A BILL 
To amend the Immigration and Nationality Act to provide 
for the detention of certain aliens who commit assault 
against law enforcement officers. 
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Detain and Deport 4
Illegal Aliens Who Assault Cops Act’’. 5
SEC. 2. DETENTION OF CERTAIN ALIENS WHO COMMIT AS-6
SAULT AGAINST LAW ENFORCEMENT OFFI-7
CERS. 8
Section 236(c) of the Immigration and Nationality 9
Act (8 U.S.C. 1226(c)) is amended— 10

(1) in paragraph (1)— 1
(A) in the matter preceding subparagraph 2
(A), by striking ‘‘Attorney General’’ and insert-3
ing ‘‘Secretary of Homeland Security’’; 4
(B) in subparagraph (C), by striking ‘‘, 5
or’’ and inserting a comma; 6
(C) in subparagraph (D), by adding ‘‘or’’ 7
at the end; and 8
(D) by inserting after subparagraph (D) 9
the following: 10
‘‘(E)(i) is inadmissible under section 11
212(a)(6)(A) or (C) or under section 212(a)(7); 12
and 13
‘‘(ii) is charged with, arrested for, con-14
victed of, admits having committed, or admits 15
committing acts which constitute the essential 16
elements of any offense involving assault of a 17
law enforcement officer,’’; 18
(2) by redesignating paragraph (2) as para-19
graph (4); and 20
(3) by inserting after paragraph (1) the fol-21
lowing: 22

IRCUMSTANCES.— 23

‘‘(A) IN GENERAL.—The circumstances re-1
ferred to in paragraph (1)(E) are that the law 2
enforcement officer was assaulted— 3
‘‘(i) while he or she was engaged in 4
the performance of his or her official du-5
ties; 6
‘‘(ii) because of the performance of his 7
or her official duties; or 8
‘‘(iii) because of his or her status as 9
a law enforcement officer. 10
‘‘(B) D
EFINITIONS.—For purposes of 11
paragraph (1)(E)— 12
‘‘(i) the term ‘assault’ has the mean-13
ing given that term in the jurisdiction 14
where the acts occurred; and 15
‘‘(ii) the term ‘law enforcement offi-16
cer’ is a person authorized by law— 17
‘‘(I) to engage in or supervise the 18
prevention, detention, investigation, or 19
prosecution, or the incarceration of 20
any person for any criminal violation 21
of law; 22
‘‘(II) to apprehend, arrest, or 23
prosecute an individual for any crimi-24
nal violation of law; or 25

‘‘(III) to be a firefighter or other 1
first responder. 2
‘‘(3) D
ETAINER.—The Secretary of Homeland 3
Security shall issue a detainer for an alien described 4
in paragraph (1)(E) and, if the alien is not other-5
wise detained by Federal, State, or local officials, 6
shall effectively and expeditiously take custody of the 7
alien.’’. 8
