Be it enacted by the Senate and House of Representa-1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘New Opportunities for 4 Technological Innovation, Mitigation, and Education To 5 Overcome Waste Act,’’ or the ‘‘NO TIME TO Waste Act’’. 6 SEC. 2. DEFINITIONS. 7 In this Act: 8 VerDate Sep 11 2014 23:20 Apr 25, 2025 Jkt 059200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H2883.IH H2883 kjohnson on DSK7ZCZBW3PROD with $$_JOB 2 •HR 2883 IH (1) ADMINISTRATOR.—The term ‘‘Adminis-1 trator’’ means the Administrator of the Environ-2 mental Protection Agency. 3 (2) C OMMISSIONER.—The term ‘‘Commis-4 sioner’’ means the Commissioner of Food and 5 Drugs. 6 (3) F OOD.—The term ‘‘food’’ means any raw, 7 cooked, processed, or prepared substance, ice, bev-8 erage, or ingredient used or intended for use in 9 whole or in part for human consumption. 10 (4) F OOD LOSS.—The term ‘‘food loss’’ means, 11 with respect to food, that the food does not reach a 12 consumer as a result of an issue in the production, 13 storage, processing, or distribution phase. 14 (5) F OOD RECOVERY.—The term ‘‘food recov-15 ery’’ means the collection of wholesome food that 16 would otherwise go to waste and the redistribution 17 of that food to feed people. 18 (6) F OOD SPOILAGE.—The term ‘‘food spoil-19 age’’ means a process or change that renders a food 20 product undesirable or unacceptable for human con-21 sumption. 22 (7) F OOD WASTE.—The term ‘‘food waste’’ 23 means, with respect to food, that the food is in-24 tended for human consumption but is unconsumed 25 VerDate Sep 11 2014 23:20 Apr 25, 2025 Jkt 059200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H2883.IH H2883 kjohnson on DSK7ZCZBW3PROD with $$_JOB 3 •HR 2883 IH by humans for any reason at the retail or consump-1 tion phase. 2 (8) L IAISON.—The term ‘‘Liaison’’ means the 3 Food Loss and Waste Reduction Liaison established 4 under section 224 of the Department of Agriculture 5 Reorganization Act of 1994 (7 U.S.C. 6924). 6 (9) S ECRETARY.—The term ‘‘Secretary’’ means 7 the Secretary of Agriculture. 8 (10) U PCYCLED FOOD PRODUCT .—The term 9 ‘‘upcycled food product’’ means a product that— 10 (A) is created from surplus food, unmar-11 ketable food, or edible or inedible food byprod-12 ucts; and 13 (B) is made with ingredients that— 14 (i) otherwise would not have gone to 15 human consumption; 16 (ii) are sourced and produced using 17 supply chains for which upstream data can 18 be verified and validated for accuracy; and 19 (iii) have a positive impact on the en-20 vironment. 21 SEC. 3. OFFICE OF FOOD LOSS AND WASTE. 22 (a) E STABLISHMENT.—The Secretary shall establish 23 in the Department of Agriculture an Office of Food Loss 24 and Waste (referred to in this section as the ‘‘Office’’). 25 VerDate Sep 11 2014 23:20 Apr 25, 2025 Jkt 059200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H2883.IH H2883 kjohnson on DSK7ZCZBW3PROD with $$_JOB 4 •HR 2883 IH (b) RESPONSIBILITIES.—The Office shall be respon-1 sible for— 2 (1) supporting the role and responsibilities of 3 the Liaison; 4 (2) comprehensive research on methods to 5 quantify on-farm food loss and supply chain food 6 loss; 7 (3) research on new technologies to reduce food 8 loss and food waste; 9 (4) quantifying the impact of food waste reduc-10 tion policies on greenhouse gas emissions reductions; 11 (5) submitting to Congress and making publicly 12 available reports describing the progress of the 13 United States in advancing toward