SHORT TITLE. 1 This Act may be cited as ‘‘Sarah’s Law’’. 2 SEC. 2. MANDATORY DETENTION OF CERTAIN ALIENS 3 CHARGED WITH A CRIME RESULTING IN 4 DEATH OR SERIOUS BODILY INJURY. 5 Section 236(c) of the Immigration and Nationality 6 Act (8 U.S.C. 1226(c)) is amended— 7 (1) in paragraph (1)— 8 (A) in subparagraph (C)— 9 (i) by striking ‘‘sentence’’ and insert-10 ing ‘‘sentenced’’; and 11 (ii) by striking ‘‘or’’; 12 (B) in subparagraph (D), by striking the 13 comma at the end and inserting ‘‘, or’’; and 14 (C) by inserting after subparagraph (D) 15 the following: 16 ‘‘(E)(i)(I) is inadmissible under paragraph 17 (6)(A), (6)(C), or (7) of section 212(a), 18 ‘‘(II) is deportable under section 19 237(a)(1)(B) as an alien whose nonimmigrant 20 visa (or other documentation authorizing admis-21 sion into the United States as a nonimmigrant) 22 has been revoked under section 221(i), or 23 ‘‘(III) is deportable under section 24 237(a)(1)(C)(i), and 25 VerDate Sep 11 2014 16:19 Feb 18, 2025 Jkt 059200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H578.IH H578 ssavage on LAPJG3WLY3PROD with BILLS 3 •HR 578 IH ‘‘(ii) is charged with, is arrested for, is 1 convicted of, admits having committed, or ad-2 mits committing acts which constitute the es-3 sential elements of any offense that resulted in 4 the death or serious bodily injury (as defined in 5 section 1365(h)(3) of title 18, United States 6 Code) of another person,’’; and 7 (2) by adding at the end the following: 8 ‘‘(3) N OTIFICATION REQUIREMENT .—Upon en-9 countering or gaining knowledge of an alien de-10 scribed in paragraph (1), the Secretary of Homeland 11 Security shall— 12 ‘‘(A) obtain information from law enforce-13 ment agencies and from other available sources 14 regarding the identity of any victims of the 15 crimes for which such alien was charged, ar-16 rested, or convicted; and 17 ‘‘(B) provide the victim or, if the victim is 18 deceased, a parent, guardian, spouse, or closest 19 living relative of such victim, with information, 20 on a timely and ongoing basis, including— 21 ‘‘(i) the alien’s full name, aliases, date 22 of birth, and country of nationality; 23 ‘‘(ii) the alien’s immigration status 24 and criminal history; 25 VerDate Sep 11 2014 16:19 Feb 18, 2025 Jkt 059200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H578.IH H578 ssavage on LAPJG3WLY3PROD with BILLS 4 •HR 578 IH ‘‘(iii) the alien’s custody status and 1 any changes related to the alien’s custody; 2 and 3 ‘‘(iv) a description of any efforts by 4 the United States Government to remove 5 the alien from the United States. 6 ‘‘(4) D ETAINER.—The Secretary of Homeland 7 Security shall issue a detainer for an alien described 8 in paragraph (1)(E) and, if the alien is not other-9 wise detained by Federal, State, or local officials, 10 shall effectively and expeditiously take custody of the 11 alien.’’. 12 SEC. 3.
