General Description:

This joint resolution of the Legislature proposes to amend the Utah Constitution to enact a
6 
provision relating to electors for President and Vice President of the United States.

Highlighted Provisions:

This resolution proposes to amend the Utah Constitution to:
9 
▸ prohibit requiring or compelling an elector for President and Vice President of the United
10 
States to vote for any individual based on voting results in any other state.

Other Special Clauses:

This resolution directs the lieutenant governor to submit this proposal to voters.
13 
This resolution provides a contingent effective date of January 1, 2027 for this proposal.

Be it resolved by the Legislature of the state of Utah, two-thirds of all members elected to each
19 
of the two houses voting in favor thereof:

Section 1.  It is proposed to enact Utah Constitution, Article XXII, Section 6, to read:
21 
Article XXII, Section 6 . Electors for President or Vice President -- Vote may not
22 
be required or compelled based on other states' voting results.
23 
An elector for President and Vice President of the United States, appointed as provided
24 
in Article II, Section 1 of the Constitution of the United States, may not be required or
25 
compelled to vote for any individual based on the result of the voting nationwide or in one or
26 
more other states.

Section 2.  Submittal to voters.

The lieutenant governor is directed to submit this proposed amendment to the voters of
29 
the state at the next regular general election in the manner provided by law.
30 
Section 3.  Contingent effective date.
31 
If the amendment proposed by this joint resolution is approved by a majority of those  H.J.R. 5	01-22 11:01
32 
voting on it at the next regular general election, the amendment shall take effect on January 1,
33 
2027.
