To amend title 39, United States Code, to provide for in-
creased oversight over significant proposed changes to
postal services, and for other purposes.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Postal Service Trans-4
parency and Review Act’’. 5

SEC. 2. OVERSIGHT OF PROPOSED SIGNIFICANT CHANGES 1
TO POSTAL SERVICES. 2
Section 3661 of title 39, United States Code, is 3
amended— 4
(1) by striking subsection (b) and inserting the 5
following: 6
‘‘(b)(1) Prior to implementing any change in the na-7
ture of postal services which will generally affect service 8
on a nationwide or substantially nationwide basis, or 9
which will significantly affect service within a postal dis-10
trict, not later than the date that is 180 days before the 11
proposed effective date of such change the Postal Service 12
shall submit a proposal for such change to the Postal Reg-13
ulatory Commission requesting an advisory opinion on the 14
change. 15
‘‘(2)(A) Not later than 180 days after the date the 16
Commission receives such a proposal from the Postal Serv-17
ice under paragraph (1), the Commission shall issue an 18
advisory opinion on the proposal. 19
‘‘(B) The Postal Service may not take any action, or 20
obligate or expend any funds, to implement, administer, 21
or otherwise carry out the applicable proposed change at 22
anytime before the date the Commission issues an advisory 23
opinion under this paragraph, consistent with paragraph 24
(3). 25

‘‘(3)(A) The Commission may issue a ruling to sus-1
pend implementation of any such change if the Commis-2
sion determines that the Postal Service failed to seek an 3
advisory opinion required under paragraph (1). 4
‘‘(B) On and after the date of such ruling, no funds 5
may be obligated or expended by the Postal Service to im-6
plement, administer, or otherwise carry out such change 7
until the Postal Service seeks an advisory opinion under 8
such paragraph, and mail service levels shall be returned 9
to and maintained at the service level in effect prior to 10
the applicable change in the nature of postal service that 11
occurred.’’; and 12
(2) by adding after subsection (c) the following: 13
‘‘(d) Chapter 8 of title 5 shall apply to proposals sub-14
mitted by the Postal Service under subsection (b)(1) to 15
the Postal Regulatory Commission, except that in applying 16
such chapter to such a proposal— 17
‘‘(1) the term ‘joint resolution’ means only a 18
joint resolution introduced in the period beginning 19
on the date the Commission issued an advisory opin-20
ion under subsection (b)(1) with respect to such pro-21
posal was so submitted and ending 60 legislative 22
days thereafter, the matter after the resolving clause 23
of which is as follows: ‘That Congress disapproves 24
the proposal submitted by the United States Postal 25

Service relating to llll, and such change shall 1
have no force or effect.’ (The blank space being ap-2
propriately filled in); and 3
‘‘(2) the term ‘submission or publication date’ 4
means the date such opinion was so issued.’’. 5