or achieving the 14 goal of reducing food loss and food waste by 50 per-15 cent, compared to 2016 levels, by 2030; 16 (6) publishing reports to Congress and to the 17 public for the purpose of engaging with educational 18 campaigns relating to food loss and food waste; 19 (7) carrying out the grant program under sub-20 section (d); and 4 (B) to contribute to increased education 5 relating to food loss and food waste for private 6 entities, nonprofit and community-based organi-7 zations, and individuals; 8 (10) tracking and assessing programs across 9 Federal agencies to advance research relating to 10 food loss and food waste; 11 (11) analyzing food loss and food waste policy 12 data and establishing and disseminating model poli-13 cies for municipal, local, State, territorial, and Trib-14 al governments that are proven to reduce food loss 15 or food waste; 16 (12) recommending new regulations, invest-17 ments, or policies to the Liaison and the Secretary 18 to address new identified gaps on preventing and re-19 ducing food loss and food waste; and 20 (13) carrying out such other activities as the 21 Secretary or the Liaison determine to be appro-22 priate. 23 (c) P ARTNERSHIPS.—In carrying out the responsibil-24 ities described in subsection (b), the Secretary, in con-25 VerDate Sep 11 2014 23:20 Apr 25, 2025 Jkt 059200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\H2883.IH H2883 kjohnson on DSK7ZCZBW3PROD with $$_JOB 6 •HR 2883 IH sultation with other Federal agencies, the Liaison, and the 1 Office, shall establish partnerships with regional partner 2 institutions to plan, conduct, and arrange for public re-3 search, data, education, and recommendations relating to 4 food loss and food waste prevention and reduction and 5 food recovery issues locally, regionally, and nationally. 6 (d) G RANTPROGRAM.— 7 (1) I N GENERAL.—The Office shall establish a 8 grant program to support collecting data on existing 9 State and local food loss and food waste policies. 10 (2) E LIGIBILITY.—An entity eligible to receive 11 a grant under paragraph (1) is— 12 (A) a municipal, local, State, or Tribal 13 government; 14 (B) a partnership of 1 or more govern-15 ments described in subparagraph (A) and 1 or 16 more nonprofit organizations; or 17 (C) a partnership of 2 or more— 18 (i) governments described in subpara-19 graph (A); or 20 (ii) nonprofit organizations. 21 (3) C OLLABORATION.—An entity that receives a 22 grant under paragraph (1) may collaborate with 1 or 23 more nonprofit, private, or other organizations in 24 carrying out activities using the grant funds. 25 VerDate Sep 11 2014 23:20 Apr 25, 2025 Jkt 059200 PO 00000 Frm 00006 Fmt 6652 Sfmt 6201 E:\BILLS\H2883.IH H2883 kjohnson on DSK7ZCZBW3PROD with $$_JOB 7 •HR 2883 IH (4) PROJECT REQUIREMENTS .—A data collec-1 tion project carried out using a grant under para-2 graph (1) shall— 3 (A) be carried out for not longer than 3 4 years; and 5 (B) include the provision of data collected 6 under the project to the Office. 7 (5) D ATA REQUIREMENTS .—Data collected 8 under a project carried out using a grant under 9 paragraph (1) shall provide rigorous evidence of the 10 impact of food loss and food waste policies, which 11 may include— 12 (A) estimates of the quantity of the reduc-13 tion of food loss and food waste after the imple-14 mentation of a policy; 15 (B) where relevant, estimates of the quan-16 tity of food loss and food waste in a similar 17 community that is not subject to the policy; and 18 (C) the economic benefits and impacts re-19 alized from food that is recovered, upcycled, re-20 used, or recycled. 