A BILL
To amend the Safe Drinking Water Act to modify eligibility
for the State response to contaminants program, and
for other purposes.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. TECHNICAL FIX FOR STATE RESPONSE TO CON-3
TAMINANTS PROGRAM. 4
Section 1459A(j) of the Safe Drinking Water Act (42 5
U.S.C. 300j–19a(j)) is amended— 6
(1) in paragraph (1)— 7
(A) in the matter preceding subparagraph 8
(A), by striking ‘‘subsection (c)(2)’’ and insert-9

ing ‘‘clause (i) or (ii) of subparagraph (A) of 1
paragraph (3) or a drinking water well owner 2
described in subparagraph (B) of that para-3
graph’’; 4
(B) by striking ‘‘contaminant—’’ and all 5
that follows through ‘‘to—’’ in subparagraph 6
(A) in the matter preceding clause (i) and in-7
serting ‘‘contaminant that is determined by the 8
State—’’; 9
(C) by striking subparagraph (B); 10
(D) by redesignating clauses (i) and (ii) as 11
subparagraphs (A) and (B), respectively, and 12
indenting appropriately; 13
(E) in subparagraph (A) (as so redesig-14
nated)— 15
(i) by inserting ‘‘to’’ before ‘‘be 16
present’’; 17
(ii) by striking ‘‘serving,’’ and insert-18
ing ‘‘serving a community’’; and 19
(iii) by striking ‘‘for, that commu-20
nity’’; and 21
(F) in subparagraph (B) (as so redesig-22
nated)— 23
(i) by inserting ‘‘to’’ before ‘‘poten-24
tially’’; and 25

(ii) by striking ‘‘; and’’ at the end and 1
inserting a period; and 2
(2) by adding at the end the following: 3
‘‘(3) E
LIGIBILITY FOR ASSISTANCE OR AS A 4
BENEFICIARY OF ASSISTANCE .—For purposes of this 5
subsection, the Administrator may issue a grant to 6
a State— 7
‘‘(A) that is requesting a grant on behalf 8
of— 9
‘‘(i) a community that, under the af-10
fordability criteria established by the State 11
under section 1452(d)(3), is determined by 12
the State to be— 13
‘‘(I) a disadvantaged community; 14
or 15
‘‘(II) a community that may be-16
come a disadvantaged community as a 17
result of carrying out an activity de-18
scribed in paragraph (1); or 19
‘‘(ii) a community with a population 20
of fewer than 10,000 individuals that the 21
Administrator determines does not have 22
the capacity to incur debt sufficient to fi-23
nance an activity described in paragraph 24
(1); or 25

‘‘(B) for the benefit of 1 or more owners 1
of drinking water wells that are not public 2
water systems and are not connected to a public 3
water system.’’. 4
