To amend the Research and Development, Competition, and
Innovation Act to clarify the definition of foreign country
for purposes of malign foreign talent recruitment restric-
tion, and for other purposes.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘United States Re-4
search Protection Act of 2025’’. 5

SEC. 2. CLARIFICATION OF DEFINITION OF FOREIGN COUN-1
TRY FOR PURPOSES OF MALIGN FOREIGN 2
TALENT RECRUITMENT RESTRICTION. 3
Paragraph (4) of section 10638 of title VI of division 4
B of the Research and Development, Competition, and In-5
novation Act (42 U.S.C. 19237) is amended— 6
(1) by inserting ‘‘of concern’’ after ‘‘foreign 7
country’’ each place such term appears; 8
(2) by striking ‘‘means—’’ and all that follows 9
through ‘‘any program, position, or activity’’ and in-10
serting ‘‘means any program, position, or activity’’; 11
(3) by striking subparagraph (B); 12
(4) by redesignating clauses (i) through (ix) as 13
subparagraphs (A) through (I), respectively, and 14
moving such subparagraphs, as so redesignated, two 15
ems to the left; 16
(5) in the matter preceding subparagraph (A), 17
as so redesignated, by striking ‘‘directly provided’’ 18
and inserting ‘‘whether directly or indirectly pro-19
vided’’; and 20
(6) in subparagraph (I), as so redesignated, by 21
striking ‘‘; and’’ and inserting a period. 22
