Enrolled Copy S.B. 105 1 Student Privacy and Modesty in Public Education 2025 GENERAL SESSION STATE OF UTAH Chief Sponsor: Jen Plumb House Sponsor: Ariel Defay 2 3 LONG TITLE 4 General Description: 5 This bill enacts provisions regarding a student's reasonable expectation of individual 6 privacy and personal modesty in the public education system. 7 Highlighted Provisions: 8 This bill: 9 ▸ defines terms; and 10 ▸ enacts provisions regarding a student's reasonable expectation of individual privacy and 11 personal modesty in the public education system, including: 12 ● prohibiting any requirement that a student undress in the presence of another 13 individual; and 14 ● establishing options for local education agencies which constitute compliance 15 regarding the prohibition. 16 Money Appropriated in this Bill: 17 None 18 Other Special Clauses: 19 This bill provides a special effective date. 20 Utah Code Sections Affected: 21 ENACTS: 22 53G-9-214, Utah Code Annotated 1953 23 24 Be it enacted by the Legislature of the state of Utah: 25 Section 1. Section 53G-9-214 is enacted to read: 26 53G-9-214 . Individual privacy -- Personal modesty. 27 (1) As used in this section: 28 (a)(i) "Changing facility" means a room in which two or more individuals may be in S.B. 105 Enrolled Copy 29 a state of undress in the presence of others. 30 (ii) "Changing facility" includes a dressing room, fitting room, locker room, changing 31 room, or shower room. 32 (b) "Full nudity" means that an individual's genitalia, female breast below the top of the 33 areola, buttocks, anus, or pubic area is completely exposed. 34 (c) "Partial nudity" means that an individual's pubic region or chest are less than 35 completely covered. 36 (d) "Restroom" means a room that includes one or more toilets or urinals. 37 (e) "Single-occupant facility" means a restroom or changing facility: 38 (i) with floor-to-ceiling walls; 39 (ii) with an entirely encased and locking door; and 40 (iii) that is designated for single occupancy. 41 (2) Each student in the public education system has a reasonable expectation of individual 42 privacy and personal modesty. 43 (3) In accordance with Subsection (2), an LEA may not require, invite, or encourage a 44 student to undress, change clothing, or otherwise be in a state of full or partial nudity in 45 the presence of another individual, regardless of whether: 46 (a) the student is in a restroom or changing facility; or 47 (b) the other individual is an employee of the LEA. 48 (4)(a) An LEA is presumed to comply with Subsection (3) if the LEA ensures the 49 availability of the following for students who choose to undress or change clothing in 50 private: 51 (i) single-occupant facilities; 52 (ii) floor-to-ceiling walls and doors or similar privacy protections within changing 53 facilities; or 54 (iii) curtains or similar privacy protections in changing facilities. 55 (b) Nothing in this section requires an LEA to make available a specific privacy 56 accommodation described in Subsection (4)(a). 57 Section 2. Effective date. 58 This bill takes effect on July 1, 2025. - 2 -
