘‘(F) Transfer of reproductive genetic ma-6
terial. 7
‘‘(G) Medications as prescribed or nec-8
essary for fertility. 9
‘‘(H) Fertility treatment coordination. 10
‘‘(I) Such other information, referrals, 11
treatments, procedures, testing, medications, 12
laboratory services, technologies, and services 13
facilitating reproduction as determined appro-14
priate by the Secretary of Defense.’’. 15
(b) P
ROGRAM ONFERTILITYTREATMENTCOORDI-16
NATION.—Chapter 55 of title 10, United States Code, is 17
amended by adding at the end the following new section: 18
‘‘§ 1110c. Program on fertility-related care coordina-19
tion 20
‘‘(a) I
NGENERAL.—The Secretary of Defense shall 21
establish a program on the coordination of fertility-related 22
care by the Secretary for purposes of ensuring patients 23
receive timely fertility-related care. 24

‘‘(b) TRAINING ANDSUPPORT.—In carrying out the 1
program established under subsection (a), the Secretary 2
shall provide to community health care providers training 3
and support with respect to the unique needs of members 4
of the uniformed services and the dependents of such 5
members.’’. 6
(c) C
ONFORMINGAMENDMENT.—Section 1079(a) of 7
title 10, United States Code, is amended by adding at the 8
end the following new paragraph: 9
‘‘(21) Fertility related care shall be provided in 10
accordance with section 1074p of this title.’’. 11
(d) A
PPLICATION.—The amendments made by this 12
section shall apply with respect to services provided on or 13
after October 1, 2027. 14
