To amend title 28, United States Code, to change the resi-
dency requirements for certain officials serving in the 
District of Columbia, and for other purposes. 
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘District of Columbia 4
Federal Judicial Officials Residency Equality Act of 5
2025’’. 6

SEC. 2. RESIDENCY REQUIREMENTS FOR CERTAIN OFFI-1
CIALS SERVING IN THE DISTRICT OF COLUM-2

(a) C
IRCUITJUDGES.—Section 44(c) of title 28, 4
United States Code, is amended— 5
(1) by striking ‘‘Except in the District of Co-6
lumbia, each’’ and inserting ‘‘Each’’; 7
(2) by striking ‘‘his appointment’’ and inserting 8
‘‘his or her appointment’’; and 9
(3) by striking ‘‘state’’ and inserting ‘‘State’’. 10
(b) D
ISTRICTJUDGES.—Section 134 of title 28, 11
United States Code, is amended— 12
(1) in the first sentence of subsection (b)— 13
(A) by striking ‘‘the District of Columbia, 14
the Southern District of New York, and’’ and 15
inserting ‘‘the Southern District of New York 16
and’’; and 17
(B) by striking ‘‘for which he’’ and insert-18
ing ‘‘for which he or she’’; and 19
(2) in subsection (c), by striking ‘‘his’’ each 20
place it appears and inserting ‘‘his or her’’. 21

NITEDSTATESATTORNEYS.—Section 545(a) of 22
title 28, United States Code, is amended by striking the 23
first sentence and inserting ‘‘Each United States attorney 24
shall reside in the district for which he or she is appointed, 25
except that those officers of the Southern District of New 26

York and the Eastern District of New York may reside 1
within 20 miles thereof.’’. 2
(d) U
NITEDSTATESMARSHALS.—Section 561(e)(1) 3
of title 28, United States Code, is amended to read as 4
follows: 5
‘‘(1) the marshal for the Southern District of 6
New York may reside within 20 miles of the district; 7
and’’. 8
(e) C
LERKS.—Section 751(c) of title 28, United 9
States Code, is amended by striking ‘‘District of Columbia 10
and the’’. 11
(f) E
FFECTIVEDATE.—The amendments made by 12
this section shall apply only to individuals appointed after 13
the date of the enactment of this Act. 14