21 (6) M ATCHING REQUIREMENT .—An entity that 22 receives a grant under paragraph (1) shall provide 23 funds, in-kind contributions, or a combination of 24 both from sources other than funds provided 25 VerDate Sep 11 2014 23:20 Apr 25, 2025 Jkt 059200 PO 00000 Frm 00007 Fmt 6652 Sfmt 6201 E:\BILLS\H2883.IH H2883 kjohnson on DSK7ZCZBW3PROD with $$_JOB 8 •HR 2883 IH through the grant in an amount equal to not less 1 than 10 percent of the amount of the grant, which 2 may include private funding or other sources of rev-3 enue, as determined by the Secretary. 4 (7) M ODEL POLICIES.—After the Office receives 5 the data collected under the grant program under 6 this paragraph, the Office shall analyze the data and 7 establish model policies for municipal, local, State, 8 and Tribal governments that are proven to reduce 9 food waste. 10 (e) A UTHORIZATIONS OFAPPROPRIATIONS.— 11 (1) I N GENERAL.—There is authorized to be 12 appropriated to the Office $1,500,000 for each of 13 fiscal years 2026 through 2030. 14 (2) G RANT PROGRAM.— 15 (A) I N GENERAL.—There is authorized to 16 be appropriated to carry out the grant program 17 under subsection (d) $2,000,000 for each of fis-18 cal years 2026 through 2030. 19 (B) A DMINISTRATIVE COSTS .—Of the 20 amount appropriated under subparagraph (A), 21 the Secretary may retain not more than 4 per-22 cent to pay administrative costs incurred by the 23 Secretary in carrying out subsection (d). 24 VerDate Sep 11 2014 23:20 Apr 25, 2025 Jkt 059200 PO 00000 Frm 00008 Fmt 6652 Sfmt 6201 E:\BILLS\H2883.IH H2883 kjohnson on DSK7ZCZBW3PROD with $$_JOB 9 •HR 2883 IH SEC. 4. IMPROVING COORDINATION TO PREVENT AND RE-1 DUCE FOOD LOSS AND WASTE. 2 (a) R EGIONALCOORDINATORS.— 3 (1) I N GENERAL.—The Secretary shall establish 4 in the Department of Agriculture regional coordina-5 tors. 6 (2) R ESPONSIBILITIES.—The regional coordina-7 tors established under paragraph (1) shall be re-8 sponsible for— 9 (A) partnering with food producers, food 10 processors, distributors, and food recovery orga-11 nizations and acting as regional points of con-12 tact to facilitate real-time food recovery; 13 (B) understanding and developing the ca-14 pacity needed for ongoing food recovery; 15 (C) providing technical support to food re-16 covery organizations to improve the ability of 17 the food recovery organizations to pick up sur-18 plus food, process that food, and deliver that 19 food to populations or communities; and 20 (D) engaging with Department of Agri-21 culture regional food business centers to iden-22 tify opportunities for synergy and alignment 23 with those centers. 24 VerDate Sep 11 2014 23:20 Apr 25, 2025 Jkt 059200 PO 00000 Frm 00009 Fmt 6652 Sfmt 6201 E:\BILLS\H2883.IH H2883 kjohnson on DSK7ZCZBW3PROD with $$_JOB 10 •HR 2883 IH (3) AUTHORIZATION OF APPROPRIATIONS .— 1 There is authorized to be appropriated to the Sec-2 retary to carry out this subsection $1,000,000. 3 (b) F OODRECOVERY AND DISTRIBUTIONINFRA-4 STRUCTURE SUPPORT AND COORDINATION BLOCK 5 G RANTS.— 6 (1) I N GENERAL.—The Secretary, in coordina-7 tion with the Office of Food Loss and Waste estab-8 lished under section 3, shall establish as part of the 9 program under section 203D(d) of the Emergency 10 Food Assistance Act of 1983 (7 U.S.C. 7507(d)) a 11 program to award annual block grants to States and 12 Indian Tribes to carry out projects to develop and 13 support food recovery infrastructure and innovative 14 food distribution models. 