A BILL
To establish a new nonimmigrant visa for mobile
entertainment workers.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLES. 3
This Act may be cited as the ‘‘Restoring Industry De-4
velopment in Entertainment Act’’ or the ‘‘RIDE Act’’. 5
SEC. 2. AUTHORIZATION OF NEW P–4 NONIMMIGRANT VISA. 6
Section 101(a)(15)(P) of the Immigration and Na-7
tionality Act (8 U.S.C. 1101(a)(15)(P)) is amended— 8
(1) in clause (iii)(II) by striking ‘‘or’’ at the 9
end; and 10

(2) by striking clause (iv) and inserting the fol-1
lowing: 2
‘‘(iv) is a mobile entertainment worker 3
described in section 214(c)(4)(I) and for 4
which mobile entertainment position the 5
Department of Labor has certified that 6
if— 7
‘‘(I) there are not sufficient 8
workers who are able, willing, and 9
qualified, and who will be available at 10
the time and place needed, to perform 11
the labor or services required; and 12
‘‘(II) the employment of the alien 13
in such labor or services will not ad-14
versely affect the wages and working 15
conditions of workers in the United 16
States similarly employed; or 17
‘‘(v) is the spouse or child of an alien 18
described in clause (i), (ii), (iii), or (iv) and 19
is accompanying, or following to join, such 20
alien.’’. 21
SEC. 3. MOBILE ENTERTAINMENT WORKERS. 22
Section 214(c)(4) of the Immigration and Nationality 23
Act (8 U.S.C. 1184(c)(4)) is amended by adding at the 24
end the following: 25

‘‘(I)(i) For purposes of section 101(a)(15)(P)(iv), an 1
alien is a mobile entertainment worker described in this 2
subparagraph if the alien seeks to enter the United States 3
temporarily and solely for the purpose of performing func-4
tions that are integral and essential to the operation of 5
a mobile entertainment provider, including— 6
‘‘(I) transporting, assembly, operation, dis-7
assembly, and maintenance of mobile entertainment 8
attractions, structures, and equipment, including 9
rides, games, novelties, and food or beverage conces-10
sions; and 11
‘‘(II) other functions that are common in the 12
mobile entertainment industry and are necessary for 13
the safe and efficient operation of the mobile enter-14
tainment provider. 15
‘‘(ii) In this subparagraph, the term ‘mobile enter-16
tainment provider’ means— 17
‘‘(I) a carnival or circus that travels around the 18
United States on a temporary or seasonal basis; or 19
‘‘(II) a provider of services normally affiliated 20
with a carnival or circus, such as food and game 21
concessions, that travels around the United States 22
on a seasonal or temporary basis to provide services 23
to— 24

‘‘(aa) State, county, and local fairs and 1
festivals; or 2
‘‘(bb) support events sponsored by not-for- 3
profit organizations for fundraising.’’. 4
SEC. 4. RULEMAKING. 5
The Secretary of Homeland Security and the Sec-6
retary of Labor shall each publish in the Federal Reg-7
ister— 8
(1) not later than 180 days after the date of 9
the enactment of this Act, proposed rules imple-10
menting the amendments made by sections 2 and 3; 11
and 12
(2) not later than 1 year after such date of en-13
actment, final rules implementing the amendments 14
made by sections 2 and 3. 15
