To amend the Workforce Innovation and Opportunity Act
to define the term evidence-based.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. EVIDENCE-BASED DEFINITION. 3
(a) I
NGENERAL.—Section 3 of the Workforce Inno-4
vation and Opportunity Act (29 U.S.C. 3102) is amended 5
by adding at the end the following new paragraph: 6
‘‘(72) E
VIDENCE-BASED.—The term ‘evidence- 7
based’, when used with respect to an activity, serv-8
ice, strategy, or intervention, or content of materials, 9

means an activity, service, strategy, or intervention, 1
or content of materials that— 2
‘‘(A) demonstrates a statistically signifi-3
cant effect on improving participant outcomes 4
or other relevant outcomes based on— 5
‘‘(i) strong evidence from at least 1 6
well-designed and well-implemented experi-7
mental study; 8
‘‘(ii) moderate evidence from at least 9
1 well-designed and well-implemented 10
quasi-experimental study; or 11
‘‘(iii) promising evidence from at least 12
1 well-designed and well-implemented cor-13
relational study with statistical controls for 14
selection bias; or 15
‘‘(B)(i) demonstrates a rationale based on 16
high-quality research findings or positive eval-17
uation that such activity, service, strategy, 18
intervention, or content is likely to improve stu-19
dent outcomes or other relevant outcomes; and 20
‘‘(ii) includes ongoing efforts to examine 21
the effects of such activity, service, strategy, 22
intervention, or content.’’. 23
(b) D
ESCRIPTION OF EVIDENCE-BASEDPRO-24
GRAMS.—Section 102(b)(1) of the Workforce Innovation 25

and Opportunity Act (29 U.S.C. 3112(b)(1)) is amend-1
ed— 2
(1) in subparagraph (C), by inserting ‘‘the ex-3
tent to which such activities are evidence-based,’’ 4
after ‘‘of such activities,’’; 5
(2) in subparagraph (D), by striking ‘‘and’’ at 6
the end; 7
(3) in subparagraph (E), by striking the period 8
and inserting ‘‘; and’’; and 9
(4) by adding at the end the following new sub-10
paragraph: 11
‘‘(F) a description of any strategies the 12
State will use to prioritize the funding of evi-13
dence-based programs through the funds re-14
served as described in section 128(a) and avail-15
able for statewide workforce development activi-16
ties.’’. 17
