Christofferson 2 3 LONG TITLE 4 General Description: 5 This bill addresses registration for new commercial motor vehicles. 6 Highlighted Provisions: 7 This bill: 8 ▸ allows for a conditional registration of a new commercial motor vehicle in certain 9 circumstances. 10 Money Appropriated in this Bill: 11 None 12 Other Special Clauses: 13 This bill provides a special effective date. 14 Utah Code Sections Affected: 15 ENACTS: 16 41-1a-233, Utah Code Annotated 1953 17 18 Be it enacted by the Legislature of the state of Utah: 19 Section 1. Section 41-1a-233 is enacted to read: 20 41-1a-233 . Conditional registration for new commercial motor vehicles. 21 (1) As used in this part: 22 (a) "Manufacturer's statement of origin" means a statement or certificate from the motor 23 vehicle manufacturer that shows: 24 (i) the date of sale from the manufacturer to the first purchaser; 25 (ii) the name of the first purchaser; 26 (iii) a description of the motor vehicle, including the year, make, model, and vehicle 27 identification number; and 28 (iv) a certification that the motor vehicle was new when sold to the first purchaser. S.B. 251 Enrolled Copy 29 (b) "Passenger rental car establishment" means an establishment described in NAICS 30 subsector 532111 of the 2022 North American Industry Classification System of the 31 federal Executive Office of the President, Office of Management and Budget. 32 (c) "Qualified identification number inspector" means the same as it is described in 33 Section 41-1a-802. 34 (2) The division may issue a conditional registration for a new motor vehicle that is a 35 commercial vehicle if: 36 (a) the owner: 37 (i) is a passenger rental car establishment; 38 (ii) has not received a manufacturer statement of origin; 39 (iii) is entitled to a manufacturer statement of origin; 40 (iv) has physical possession of the vehicle; and 41 (v) has paid all applicable taxes and fees for the vehicle; and 42 (b) a qualified identification number inspector has: 43 (i) physically inspected the identification number of the motor vehicle; and 44 (ii) made a record of the identification number inspection on a form approved by the 45 division. 46 (3)(a) A conditional registration issued under Subsection (2) shall be in effect for a 47 period of 12 months beginning with the first day of the calendar month of registration 48 and does not expire until the last day of the same month in the following year. 49 (b) An owner of a vehicle with a conditional registration may not renew the registration 50 until a Utah title is obtained for the vehicle. 51 (c) A vehicle with a conditional registration under this section may not be sold or 52 transferred without first obtaining a Utah title. 53 (4) If a Utah title is not issued for a vehicle within 10 months of the beginning of the month 54 in which a conditional registration is issued for the vehicle, the division shall: 55 (a) revoke the conditional registration for the vehicle; and 56 (b) not allow the vehicle to be registered in the state until a Utah title is obtained for the 57 vehicle. 58 (5) A commercial vehicle that is issued a conditional registration as provided in this section 59 is subject to the same fees that would apply to the commercial vehicle if the registration 60 was not a conditional registration. 61 (6) A person shall submit a request for a conditional registration in a form prescribed by the 62 division. - 2 - Enrolled Copy S.B. 251 63 (7) A conditional registration under this section may not be issued to a vehicle subject to 64 apportioned registration under Section 41-1a-301. 65 Section 2. Effective Date. 66 This bill takes effect on July 1, 2025. - 3 -
