01-20 11:44 H.B. 271 0 Meeting or Procession Disruption Amendments 2025 GENERAL SESSION STATE OF UTAH Chief Sponsor: Matt MacPherson 1 2 LONG TITLE 3 General Description: 4 This bill modifies the criminal offense concerning disrupting a meeting or procession. 5 Highlighted Provisions: 6 This bill: 7 ▸ modifies the criminal offense concerning disrupting a meeting or procession; and 8 ▸ makes technical and conforming changes. 9 Money Appropriated in this Bill: 10 None 11 Other Special Clauses: 12 None 13 Utah Code Sections Affected: 14 AMENDS: 15 76-9-103, as enacted by Laws of Utah 1973, Chapter 196 16 17 Be it enacted by the Legislature of the state of Utah: 18 Section 1. Section 76-9-103 is amended to read: 19 76-9-103 . Disrupting a meeting or procession. 20 (1) [A person is guilty of ] Terms defined in Section 76-1-101.5 apply to this section. 21 (2) An actor commits disrupting a meeting or procession if[, intending to prevent or disrupt 22 a lawful meeting, procession, or gathering, he obstructs or interferes with] the actor, 23 acting intentionally, knowingly, or recklessly, prevents or substantially obstructs or 24 disrupts a lawful meeting, procession, or gathering by[ physical action, verbal utterance, 25 or any other means.] : 26 (a)(i) using force, violence, or the threat of violence; or 27 (ii) engaging in another unlawful act, if the penalty for the unlawful act is a class B 28 misdemeanor or higher; 29 (b) interfering with or preventing the ingress or egress to the physical facility where the 30 meeting, procession, or gathering is taking place, including through the use of H.B. 271 01-20 11:44 31 threatening language or actions that would put a reasonable person in fear of entering 32 or leaving the location; or 33 (c) denying the use of the property or facility where the meeting, procession, or 34 gathering is taking place through the use of excessive sound. 35 [(2)] (3) [Disrupting a meeting or procession] A violation of Subsection (2) is a class B 36 misdemeanor. 37 Section 2. Effective Date. 38 This bill takes effect on May 7, 2025. - 2 -
