(Buff) H.B. 271 Matt MacPherson proposes the following substitute bill: 1 Meeting or Procession Disruption Amendments 2025 GENERAL SESSION STATE OF UTAH Chief Sponsor: Matt MacPherson Senate Sponsor: 2 3 LONG TITLE 4 General Description: 5 This bill modifies the criminal offense concerning disrupting a meeting or procession. 6 Highlighted Provisions: 7 This bill: 8 ▸ modifies the criminal offense concerning disrupting a meeting or procession; 9 ▸ adds a coordination clause between this bill and H.B. 21, Criminal Code Recodification 10 and Cross References, to provide that the changes to Section 76-9-103 in this bill will 11 supersede the changes to that section in H.B. 21; and 12 ▸ makes technical and conforming changes. 13 Money Appropriated in this Bill: 14 None 15 Other Special Clauses: 16 This bill provides a coordination clause. 17 Utah Code Sections Affected: 18 AMENDS: 19 76-9-103, as enacted by Laws of Utah 1973, Chapter 196 20 Utah Code Sections affected by Coordination Clause: 21 76-9-103, as enacted by Laws of Utah 1973, Chapter 196 22 23 Be it enacted by the Legislature of the state of Utah: 24 The following section is affected by a coordination clause at the end of this bill. 25 Section 1. Section 76-9-103 is amended to read: 26 76-9-103 . Disrupting a meeting or procession. 27 (1) [A person is guilty of ] Terms defined in Section 76-1-101.5 apply to this section. 28 (2) An actor commits disrupting a meeting or procession if[, intending to prevent or disrupt 29 a lawful meeting, procession, or gathering, he obstructs or interferes with] the actor, 1st Sub. (Buff) H.B. 271 02-03 13:56 30 acting intentionally or knowingly, prevents or substantially obstructs or disrupts a lawful 31 meeting, procession, or gathering by[ physical action, verbal utterance, or any other 32 means.] : 33 (a)(i) using force, violence, or the threat of violence; or 34 (ii) engaging in another unlawful act, if the penalty for the unlawful act is a class B 35 misdemeanor or higher; 36 (b) interfering with or preventing the ingress or egress to the physical facility where the 37 meeting, procession, or gathering is taking place, including through the use of 38 threatening language or actions that would put a reasonable person in fear of entering 39 or leaving the location; or 40 (c) denying the use of the property or facility where the meeting, procession, or 41 gathering is taking place through the use of excessive sound. 42 [(2)] (3) [Disrupting a meeting or procession] A violation of Subsection (2) is a class B 43 misdemeanor. 44 Section 2. Effective Date. 45 This bill takes effect on May 7, 2025. 46 Section 3. Coordinating H.B. 271 with H.B. 21. 47 If H.B. 271, Meeting or Procession Disruption Amendments, and H.B. 21, Criminal 48 Code Recodification and Cross References, both pass and become law, the Legislature intends 49 that, on May 7, 2025, the amendments to Section 76-9-103 in H.B. 271 supersede the 50 amendments to Section 76-9-103 in H.B. 21. - 2 -
