(Buff) H.B. 189 Ariel Defay proposes the following substitute bill: 1 Public Education Course Grade Requirements 2025 GENERAL SESSION STATE OF UTAH Chief Sponsor: Ariel Defay Senate Sponsor: 2 3 LONG TITLE 4 General Description: 5 This bill prohibits a local education agency (LEA) from requiring student attendance at an 6 off-campus event. 7 Highlighted Provisions: 8 This bill: 9 ▸ defines terms; 10 ▸ prohibits an LEA from requiring a student to attend an off-campus event as a condition 11 for grades or academic credit; 12 ▸ prohibits adverse effects on a student's grades or academic standing due to non-attendance 13 at an off-campus event; and 14 ▸ requires an LEA to provide optional transportation, a fee waiver, and alternative options 15 for students to meet academic requirements. 16 Money Appropriated in this Bill: 17 None 18 Other Special Clauses: 19 This bill provides a special effective date. 20 Utah Code Sections Affected: 21 ENACTS: 22 53G-10-307, Utah Code Annotated 1953 23 24 Be it enacted by the Legislature of the state of Utah: 25 Section 1. Section 53G-10-307 is enacted to read: 26 53G-10-307 . Prohibition on mandatory attendance at off-campus event. 27 (1) As used in this section, "off-campus event" means an activity or meeting held outside 28 the premises of the school where the student is enrolled. 1st Sub. (Buff) H.B. 189 01-29 16:21 29 (2) An LEA may not require a student to attend, or pay admission to, an off-campus event 30 as a condition for: 31 (a) earning academic credit or receiving a certain grade; or 32 (b) satisfying an academic requirement. 33 (3) Notwithstanding the requirements of this section, an LEA may require a student to 34 attend, or pay admission to, an off-campus event for the reasons described in S 35 ubsections (2)(a) and (b) if an LEA designs and approves a school program to occur at 36 an off-campus location that: 37 (a) takes place off-campus for some or all of the instructional period; 38 (b) is essential for fulfilling the instructional objectives of the class; and 39 (c) school administration approves for student travel. 40 (4) An LEA may not impose a negative consequence on a student for the student's failure to 41 attend or pay for an off-campus event. 42 (5) If an LEA grants credit for attendance at, or payment for admission to, an off-campus 43 event, the LEA shall provide: 44 (a) optional transportation to and from the off-campus event; 45 (b) a fee waiver for the off-campus event; and 46 (c) a reasonable alternative for a student to obtain the credit on campus during regular 47 school hours. 48 Section 2.