15 (2) D ISTRIBUTION.—A State shall distribute a 16 block grant received under paragraph (1) to applica-17 ble food recovery organizations and local govern-18 ments to address any gaps in food recovery infra-19 structure, including— 20 (A) storage and capacity of processing in-21 frastructure equipment and facilities; 22 (B) temperature-controlled food distribu-23 tion infrastructure; 24 VerDate Sep 11 2014 23:20 Apr 25, 2025 Jkt 059200 PO 00000 Frm 00010 Fmt 6652 Sfmt 6201 E:\BILLS\H2883.IH H2883 kjohnson on DSK7ZCZBW3PROD with $$_JOB 11 •HR 2883 IH (C) technological solutions supporting food 1 recovery, such as real-time updates to connect 2 organizations that have surplus food with orga-3 nizations that distribute surplus food; and 4 (D) support of salaries, wages, and bene-5 fits for food recovery organizations. 6 (3) C OORDINATION.—In establishing the pro-7 gram under paragraph (1), the Secretary shall co-8 ordinate with other Department of Agriculture agen-9 cies and programs, including— 10 (A) the Agricultural Marketing Service; 11 (B) the Emergency Food Assistance Pro-12 gram Reach and Resiliency Grants; and 13 (C) such other agencies and programs as 14 the Secretary determines to be appropriate. 15 (4) A UTHORIZATION OF APPROPRIATIONS .— 16 There is authorized to be appropriated to carry out 17 this subsection $2,000,000 for each of fiscal years 18 2026 through 2030. 19 SEC. 5. STRENGTHENING GOVERNMENT APPROACH TO 20 FOOD LOSS AND WASTE. 21 (a) I NTERAGENCYCOLLABORATION ON FOODLOSS 22 ANDWASTE.— 23 (1) I N GENERAL.—The Secretary, in collabora-24 tion with the Administrator and the Commissioner, 25 VerDate Sep 11 2014 23:20 Apr 25, 2025 Jkt 059200 PO 00000 Frm 00011 Fmt 6652 Sfmt 6201 E:\BILLS\H2883.IH H2883 kjohnson on DSK7ZCZBW3PROD with $$_JOB 12 •HR 2883 IH shall collaborate to carry out the agreement relative 1 to cooperation and coordination on food loss and 2 waste signed by those officials on December 17, 3 2020. 4 (2) R EPORTS.—Every year, the Secretary, act-5 ing through the Liaison and the Office of Food Loss 6 and Waste established under section 3, in consulta-7 tion with the Administrator and the Commissioner, 8 shall submit to Congress and make publicly available 9 a report describing the progress of the Secretary in 10 carrying out the agreement described in paragraph 11 (1). 12 (3) I NTERAGENCY ENGAGEMENT .—Pursuant to 13 paragraph (1), the Secretary, the Administrator, and 14 the Commissioner shall engage with the heads of 15 other Federal departments and agencies, including 16 the Secretary of Defense, the Secretary of Edu-17 cation, the Secretary of Transportation, the Sec-18 retary of Homeland Security, the Administrator of 19 General Services, and such other Federal depart-20 ments and agencies as the Secretary, the Adminis-21 trator, and the Commissioner determine to be appro-22 priate, to expand work on food loss and food waste. 23 (4) C ONSULTATION.— 24 VerDate Sep 11 2014 23:20 Apr 25, 2025 Jkt 059200 PO 00000 Frm 00012 Fmt 6652 Sfmt 6201 E:\BILLS\H2883.IH H2883 kjohnson on DSK7ZCZBW3PROD with $$_JOB 13 •HR 2883 IH (A) IN GENERAL.