MANUFACTURED HOUSING COMMUNITY IMPROVE-1 MENT GRANT PROGRAM. 2 Title I of the Housing and Community Development 3 Act of 1974 (42 U.S.C. 5301 et seq.) is amended— 4 (1) in section 105(a) (42 U.S.C. 5305(a)), in 5 the matter preceding paragraph (1), by striking 6 ‘‘Activities’’ and inserting ‘‘Unless otherwise author-7 ized under section 123, activities’’; and 8 (2) by adding at the end the following: 9 ‘‘SEC. 123. PRESERVATION AND REINVESTMENT FOR COM-10 MUNITY ENHANCEMENT. 11 ‘‘(a) D EFINITIONS.—In this section: 12 ‘‘(1) C OMMUNITY DEVELOPMENT FINANCIAL IN -13 STITUTION.—The term ‘community development fi-14 nancial institution’ means an institution that has 15 been certified as a community development financial 16 institution (as defined in section 103 of the Riegle 17 Community Development and Regulatory Improve-18 ment Act of 1994 (12 U.S.C. 4702)) by the Sec-19 retary of the Treasury. 20 ‘‘(2) E LIGIBLE MANUFACTURED HOUSING COM -21 MUNITY.—The term ‘eligible manufactured housing 22 community’ means a manufactured housing commu-23 nity that— 24 ‘‘(A) is affordable to low- and moderate-in-25 come persons, as determined by the Secretary, 26 VerDate Sep 11 2014 21:33 Mar 25, 2025 Jkt 059200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S943.IS S943 ssavage on LAPJG3WLY3PROD with BILLS 3 •S 943 IS but not more than 120 percent of the area me-1 dian income; and 2 ‘‘(B)(i) is owned by the residents of the 3 manufactured housing community through a 4 resident-controlled entity such as a resident- 5 owned cooperative; or 6 ‘‘(ii) will be maintained as such a commu-7 nity, and remain affordable for low- and mod-8 erate-income persons, to the maximum extent 9 practicable and for the longest period feasible. 10 ‘‘(3) E LIGIBLE RECIPIENT.—The term ‘eligible 11 recipient’ means— 12 ‘‘(A) an eligible manufactured housing 13 community; 14 ‘‘(B) a unit of general local government; 15 ‘‘(C) a housing authority; 16 ‘‘(D) a resident-owned community; 17 ‘‘(E) a resident-owned cooperative; 18 ‘‘(F) a nonprofit entity with housing exper-19 tise or a consortia of such entities; and 3 ‘‘(ii) working with an eligible manu-4 factured housing community. 5 ‘‘(4) I NDIAN TRIBE.—The term ‘Indian Tribe’ 6 has the meaning given the term ‘Indian tribe’ in sec-7 tion 4 of the Native American Housing Assistance 8 and Self-Determination Act of 1996 (25 U.S.C. 9 4103). 10 ‘‘(5) M ANUFACTURED HOUSING COMMUNITY .— 11 The term ‘manufactured housing community’ 12 means— 13 ‘‘(A) any community, court, park, or other 14 land under unified ownership developed and ac-15 commodating or equipped to accommodate the 16 placement of manufactured homes, where— 17 ‘‘(i) spaces within such community are 18 or will be primarily used for residential oc-19 cupancy; or 3 ‘‘(B) any community that meets the defini-4 tion of manufactured housing community used 5 for programs similar to the program under this 6 section. 7 ‘‘(6) R ESIDENT HEALTH, SAFETY, AND ACCES-8 SIBILITY ACTIVITIES.—The term ‘resident health, 9 safety, and accessibility activities’ means the recon-10 struction, repair, or replacement of manufactured 11 housing and manufactured housing communities 12 to— 13 ‘‘(A) protect the health and safety of resi-14 dents; 15 ‘‘(B) address weatherization and reduce 16 utility costs; or 17 ‘‘(C) address accessibility needs for resi-18 dents with disabilities. 19 ‘‘(7) T RIBALLY DESIGNATED HOUSING ENTI -20 TY.—The term ‘tribally designated housing entity’ 21 has the meaning given the term in section 4 of the 22 Native American Housing Assistance and Self-De-23 termination Act of 1996 (25 U.S.C. 4103). 24 VerDate Sep 11 2014 21:33 Mar 25, 2025 Jkt 059200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\S943.IS S943 ssavage on LAPJG3WLY3PROD with BILLS 6 •S 943 IS ‘‘(b) ESTABLISHMENT.—The Secretary shall, by no-1 tice, carry out a competitive grant program to award 2 funds to eligible recipients to carry out eligible projects 3 for development of or improvements in eligible manufac-4 tured housing communities. 