To prohibit funding for the Montreal Protocol on Substances
that Deplete the Ozone Layer and the United Nations
Framework Convention on Climate Change until China
is no longer defined a developing country.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Ending China’s Unfair 4
Advantage Act of 2025’’. 5
SEC. 2. DEFINITIONS. 6

(1) APPROPRIATE CONGRESSIONAL COMMIT -1
TEES.—The term ‘‘appropriate congressional com-2
mittees’’ means— 3
(A) the Committee on Foreign Relations of 4
the Senate; 5
(B) the Committee on Appropriations of 6
the Senate; 7
(C) the Committee on Foreign Affairs of 8
the House of Representatives; and 9
(D) the Committee on Appropriations of 10
the House of Representatives. 11
(2) M
ONTREAL PROTOCOL .—The term ‘‘Mon-12
treal Protocol’’ means the Montreal Protocol on Sub-13
stances that Deplete the Ozone Layer, done at Mon-14
treal September 16, 1987. 15

NITED NATIONS FRAMEWORK CONVEN -16
TION ON CLIMATE CHANGE .—The term ‘‘United Na-17
tions Framework Convention on Climate Change’’ 18
means the United Nations Framework Convention 19
on Climate Change, adopted in Rio de Janeiro, 20
Brazil in June 1992. 21

SEC. 3. PROHIBITION ON USE OF FUNDS FOR THE MON-1
TREAL PROTOCOL ON SUBSTANCES THAT DE-2
PLETE THE OZONE LAYER UNTIL CHINA IS 3
NO LONGER DEFINED AS A DEVELOPING 4
COUNTRY. 5
Notwithstanding any other provision of law, no Fed-6
eral funds may be obligated or expended to implement the 7
Montreal Protocol, including its protocols and amend-8
ments, or any fund established under the Protocol, until 9
the President certifies to the appropriate congressional 10
committees that the Parties to the Montreal Protocol have 11
amended their Decision I/12E, ‘‘Clarification of terms and 12
definitions: developing countries,’’ made at the First Meet-13
ing of the Parties to remove the People’s Republic of 14
China. 15
SEC. 4. PROHIBITION ON USE OF FUNDS FOR THE UNITED 16
NATIONS FRAMEWORK CONVENTION ON CLI-17
MATE CHANGE UNTIL CHINA IS INCLUDED 18
AMONG THE COUNTRIES LISTED IN ANNEX I 19
OF THE CONVENTION. 20
Notwithstanding any other provision of law, no Fed-21
eral funds may be obligated or expended to fund the oper-22
ations and meetings of the United Nations Framework 23
Convention on Climate Change, including it protocols or 24
agreements, or any fund established under the Convention 25
or its agreements, until the President certifies to the ap-26
