Ward 6 Senate Sponsor: ____________ 7 8LONG TITLE 9General Description: 10 This bill creates a consensus process related to the funding of services for persons with 11disabilities. 12Highlighted Provisions: 13 This bill: 14 <defines terms; 15 <at certain times, requires the Governor's Office of Planning and Budget, the Office 16of the Legislative Fiscal Analyst, and the Division of Services for People with 17Disabilities (division) to estimate, for the next fiscal year: 18 Cthe number of high-priority individuals who will be on the division's waiting list 19for services; and 20 Cthe amount that would be required to provide services to the lesser of all 21high-priority individuals on the waiting list or 200 high-priority individuals; and 22 <at certain times, requires the base budget to include an appropriation to the 23Department of Health and Human Services equal to the amount estimated to 24provide services to certain high-priority individuals. 25Money Appropriated in this Bill: *HB0242S01* 1st Sub. (Buff) H.B. 242 02-01-23 3:03 PM - 2 - 26 None 27Other Special Clauses: 28 None 29Utah Code Sections Affected: 30ENACTS: 31 62A-5-112, Utah Code Annotated 1953 32 33Be it enacted by the Legislature of the state of Utah: 34 Section 1. Section 62A-5-112 is enacted to read: 35 62A-5-112. Consensus estimate -- Base budget appropriation. 36 (1) As used in this section: 37 (a) "Base budget" means the same as that term is defined in legislative rule. 38 (b) "Committee" means the Executive Appropriations Committee. 39 (c) "General Fund growth factor" means the same as that term is defined in Section 4026-18-405.5. 41 (d) "High-priority individual" means an eligible individual waiting for services from 42the division: 43 (i) who does not have a family caregiver to help take care of them or who is at 44imminent risk for losing a family caregiver; 45 (ii) who has been the victim of a documented incident of abuse, neglect, or 46exploitation; 47 (iii) who is at imminent risk for becoming homeless; or 48 (iv) whose family is at immediate risk because any of the following documented 49behavioral issues occur weekly or more frequently: 50 (A) severe physical assaults; 51 (B) sexually inappropriate behavior; or 52 (C) sexually aggressive behavior. 53 (2) In a year in which the General Fund growth factor is greater than 100%: 54 (a) the Governor's Office of Planning and Budget, in cooperation with the Office of the 55Legislative Fiscal Analyst and the division, shall: 56 (i) estimate, for the next fiscal year, the number of high-priority individuals to whom 02-01-23 3:03 PM 1st Sub. (Buff) H.B. 242 - 3 - 57the division will be unable to provide services using attrition funding described in Subsection 5862A-5-102(7)(b); and 59 (ii) estimate the amount that would be required to provide division services to the 60lesser of: 61 (A) the total number of high-priority individuals estimated under Subsection (2)(a); or 62 (B) 200 high-priority individuals; and 63 (b) the next fiscal year base budget shall include an appropriation to the Department of 64Health and Human Services in an amount equal to the estimate made under Subsection 65(2)(a)(ii). 66 (3) The Office of the Legislative Fiscal Analyst shall provide estimates required under 67Subsection (2)(a) to the committee before the committee's December meeting.