—The Secretary shall 1 consult with, and receive advice from, rep-2 resentatives described in subparagraph (B) re-3 lating to— 4 (i) programming and policy issues re-5 lating to understanding existing and future 6 challenges relating to food loss and food 7 waste; 8 (ii) acquiring the latest data relating 9 to food loss and food waste; 10 (iii) the latest innovative solutions re-11 lating to food loss and food waste from 12 leading experts; and 13 (iv) sharing and developing procure-14 ment best practices that will assist the 15 heads of Federal departments and agencies 16 described in paragraph (3) in— 17 (I) preventing food loss and 18 waste; 19 (II) reducing food loss and food 20 waste; 21 (III) leading by example in ad-22 dressing issues relating to food loss 23 and food waste; and 24 VerDate Sep 11 2014 23:20 Apr 25, 2025 Jkt 059200 PO 00000 Frm 00013 Fmt 6652 Sfmt 6201 E:\BILLS\H2883.IH H2883 kjohnson on DSK7ZCZBW3PROD with $$_JOB 14 •HR 2883 IH (IV) engaging contractors in re-1 ducing food loss and food waste in the 2 operations of the contractors. 3 (B) R EPRESENTATIVES.—The representa-4 tives referred to in subparagraph (A) are rep-5 resentatives of— 6 (i) the private sector; 7 (ii) agricultural producers; 8 (iii) food industry members, such as 9 food safety trainers, food aggregators and 10 processors, food safety professionals, retail-11 ers, and food service entities; 12 (iv) nonprofit organizations; 13 (v) food recovery organizations of 14 varying sizes; and 15 (vi) any other sector, as determined 16 by the Secretary. 17 (C) R EPRESENTATION OF SMALLER PRO -18 DUCERS AND FOOD INSECURE COMMUNITIES .— 19 In consulting and receiving advice under sub-20 paragraph (A), the Secretary shall ensure par-21 ticipation by smaller producers and organiza-22 tions from communities most impacted by food 23 and nutrition insecurity and food loss and food 24 waste issues. 25 VerDate Sep 11 2014 23:20 Apr 25, 2025 Jkt 059200 PO 00000 Frm 00014 Fmt 6652 Sfmt 6201 E:\BILLS\H2883.IH H2883 kjohnson on DSK7ZCZBW3PROD with $$_JOB 15 •HR 2883 IH (D) FORMS OF CONSULTATION .—The Sec-1 retary may consult and receive advice under 2 subparagraph (A) through— 3 (i) a meeting through which input is 4 sought, such as a workshop, town hall 5 meeting, or listening session; 6 (ii) a meeting described in clause (i) 7 with an existing group formed by rep-8 resentatives described in subparagraph 9 (B); and 10 (iii) such other means as the Sec-11 retary determines to be appropriate. 12 (E) I NTERAGENCY MEETINGS .—The Sec-13 retary shall host quarterly meetings with the 14 Administrator, the Commissioner, and the 15 heads of other Federal agencies for the purpose 16 of sharing communications relating to consulta-17 tion and advice received under subparagraph 18 (A) with those officials regularly. 19 (F) FACA EXEMPTION.—Chapter 10 of 20 title 5, United States Code (commonly referred 21 to as the ‘‘Federal Advisory Committee Act’’), 22 shall not apply to any group formed for pur-23 poses of consultation or providing advice under 24 this paragraph. 25 VerDate Sep 11 2014 23:20 Apr 25, 2025 Jkt 059200 PO 00000 Frm 00015 Fmt 6652 Sfmt 6201 E:\BILLS\H2883.IH H2883 kjohnson on DSK7ZCZBW3PROD with $$_JOB 16 •HR 2883 IH (5) CONTINUATION OF EFFECT .—Nothing in 1 the subsection shall be affected by the expiration of 2 the agreement described in paragraph (1). 3 (6) A UTHORIZATION OF APPROPRIATIONS .— 4 There is authorized to be appropriated to the Sec-5 retary to carry out this subsection $1,000,000 for 6 each of fiscal years 2026 through 2030. 7 (b) F EDERALCONTRACTORS.