Be it enacted by the Senate and House of Representa-1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Keep Americans Safe 4 Act’’. 5 SEC. 2. DEFINITIONS. 6 Section 921(a) of title 18, United States Code, is 7 amended by adding at the end the following: 8 VerDate Sep 11 2014 08:16 Mar 14, 2025 Jkt 059200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\S803.IS S803 kjohnson on DSK7ZCZBW3PROD with $$_JOB 2 •S 803 IS ‘‘(38) The term ‘large capacity ammunition feeding 1 device’— 2 ‘‘(A) means a magazine, belt, drum, feed strip, 3 helical feeding device, or similar device, including 4 any such device joined or coupled with another in 5 any manner, that has an overall capacity of, or that 6 can be readily restored, changed, or converted to ac-7 cept, more than 10 rounds of ammunition; and 8 ‘‘(B) does not include an attached tubular de-9 vice designed to accept, and capable of operating 10 only with, .22 caliber rimfire ammunition. 11 ‘‘(39) The term ‘qualified law enforcement officer’ 12 has the meaning given the term in section 926B.’’. 13 SEC. 3. RESTRICTIONS ON LARGE CAPACITY AMMUNITION 14 FEEDING DEVICES. 15 (a) I NGENERAL.—Section 922 of title 18, United 16 States Code, is amended by inserting after subsection (u) 17 the following: 18 ‘‘(v)(1) It shall be unlawful for a person to import, 19 sell, manufacture, transfer, or possess, in or affecting 20 interstate or foreign commerce, a large capacity ammuni-21 tion feeding device. 22 ‘‘(2) Paragraph (1) shall not apply to the possession 23 of any large capacity ammunition feeding device otherwise 24 VerDate Sep 11 2014 08:16 Mar 14, 2025 Jkt 059200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S803.IS S803 kjohnson on DSK7ZCZBW3PROD with $$_JOB 3 •S 803 IS lawfully possessed on or before the date of enactment of 1 the Keep Americans Safe Act. 2 ‘‘(3) Paragraph (1) shall not apply to— 3 ‘‘(A) the importation for, manufacture for, sale 4 to, transfer to, or possession by the United States 5 or a department or agency of the United States or 6 a State or a department, agency, or political subdivi-7 sion of a State, or a sale or transfer to or possession 8 by a qualified law enforcement officer employed by 9 the United States or a department or agency of the 10 United States or a State or a department, agency, 11 or political subdivision of a State for purposes of law 12 enforcement (whether on or off-duty), or a sale or 13 transfer to or possession by a campus law enforce-14 ment officer for purposes of law enforcement (wheth-15 er on or off-duty); 16 ‘‘(B) the importation for, or sale or transfer to 17 a licensee under title I of the Atomic Energy Act of 18 1954 (42 U.S.C. 2011 et seq.) for purposes of estab-19 lishing and maintaining an on-site physical protec-20 tion system and security organization required by 21 Federal law, or possession by an employee or con-22 tractor of such licensee on-site for such purposes or 23 off-site for purposes of licensee-authorized training 24 or transportation of nuclear materials; or 7 ‘‘(ii) that the individual purchased, or oth-8 erwise obtained, for official use before such re-9 tirement; or 10 ‘‘(D) the importation, sale, manufacture, trans-11 fer, or possession of any large capacity ammunition 12 feeding device by a licensed manufacturer or licensed 13 importer for the purposes of testing or experimen-14 tation authorized by the Attorney General. 15 ‘‘(4) For purposes of paragraph (3)(A), the term 16 ‘campus law enforcement officer’ means an individual who 17 is— 18 ‘‘(A) employed by a private institution of higher 19 education that is eligible for funding under title IV 20 of the Higher Education Act of 1965 (20 U.S.C. 21 1070 et seq.); 2 ‘‘(C) authorized by Federal, State, or local law 3 to carry a firearm, execute search warrants, and 4 make arrests; and 5 ‘‘(D) recognized, commissioned, or certified by 6 a government entity as a law enforcement officer.’’. 7 (b) I DENTIFICATIONMARKINGS FORLARGECAPAC-8 ITYAMMUNITIONFEEDINGDEVICES.—Section 923(i) of 9 title 18, United States Code, is amended by adding at the 10 end the following: ‘‘A large capacity ammunition feeding 11 device manufactured after the date of enactment of the 12 Keep Americans Safe Act shall be identified by a serial 13 number and the date on which the device was manufac-14 tured or made, legibly and conspicuously engraved or cast 15 on the device, and such other identification as the Attor-16 ney General shall by regulations prescribe.’’. 17 (c) S EIZURE ANDFORFEITURE OFLARGECAPACITY 18 A MMUNITIONFEEDINGDEVICES.—Section 924(d) of title 19 18, United States Code, is amended— 20 (1) in paragraph (1)— 21 (A) in the first sentence— 22 (i) by striking ‘‘Any firearm or ammu-23 nition involved in’’ and inserting ‘‘Any fire-24 VerDate Sep 11 2014 08:16 Mar 14, 2025 Jkt 059200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\S803.IS S803 kjohnson on DSK7ZCZBW3PROD with $$_JOB 6 •S 803 IS arm or ammunition or large capacity am-1 munition feeding device involved in’’; 2 (ii) by striking ‘‘or (k)’’ and inserting 3 ‘‘(k), or (v)’’; and 4 (iii) by striking ‘‘any firearm or am-5 munition intended’’ and inserting ‘‘any 6 firearm or ammunition or large capacity 7 ammunition feeding device intended’’; and 8 (B) by inserting ‘‘or large capacity ammu-9 nition feeding devices’’ after ‘‘firearms or am-10 munition’’ each place the term appears; 11 (2) in paragraph (2)— 12 (A) in subparagraph (A), by inserting ‘‘or 13 large capacity ammunition feeding devices’’ 14 after ‘‘firearms or ammunition’’; and 15 (B) in subparagraph (C), by inserting ‘‘or 16 large capacity ammunition feeding devices’’ 17 after ‘‘firearms or quantities of ammunition’’; 18 and 19 (3) in paragraph (3)(E), by inserting ‘‘922(v),’’ 20 after ‘‘922(n),’’. 21 SEC. 4. USE OF BYRNE GRANTS FOR BUY-BACK PROGRAMS 1 FOR LARGE CAPACITY AMMUNITION FEED-2 ING DEVICES. 3 Section 501(a)(1) of title I of the Omnibus Crime 4 Control and Safe Streets Act of 1968 (34 U.S.C. 5 10152(a)(1)) is amended by adding at the end the fol-6 lowing: 7 ‘‘(J) Compensation for surrendered large 8 capacity ammunition feeding devices, as that 9 term is defined in section 921 of title 18, 10 United States Code, under buy-back programs 11 for large capacity ammunition feeding devices.’’. 12 SEC. 6.
