To amend the Richard B. Russell National School Lunch
Act to allow schools that participate in the school lunch
program to serve whole milk, and for other purposes.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Whole Milk for 4
Healthy Kids Act of 2025’’. 5

Section 9(a)(2) of the Richard B. Russell National 3
School Lunch Act (42 U.S.C. 1758(a)(2)) is amended— 4
(1) in subparagraph (A)— 5
(A) by striking clauses (i) and (ii) and in-6
serting the following: 7
‘‘(i) shall offer students a variety of 8
fluid milk; 9
‘‘(ii) may offer students flavored and 10
unflavored organic or nonorganic whole, 11
reduced-fat, low-fat, and fat-free fluid milk 12
and lactose-free fluid milk;’’; and 13
(B) in clause (iii), by striking ‘‘physician’’ 14
and inserting ‘‘physician, parent, or legal 15
guardian’’; and 16
(2) by adding at the end the following: 17
‘‘(D) S
ATURATED FAT.—Milk fat included 18
in any fluid milk provided under subparagraph 19
(A) shall not be considered saturated fat for 20
purposes of measuring compliance with the al-21
lowable average saturated fat content of a meal 22
under section 210.10 of title 7, Code of Federal 23
Regulations (or successor regulations).’’. 24