5 ‘‘(c) E LIGIBLEPROJECTS.— 6 ‘‘(1) I N GENERAL.—Amounts from grants 7 under this section may be used for— 8 ‘‘(A) community infrastructure, facilities, 9 utilities, and other land improvements in or 10 serving an eligible manufactured housing com-11 munity; 12 ‘‘(B) reconstruction or repair existing 13 housing within an eligible manufactured hous-14 ing community; 15 ‘‘(C) replacement of homes within an eligi-16 ble manufactured housing community; 17 ‘‘(D) planning; 18 ‘‘(E) resident health, safety, and accessi-19 bility activities in homes in an eligible manufac-20 tured housing community; 21 ‘‘(F) land and site acquisition and infra-22 structure for expansion or construction of an el-23 igible manufactured housing community; and 3 ‘‘(H) any other activity that— 4 ‘‘(i) is approved by the Secretary con-5 sistent with the requirements under this 6 section; 7 ‘‘(ii) improves the overall living condi-8 tions of an eligible manufactured housing 9 community, which may include the addi-10 tion or enhancement of shared spaces such 11 as community centers, recreational areas, 12 or other facilities that support resident 13 well-being and community engagement; 14 and 15 ‘‘(iii) is necessary to protect the 16 health and safety of the residents of the el-17 igible manufactured housing community 18 and the long-term affordability and sus-19 tainability of the community. 20 ‘‘(2) R EPLACEMENT.—For purposes of sub-21 paragraphs (B) and (C) of paragraph (1), grants 22 under this section— 23 VerDate Sep 11 2014 21:33 Mar 25, 2025 Jkt 059200 PO 00000 Frm 00007 Fmt 6652 Sfmt 6201 E:\BILLS\S943.IS S943 ssavage on LAPJG3WLY3PROD with BILLS 8 •S 943 IS ‘‘(A) may not be used for rehabilitation or 1 modernization of units that were built before 2 June 15, 1976; and 3 ‘‘(B) may only be used for disposition and 4 replacement of units described in subparagraph 5 (A), provided that any replacement housing 6 complies with the Manufactured Home Con-7 struction and Safety Standards or is another al-8 lowed home, as determined by the Secretary. 9 ‘‘(d) P RIORITY.—In awarding grants under this sec-10 tion, the Secretary shall prioritize applicants that will 11 carry out activities that primarily benefit low- and mod-12 erate-income residents and preserve long-term housing af-13 fordability for residents of eligible manufactured housing 14 communities. 15 ‘‘(e) W AIVERS.—The Secretary may waive or specify 16 alternative requirements for any provision of law or regu-17 lation that the Secretary administers in connection with 18 use of amounts made available under this section other 19 than requirements related to fair housing, nondiscrimina-20 tion, labor standards, and the environment, upon a finding 21 that the waiver or alternative requirement is not incon-22 sistent with the overall purposes of this section and that 23 the waiver or alternative requirement is necessary to facili-24 tate the use of amounts made available under this section. 25 VerDate Sep 11 2014 21:33 Mar 25, 2025 Jkt 059200 PO 00000 Frm 00008 Fmt 6652 Sfmt 6201 E:\BILLS\S943.IS S943 ssavage on LAPJG3WLY3PROD with BILLS 9 •S 943 IS ‘‘(f) IMPLEMENTATION.— 1 ‘‘(1) I N GENERAL.—Any grant made under this 2 section shall be made pursuant to criteria for selec-3 tion of recipients of such grants that the Secretary 4 shall by regulation establish and publish together 5 with any notification of availability of amounts 6 under this section. 7 ‘‘(2) S ET ASIDE OF GRANT AMOUNTS .—The 8 Secretary may set aside amounts provided under 9 this section for grants to Indian Tribes and tribally 10 designated housing entities. 11 ‘‘(g) A UTHORIZATION OF APPROPRIATIONS.—There 12 is authorized to be appropriated to the Secretary such 13 sums as may be necessary to carry out this section, which 14 shall be in addition to any other funds appropriated to 15 pursuant to this title.’’. 16 Æ VerDate Sep 11 2014 21:33 Mar 25, 2025 Jkt 059200 PO 00000 Frm 00009 Fmt 6652 Sfmt 6301 E:\BILLS\S943.IS S943 ssavage on LAPJG3WLY3PROD with BILLS
