A BILL
To exempt Federal actions related to energy and mineral
activities on certain Federal lands from the requirements
of the National Environmental Policy Act of 1969.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. NEPA EXEMPTION FOR FEDERAL ACTIONS RE-3
LATED TO ENERGY AND MINERAL ACTIVITIES 4
ON CERTAIN FEDERAL LANDS. 5
Notwithstanding any other provision of law, the fol-6
lowing shall not be considered a major Federal action 7
under section 102(2)(C) of the National Environmental 8
Policy Act of 1969 (42 U.S.C. 4332(2)(C)): 9

(1) Issuing, granting, or renewing a lease, ease-1
ment, or right-of-way under the Mineral Leasing Act 2
(30 U.S.C. 181 et seq.) for the exploration, develop-3
ment, or production of oil, gas, or coal. 4
(2) Issuing, granting, or renewing a permit or 5
other authorization under the Mining Law of 1872 6
(30 U.S.C. 22 et seq.) for the exploration, location, 7
development, or extraction of a critical mineral on 8
land that is open to mineral entry. 9