—Section 4 of the Fed-8 eral Food Donation Act of 2008 (42 U.S.C. 1792) is 9 amended— 10 (1) in subsection (a)— 11 (A) in the matter preceding paragraph (1), 12 by striking ‘‘180 days’’ and all that follows 13 through ‘‘the Federal’’ and inserting ‘‘180 days 14 after the date of enactment of the New Oppor-15 tunities for Technological Innovation, Mitiga-16 tion, and Education To Overcome Waste Act, 17 the Federal’’; 18 (B) in paragraph (1)— 19 (i) by striking ‘‘encourages’’ and in-20 serting ‘‘requires’’; and 21 (ii) by striking ‘‘and’’ after the semi-22 colon; 23 (C) in paragraph (2), by striking the pe-24 riod at the end and inserting ‘‘; 8 ‘‘(B) food waste (as so defined) through 9 activities carried out under the contract; and 10 ‘‘(C) food donated as described in para-11 graph (1).’’; and 12 (2) by adding at the end the following: 13 ‘‘(c) R EPORTS TOCONGRESS.—Every 2 years, each 14 executive agency shall submit to Congress reports describ-15 ing the matters reported to the executive agency under 16 subsection (a)(3).’’. 17 (c) S TRENGTHENING FOODLOSS ANDWASTERE-18 SEARCH AT THEDEPARTMENT OFAGRICULTURE.— 19 (1) C RITICAL AGRICULTURE RESEARCH AND 20 EXTENSION.—In awarding grants under the critical 21 agriculture research and extension crosscutting pro-22 gram area priority established by the Secretary 23 under subsection (b) of the Competitive, Special, and 24 Facilities Research Grant Act (7 U.S.C. 3157(b)), 25 VerDate Sep 11 2014 23:20 Apr 25, 2025 Jkt 059200 PO 00000 Frm 00017 Fmt 6652 Sfmt 6201 E:\BILLS\H2883.IH H2883 kjohnson on DSK7ZCZBW3PROD with $$_JOB 18 •HR 2883 IH the Secretary shall give priority to grants to address 1 food loss and food waste. 2 (2) I NTER-DISCIPLINARY ENGAGEMENT IN ANI -3 MAL SYSTEMS.—In awarding grants under the inter- 4 disciplinary engagement in animal systems cross-5 cutting program area priority established by the Sec-6 retary under subsection (b) of the Competitive, Spe-7 cial, and Facilities Research Grant Act (7 U.S.C. 8 3157(b)), the Secretary shall give priority to grants 9 to address food loss and food waste. 10 (3) A NIMAL NUTRITION, GROWTH, AND LACTA-11 TION.—In awarding grants under the animal nutri-12 tion, growth, and lactation emphasis area program 13 established by the Secretary under subsection (b) of 14 the Competitive, Special, and Facilities Research 15 Grant Act (7 U.S.C. 3157(b)), the Secretary shall 16 give priority to grants— 17 (A) to reduce losses due to production inef-18 ficiencies, including on-farm milk loss; COMPOSTING AND FOOD WASTE REDUCTION PRO-1 GRAM. 2 Section 222(d)(2) of the Department of Agriculture 3 Reorganization Act of 1994 (7 U.S.C. 6923(d)(2)) is 4 amended— 5 (1) in subparagraph (A), by striking ‘‘local or 6 municipal governments’’ and inserting ‘‘State, local, 7 municipal, or Tribal governments’’; 8 (2) in subparagraph (C), by adding at the end 9 the following: 10 ‘‘(iv) G UIDANCE.—The Secretary shall 11 publish guidance for applying for pilot 12 projects under this paragraph for appli-13 cants that lack resources to obtain tech-14 nical assistance in preparing an application 15 to assist those applicants in preparing an 16 application, particularly to carry out a 17 pilot project for the reduction of food loss 18 and food waste (as those terms are defined 19 in section 2 of the New Opportunities for 20 Technological Innovation, Mitigation, and 21 Education To Overcome Waste Act) 22 through means other than composting. 23 ‘‘(v) P ERIOD FOR SUBMISSION OF AP -24 PLICATIONS.