ADVERSE INFORMATION ABOUT CONSUMERS UN-1 LAWFULLY OR WRONGFULLY DETAINED 2 ABROAD OR HELD HOSTAGE ABROAD. 3 (a) I NGENERAL.—The Fair Credit Reporting Act 4 (15 U.S.C. 1681 et seq.) is amended by inserting after 5 section 605C the following: 6 ‘‘§ 605D. Adverse information about consumers un-7 lawfully or wrongfully detained abroad 8 or held hostage abroad 9 ‘‘(a) D EFINITIONS.—In this section: 10 ‘‘(1) C OVERED CONSUMER .—The term ‘covered 11 consumer’ means an individual who has been— 12 ‘‘(A) a United States national unlawfully 13 or wrongfully detained abroad, as determined 14 under section 302(a) of the Robert Levinson 15 Hostage Recovery and Hostage-Taking Ac-16 countability Act (22 U.S.C. 1741(a)); or 17 ‘‘(B) a United States national taken hos-18 tage abroad, as determined by the Hostage Re-19 covery Fusion Cell established by section 304 20 that Act (22 U.S.C. 1741b). 21 ‘‘(2) D ETENTION OR HOSTAGE DOCUMENTA -22 TION.—The term ‘detention or hostage documenta-23 tion’ means documentation that— 24 ‘‘(A) certifies a consumer is a covered con-25 sumer under this section; 26 VerDate Sep 11 2014 03:52 Mar 08, 2025 Jkt 059200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S656.IS S656 kjohnson on DSK7ZCZBW3PROD with $$_JOB 3 •S 656 IS ‘‘(B) identifies the time period during 1 which the covered consumer was unlawfully or 2 wrongfully detained abroad or held hostage 3 abroad; and 4 ‘‘(C) is authenticated by— 5 ‘‘(i) the Special Presidential Envoy for 6 Hostage Affairs established by section 303 7 of the Robert Levinson Hostage Recovery 8 and Hostage-Taking Accountability Act 9 (22 U.S.C. 1741a); or 10 ‘‘(ii) the Hostage Recovery Fusion 11 Cell established by section 304 of that Act 12 (22 U.S.C. 1741b). 13 ‘‘(b) A DVERSEINFORMATION.—If a consumer report-14 ing agency described in section 603(p) is able to authen-15 ticate detention or hostage documentation provided by a 16 covered consumer, the consumer reporting agency may not 17 furnish a consumer report containing any adverse item of 18 information about the covered consumer dating during the 19 time period the covered consumer was unlawfully or 20 wrongfully detained abroad or held hostage abroad.’’. 21 (b) T ECHNICAL AND CONFORMINGAMENDMENT.— 22 The table of contents of the Fair Credit Reporting Act 23 is amended by inserting after the item relating to section 24 605C the following: 25 VerDate Sep 11 2014 03:52 Mar 08, 2025 Jkt 059200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S656.IS S656 kjohnson on DSK7ZCZBW3PROD with $$_JOB 4 •S 656 IS ‘‘605D.
