(Gray) H.B. 402 Kristen Chevrier proposes the following substitute bill: 1 Foods Additives in Schools 2025 GENERAL SESSION STATE OF UTAH Chief Sponsor: Kristen Chevrier Senate Sponsor: Heidi Balderree 2 3 LONG TITLE 4 General Description: 5 This bill enacts provisions to prohibit consumable items containing certain food additives 6 from being provided in a public school. 7 Highlighted Provisions: 8 This bill: 9 ▸ defines terms; 10 ▸ enacts provisions to prohibit consumable items containing certain food additives from 11 being provided in a public school; and 12 ▸ provides an exception. 13 Money Appropriated in this Bill: 14 None 15 Other Special Clauses: 16 None 17 Utah Code Sections Affected: 18 ENACTS: 19 53G-9-205.2, Utah Code Annotated 1953 20 21 Be it enacted by the Legislature of the state of Utah: 22 Section 1. Section 53G-9-205.2 is enacted to read: 23 53G-9-205.2 . Definitions -- Prohibited food additives -- Exceptions. 24 (1) As used in this section: 25 (a) "FD&C" means the Federal Food, Drug, and Cosmetics Act, 21 C.F.R. Part 74. 26 (b) "Public school" means the same as that term is defined in Section 53G-9-205.1. 27 (c) "School day" means the same as that terms is defined in Section 53G-6-201. 28 (2)(a) Beginning in the 2026-2027 school year, a public school may not sell, donate, 2nd Sub. (Gray) H.B. 402 02-19 15:31 29 offer, or serve on school grounds during the school day, food that contains: 30 (i) potassium bromate; 31 (ii) propylparaben; 32 (iii) FD&C Blue No. 1; 33 (iv) FD&C Blue No. 2; 34 (v) FD&C Green No. 3; 35 (vi) FD&C Red No. 3; 36 (vii) FD&C Red No. 40; 37 (viii) FD&C Yellow No. 5; and 38 (ix) FD&C Yellow No. 6. 39 (b) Except as provided in Subsection (3), a person who sells, donates, offers, or serves a 40 consumable item during the school day shall comply with the requirements under this 41 section. 42 (3) Nothing in this section prevents a student's parent from providing the parent's student 43 with a food item described in Subsection (2)(a) during the school day. 44 Section 2. Effective Date. 45 This bill takes effect on May 7, 2025. - 2 -