—The Secretary shall accept 25 submissions of applications for pilot 26 VerDate Sep 11 2014 23:20 Apr 25, 2025 Jkt 059200 PO 00000 Frm 00019 Fmt 6652 Sfmt 6201 E:\BILLS\H2883.IH H2883 kjohnson on DSK7ZCZBW3PROD with $$_JOB 20 •HR 2883 IH projects under this paragraph for a dura-1 tion sufficient to ensure that smaller and 2 rural communities are able to submit ap-3 plications, as determined by the Sec-4 retary.’’; and 5 (3) in subparagraph (D), by inserting ‘‘(which 6 may include private funding or other sources of rev-7 enue, as determined by the Secretary)’’ after ‘‘funds 8 provided through the grant’’. 9 SEC. 7. PROMOTING THE FORMATION OF PUBLIC-PRIVATE 10 PARTNERSHIPS ON FOOD LOSS AND WASTE. 11 (a) I NGENERAL.—The Secretary, acting through the 12 Office of Food Loss and Waste established under section 13 3, in collaboration with the Administrator, shall establish 14 a program to award grants to eligible governments de-15 scribed in subsection (b) to incentivize the establishment 16 of public-private partnerships that commit to reducing 17 food loss and food waste in accordance with the goal of 18 the Secretary and the Administrator to reduce food loss 19 and food waste by 50 percent by 2030. 20 (b) E LIGIBLEGOVERNMENTS.—A entity eligible to 21 receive a grant under subsection (a) is a State, municipal, 22 local, or Tribal government. 23 (c) P ARTNERSHIPS.—An eligible government de-24 scribed in subsection (b) that receives a grant under sub-25 VerDate Sep 11 2014 23:20 Apr 25, 2025 Jkt 059200 PO 00000 Frm 00020 Fmt 6652 Sfmt 6201 E:\BILLS\H2883.IH H2883 kjohnson on DSK7ZCZBW3PROD with $$_JOB 21 •HR 2883 IH section (a) shall use the grant to establish a partnership 1 with the following entities: 2 (1) 1 or more nonprofit organizations. 3 (2) 1 or more private entities from any of the 4 following sectors: 5 (A) Grocery and specialty food. 6 (B) Hospitality. 7 (C) Restaurants. 8 (D) Supercenters. 9 (E) Hospitals. 10 (F) Nursing homes. 11 (G) Adult care facilities. 12 (H) Any other sector that the Secretary 13 determines to be appropriate. 14 (d) R EQUIREMENTS.—A partnership established 15 under subsection (c) shall— 16 (1) commit to reducing food loss and food waste 17 in accordance with the goal described in subsection 18 (a); 19 (2) provide— 20 (A) a framework for cooperative action re-21 lating to food loss and food waste; 22 (B) a forum for leadership and the sharing 23 of information on best practices relating to food 24 loss and food waste; and 25 VerDate Sep 11 2014 23:20 Apr 25, 2025 Jkt 059200 PO 00000 Frm 00021 Fmt 6652 Sfmt 6201 E:\BILLS\H2883.IH H2883 kjohnson on DSK7ZCZBW3PROD with $$_JOB 22 •HR 2883 IH (C) a list of the highest priorities on issues 1 relating to food loss and food waste; 2 (3) establish a methodology for measurement of 3 reductions in food loss and food waste, with the sup-4 port of a technical team of individuals from 1 or 5 more organizations in the partnership; 6 (4) collect data and prepare reports for the pur-7 poses of— 8 (A) establishing a baseline of food loss and 9 food waste appropriate for the scope of the col-10 laboration for which the grant was awarded; 11 (B) monitoring progress in reducing food 12 loss and food waste; 13 (C) identifying particular areas relating to 14 food loss and food waste that need attention; 15 and 16 (D) highlighting successes in reducing food 17 loss and food waste that can be replicated; 18 (5) establish 1 or more working groups to facili-19 tate dialogue and dissemination of insights and best 20 practices relating to food loss and food waste; and 21 (6) make publicly available an annual report de-22 scribing the activities of the partnership. 