To improve retrospective reviews of Federal regulations, and 
for other purposes. 
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Modernizing Retro-4
spective Regulatory Review Act’’. 5
SEC. 2. IMPROVING RETROSPECTIVE REVIEWS OF EXIST-6
ING FEDERAL REGULATIONS. 7
(a) R
EPORT ONAVAILABILITY OFEXISTINGREGU-8
LATIONS INMACHINE-READABLEFORMAT.— 9

(1) IN GENERAL.—Not later than 180 days 1
after the date of the enactment of this Act, the Di-2
rector of the Office of Management and Budget, act-3
ing through the Administrator and in consultation 4
with the Director of GPO, the Archivist, and the Di-5
rector of the Federal Register, shall submit to the 6
appropriate congressional committees, a report on 7
the progress of the Federal Government in making 8
regulations of agencies available in machine-readable 9
format. 10
(2) C
ONTENTS OF REPORT .—The report re-11
quired by paragraph (1) shall include— 12
(A) an assessment of whether regulations 13
of agencies have been made available in a ma-14
chine-readable format to the public; and 15
(B) information regarding the recognition 16
by the Administrative Committee of the Federal 17
Register of the eCFR maintained by the Direc-18
tor of the Federal Register and the Director of 19
GPO as an official legal edition of the Code of 20
Federal Regulations. 21

UIDANCE ONUSINGTECHNOLOGYTOCONDUCT 22

ETROSPECTIVEREVIEWS.— 23
(1) I
N GENERAL.—Not later than 18 months 24
after the date of the enactment of this Act, the Di-25

rector of the Office of Management and Budget, act-1
ing through the Administrator, shall issue guidance 2
on how the head of the agency can— 3
(A) identify, procure, and use technology 4
(including algorithmic tools and artificial intel-5
ligence) to more efficiently, cost-effectively, and 6
accurately conduct any retrospective review of 7
the existing regulations of the agency, including 8
to more efficiently, cost-effectively, and accu-9
rately identify through any such review regula-10
tions of the agency that— 11
(i) are obsolete, ineffective, insuffi-12
cient, excessively burdensome, or redun-13
dant; 14
(ii) should be improved; 15
(iii) contain typographic errors; 16
(iv) contain inaccurate cross-ref-17
erences; or 18
(v) contradict or overlap with each 19
other, or any standards of the agency; and 20
(B) adequately train personnel of the agen-21
cy on how to use such technology. 22
(2) D
EVELOPMENT OF GUIDANCE .—In devel-23
oping the guidance required pursuant to paragraph 24
(1), the Administrator shall take into account any 25

assessment or information included in the report re-1
quired by subsection (a). 2
(c) A
GENCYRETROSPECTIVEREVIEWPLAN.—Not 3
later than 2 years after the date of the enactment of this 4
Act, the head of each agency shall submit to the Adminis-5
trator and the appropriate congressional committees a 6
plan that— 7
(1) includes a detailed strategy for imple-8
menting the guidance issued pursuant to subsection 9
(b) with respect to the regulations of the agency; 10
(2) identifies any regulation of the agency, or 11
categories of regulations of the agency, that the 12
head of the agency— 13
(A) is required by law to review after the 14
applicable regulation is issued; or 15
(B) determines would benefit from being 16
reviewed after the regulation is issued; and 17
(3) includes any additional information, data, 18
or ex-post analysis determined necessary or useful 19
by the head of the agency. 20
(d) A
GENCYIMPLEMENTATION.—Not later than 180 21
days after the date on which the head of an agency sub-22
mits the plan required by subsection (c), the head of the 23
agency shall implement the strategy included in such plan 24

with respect to any retrospective review of an existing reg-1
ulation of the agency. 2
(e) D
EFINITIONS.—In this section: 3
(1) A
DMINISTRATIVE COMMITTEE OF THE FED -4
ERAL REGISTER.—The term ‘‘Administrative Com-5
mittee of the Federal Register’’ means the Com-6
mittee established under section 1506 of title 44, 7
United States Code. 8
(2) A
DMINISTRATOR.—The term ‘‘Adminis-9
trator’’ means the Administrator of the Office of In-10
formation and Regulatory Affairs. 11
(3) A
GENCY.—The term ‘‘agency’’ has the 12
meaning given that term in section 3502 of title 44, 13
United States Code. 14
(4) A
PPROPRIATE CONGRESSIONAL COMMIT -15
TEES.—The term ‘‘appropriate congressional com-16
mittees’’ means— 17
(A) the Committee on Oversight and Gov-18
ernment Reform of the House of Representa-19
tives; and 20
(B) the Committee on Homeland Security 21
and Governmental Affairs of the Senate. 22
(5) D
IRECTOR OF GPO.—The term ‘‘Director of 23
GPO’’ means the Director of the Government Pub-24
lishing Office. 25

(6) MACHINE-READABLE.—The term ‘‘machine- 1
readable’’ has the meaning given the term in section 2
3502 of title 44, United States Code. 3
(7) R
ETROSPECTIVE REVIEW OF AN EXISTING 4
REGULATION OF THE AGENCY .—The term ‘‘retro-5
spective review of an existing regulation of the agen-6
cy’’ means a review of a regulation of the agency 7
conducted after the regulation has been issued, in-8
cluding any such review required by law or deter-9
mined appropriate by the head of the agency. 10
