REINSTATEMENT OF PRE-PANDEMIC TELEWORK 1 POLICIES, PRACTICES, AND LEVELS FOR EX-2 ECUTIVE AGENCIES. 3 Not later than 30 days after the date of enactment 4 of this Act, each agency shall adopt and apply telework 5 policies, practices, and levels at the agency that are equiv-6 alent to, or otherwise permit no additional levels of 7 telework than, those which were in effect on December 31, 8 2019, and may not expand any such policy, practice, or 9 level until the date that an agency plan is submitted to 10 Congress with a certification by the Director of the Office 11 of Personnel Management under section 3. 12 SEC. 3. STUDY, PLAN, AND CERTIFICATION REGARDING EX-13 ECUTIVE AGENCY TELEWORK POLICIES, 14 PRACTICES, AND LEVELS FOR EXECUTIVE 15 AGENCIES. 16 (a) I NGENERAL.—Not later than 6 months after the 17 date of enactment of this Act, the head of each agency, 18 in consultation with the Director, shall submit to Con-19 gress— 20 (1) a study on the impacts on the agency and 21 its mission of expanding telework by its employees 22 during the SARS–CoV–2 pandemic that commenced 23 in 2019 and maintaining such expanded telework 24 thereafter, including an analysis of— 25 VerDate Sep 11 2014 23:14 Feb 11, 2025 Jkt 059200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H473.IH H473 kjohnson on DSK7ZCZBW3PROD with $$_JOB 3 •HR 473 IH (A) any adverse impacts of that expansion 1 on the agency’s performance of its mission, in-2 cluding the performance of customer service by 3 the agency; 4 (B) any costs to the agency during that ex-5 pansion attributable to— 6 (i) owning, leasing, or maintaining un-7 derutilized real property; or 8 (ii) paying higher rates of locality pay 9 to teleworking employees as a result of in-10 correctly classifying such employees as 11 teleworkers rather than remote workers; 12 (C) any degree to which the agency failed 13 during that expansion to provide teleworking 14 employees with secure network capacity, com-15 munications tools, necessary and secure access 16 to appropriate agency data assets and Federal 17 records, and equipment sufficient to enable each 18 such employee to be fully productive; 19 (D) any degree to which that expansion fa-20 cilitated dispersal of the agency workforce 21 around the Nation; and 22 (E) any other impacts of that expansion 23 that the agency or the Director considers ap-24 propriate; 25 VerDate Sep 11 2014 23:14 Feb 11, 2025 Jkt 059200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H473.IH H473 kjohnson on DSK7ZCZBW3PROD with $$_JOB 4 •HR 473 IH (2) any agency plan to expand telework policies, 1 practices, or levels beyond those in place as a result 2 of section 2; and 3 (3) a certification by the Director that such 4 plan will— 5 (A) have a substantial positive effect on— 6 (i) the performance of the agency’s 7 mission, including the performance of cus-8 tomer service; 9 (ii) increasing the level of dispersal of 10 agency personnel throughout the Nation; 11 and 12 (iii) the reversal of any adverse im-13 pact set forth pursuant to paragraph 14 (1)(D); 15 (B) substantially lower the agency’s costs 16 of owning, leasing, or maintaining real prop-17 erty; 18 (C) substantially lower the agency’s costs 19 attributable to paying locality pay to agency 20 personnel working from locations outside the 21 pay locality of their position’s official worksite; 22 and 23 (D) ensure that teleworking employees will 24 be provided with secure network capacity, com-25 VerDate Sep 11 2014 23:14 Feb 11, 2025 Jkt 059200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H473.IH H473 kjohnson on DSK7ZCZBW3PROD with $$_JOB 5 •HR 473 IH munications tools, necessary and secure access 1 to appropriate agency data assets and Federal 2 records, and equipment sufficient to enable each 3 such employee to be fully productive, without 4 substantially increasing the agency’s overall 5 costs for secure network capacity, communica-6 tions tools, and equipment. 7 (b) L IMITATION.— 8 (1) I N GENERAL.—An agency may not imple-9 ment the plan submitted under subsection (a)(2) un-10 less a certification by the Director was issued under 11 subsection (a)(3). 12 (2) S UBSEQUENT PLANS .—In the event an ini-13 tial agency plan submitted under subsection (a)(2) 14 fails to receive such certification, the agency may 15 submit to the Director subsequent plans until such 16 certification is received, and submit such plan and 17 certification to Congress. 18 (c) D EFINITIONS.—In this Act— 19 (1) the term ‘‘agency’’ has the meaning given 20 the term ‘‘Executive agency’’ in section 105 of title 21 5, United States Code, except that such term does 22 not include the Government Accountability Office; 23 (2) the term ‘‘Director’’ means the Director of 24 the Office of Personnel Management; 25 VerDate Sep 11 2014 23:14 Feb 11, 2025 Jkt 059200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\H473.IH H473 kjohnson on DSK7ZCZBW3PROD with $$_JOB 6 •HR 473 IH (3) the term ‘‘locality pay’’ means locality pay 1 provided for under section 5304 or 5304a of such 2 title; and 3 (4) the terms ‘‘telework’’ and ‘‘teleworking’’ 4 have the meaning given those terms in section 6501 5 of such title, and include remote work. 6 Æ VerDate Sep 11 2014 23:14 Feb 11, 2025 Jkt 059200 PO 00000 Frm 00006 Fmt 6652 Sfmt 6301 E:\BILLS\H473.IH H473 kjohnson on DSK7ZCZBW3PROD with $$_JOB