23 (e) M ATCHINGREQUIREMENT.—An eligible govern-24 ment described in subsection (b) that receives a grant 25 VerDate Sep 11 2014 23:20 Apr 25, 2025 Jkt 059200 PO 00000 Frm 00022 Fmt 6652 Sfmt 6201 E:\BILLS\H2883.IH H2883 kjohnson on DSK7ZCZBW3PROD with $$_JOB 23 •HR 2883 IH under subsection (a) shall provide funds, in-kind contribu-1 tions, or a combination of both from sources other than 2 funds provided through the grant in an amount equal to 3 not less than 50 percent of the amount of the grant, which 4 may include private funding or other sources of revenue, 5 as determined by the Secretary. 6 (f) C OORDINATION.—A partnership established under 7 subsection (c) shall coordinate with regional coordinators 8 established under section 4(a), as the partnership deter-9 mines to be appropriate. 10 (g) A UTHORIZATION OFAPPROPRIATIONS.—There is 11 authorized to be appropriated to carry out this section 12 $2,000,000 for each of fiscal years 2026 through 2030. 13 SEC. 8. FOOD LOSS AND WASTE EDUCATION AND AWARE-14 NESS CAMPAIGN. 15 (a) I NGENERAL.—The Secretary, in consultation 16 with the Administrator, shall initiate a national food waste 17 education and public awareness campaign (referred to in 18 this section as the ‘‘campaign’’) through— 19 (1) the Liaison; 3 (2) highlight methods for preserving and stor-4 ing foods; 5 (3) provide consumers tips to identify whether 6 food is still safe and edible, regardless of any 7 ‘‘BEST If Used By’’ or the ‘‘USE By’’ date on the 8 label or food packaging indicating quality and 9 freshness; 10 (4) teach consumers the differences between 11 food freshness and food safety; 12 (5) teach consumers how to compost food 13 scraps; 14 (6) develop educational materials usable by sev-15 eral different channels, including for specific indus-16 try sectors (including retail, food service, and con-17 sumer packaged goods), local governments, schools, 18 community and faith-based organizations, and other 19 appropriate channels; 20 (7) educate consumers on food products made 21 with food waste, including upcycled food products, or 22 that use innovative technology to prevent food loss 23 and food waste; 24 (8) include interactive elements; 7 (2) identify, using the means determined under 8 paragraph (1), population segments to target; 9 (3) understanding how to best target those 10 identified population segments; and 11 (4) determining which strategies are most effec-12 tive in changing consumer behaviors. 13 (d) D UALFRAMEWORKCAMPAIGN.— 14 (1) I N GENERAL.—The Secretary shall carry 15 out the campaign through— 16 (A) community engagement, which allows 17 information to be delivered through locally 18 trusted sources, with locally tailored solutions 19 and partners (such as for donation or compost 20 options); and 4 (ii) such other issues as the Secretary 5 determines to be appropriate. 6 (2) P ILOT PROJECTS.— 7 (A) I N GENERAL.—The Secretary shall— 8 (i) for the purpose of testing methods 9 and materials for carrying out the cam-10 paign through community engagement 11 under paragraph (1)(A), carry out pilot 12 projects in communities selected by the 13 Secretary; and 14 (ii) assess the results of those pilot 15 projects, including through waste audits or 16 other quantitative measurements. 17 (B) R EQUIREMENTS.—In carrying out 18 pilot projects under subparagraph (A), the Sec-19 retary shall— 20 (i) ensure equity and diversity of rep-21 resentation;
