A BILL
To amend the Small Business Act to require the Small
Business and Agriculture Regulatory Enforcement Om-
budsman to publish guidance documents for certain
rules, and for other purposes.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Providing Opportuni-4
ties to Show Transparency via Information Technology 5
Act of 2025’’ or the ‘‘POST IT Act of 2025’’. 6

SEC. 2. INCLUSION OF GUIDANCE ON OMBUDSMAN 1

(a) W
EBSITEREQUIREMENT.—Section 30 of the 3
Small Business Act (15 U.S.C. 657) is amended— 4
(1) in subsection (e)— 5
(A) in paragraph (1), by striking ‘‘and’’ at 6
the end; 7
(B) in paragraph (2), by striking the pe-8
riod at the end and inserting ‘‘; and’’; and 9
(C) by adding at the end the following new 10
paragraph: 11
‘‘(3) to the extent practicable, hyperlinks for 12
any guidance that is designed to set forth policy on 13
a statutory, regulatory, or technical issue, or an in-14
terpretation of such issue, for any rule for which an 15
agency produces a small entity compliance guide.’’; 16
and 17
(2) by adding at the end the following new sub-18
section: 19
‘‘(g) P
ROTECTION OF CONFIDENTIAL INFORMA-20
TION.—Subsection (e) does not require the public avail-21
ability of information that is exempt from public disclosure 22
under section 552(b) of title 5, United States Code (com-23
monly known as the ‘Freedom of Information Act’).’’. 24

PPLICABILITY.—Paragraph (3) of section 30(e) 25
of the Small Business Act (15 U.S.C. 657), as added by 26

this section, shall apply with respect to guidance on, or 1
interpretation of, a rule for which an agency produces a 2
small entity compliance guide described under section 3
212(a)(1) of the Small Business Regulatory Enforcement 4
Fairness Act of 1996 (5 U.S.C. 601 note) on or after the 5
date of the enactment of this Act. 6
SEC. 3. COMPLIANCE WITH CUTGO. 7
No additional amounts are authorized to be appro-8
priated to carry out this Act or the amendments made 9
by this Act. 10
