SHORT TITLE. 3 This Act may be cited at the ‘‘Drug Testing for Spe-4 cial Government Employees Act’’. 5 SEC. 2. MANDATORY DRUG TESTING FOR SPECIAL GOV-6 ERNMENT EMPLOYEES IN SENSITIVE POSI-7 TIONS. 8 (a) I NGENERAL.—Before the first day of service as 9 a special Government employee at an agency, the head of 10 VerDate Sep 11 2014 22:53 Apr 04, 2025 Jkt 059200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H2578.IH H2578 ssavage on LAPJG3WLY3PROD with BILLS 2 •HR 2578 IH such agency shall require the individual proposed to be 1 such an employee to undergo a drug test in accordance 2 with the Mandatory Guidelines for Federal Workplace 3 Drug Testing Programs. 4 (b) M ANDATORYRANDOMDRUGTESTINGPRO-5 GRAM.—Not later than 90 days after the date of the en-6 actment of this Act, the head of each agency shall require 7 any special Government employee in a sensitive position 8 at the agency on the date of the enactment of this Act 9 to be entered into a random drug testing program in ac-10 cordance with the Mandatory Guidelines for Federal 11 Workplace Drug Testing Programs. 12 (c) E FFECT OFFAILINGDRUGTESTS.— 13 (1) P ROSPECTIVE SPECIAL GOVERNMENT EM -14 PLOYEES.—Any individual who tests positive for a 15 controlled substance pursuant to subsection (a) shall 16 be ineligible for an appointment as a special Govern-17 ment employee for a period of not less than 12 18 months beginning on the date on which the head of 19 the applicable agency determines that the test result 20 was positive. 21 (2) C URRENT SPECIAL GOVERNMENT EMPLOY -22 EES.—Any individual who tests positive for a con-23 trolled substance pursuant to subsection (b) shall be 24 removed from the civil service and shall be ineligible 25 VerDate Sep 11 2014 22:53 Apr 04, 2025 Jkt 059200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H2578.IH H2578 ssavage on LAPJG3WLY3PROD with BILLS 3 •HR 2578 IH for appointment as a special Government employee 1 for a period of not less than 12 months beginning 2 on the date on which the head of the applicable 3 agency determines that the test result was positive. 4 (d) D EFINITIONS.—In this Act— 5 (1) the term ‘‘controlled substance’’ has the 6 meaning given the term in section 101 of the Con-7 trolled Substances Act (21 U.S.C. 802); 8 (2) the term ‘‘agency’’ has the meaning given 9 the term in section 551 of title 5, United States 10 Code, and includes the Executive Office of the Presi-11 dent and the Office of Management and Budget; 12 (3) the term ‘‘sensitive position’’ means any po-13 sition who has been granted access to classified in-14 formation, positions that could reasonably be ex-15 pected to affect safety, security, National security, 16 or functions other than the foregoing requiring a 17 high degree of trust and confidence, and includes 18 any individual performing in a position designated 19 mission critical or performing mission critical duties; 20 and 21 (4) the term ‘‘special Government employee’’ 22 means a special Government employee as defined by 23 section 202 of title 18, United States Code. 24 Æ VerDate Sep 11 2014 01:35 Apr 08, 2025 Jkt 059200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6301 E:\BILLS\H2578.IH H2578 ssavage on LAPJG3WLY3PROD with BILLS
