02-03 16:51 H.B. 402 1 Foods Available at Schools Amendments 2025 GENERAL SESSION STATE OF UTAH Chief Sponsor: Kristen Chevrier Senate Sponsor: 2 3 LONG TITLE 4 General Description: 5 This bill enacts provisions to prohibit certain food additives from being served in a public 6 school. 7 Highlighted Provisions: 8 This bill: 9 ▸ defines terms; 10 ▸ enacts provisions to prohibit certain food additives from being served in a public school; 11 and 12 ▸ provides an exception. 13 Money Appropriated in this Bill: 14 None 15 Other Special Clauses: 16 None 17 Utah Code Sections Affected: 18 ENACTS: 19 53G-9-205.2, Utah Code Annotated 1953 20 21 Be it enacted by the Legislature of the state of Utah: 22 Section 1. Section 53G-9-205.2 is enacted to read: 23 53G-9-205.2 . Definitions -- Prohibited food additives -- Exceptions. 24 (1) As used in this section: 25 (a) "Public school" means the same as that term is defined in Section 53G-9-205.1. 26 (b) "School day" means the portion of a day that school is in session in which a 27 school-age child is required to be in school for purposes of receiving instruction. 28 (c) "Ultraprocessed food" means a food or beverage that contains one or more of the 29 following ingredients: 30 (i) brominated vegetable oil; H.B. 402 H.B. 402 02-03 16:51 31 (ii) potassium bromate; 32 (iii) propylparaben; 33 (iv) titanium dioxide; 34 (v) blue dye 1; 35 (vi) blue dye 2; 36 (vii) green dye 3; 37 (viii) red dye 3; 38 (ix) red dye 40; 39 (x) yellow dye 5; and 40 (xi) yellow dye 6. 41 (2) Beginning in the 2026-2027 school year, a public school may not serve or sell 42 ultraprocessed food on school grounds during the normal school day. 43 (3) The board shall, in accordance with Title 63G, Chapter 3, Utah Administrative 44 Rulemaking Act, adopt rules to implement this section. 45 (4) Nothing in this section prevents a student's parent or legal guardian from providing the 46 student with food that contains ultraprocessed food to the student during the school day. 47 Section 2. Effective Date. 48 This bill takes effect on May 7, 2025. - 2 -
