Bill Summary
he bill proposes to increase the monetary thresholds that trigger a certificate of need (CON)
requirement and to exempt health care services and health facility projects that are the result of a
contract awarded by the State.
Fiscal Impact
Over the past seven years, the Green Mountain Care Board (GMCB) has collected approximately $50,000
per year – on average – in fees related to the review of CON applications. GMCB estimates that the bill
could reduce this revenue by as much as $20,000 per year on average. According to GMCB this loss can be
absorbed and the decrease in CON reviews would allow resources to be deployed elsewhere.
Background and Details
Under 18 V.S.A. § 9441, the Board charges a fee for the filing of CON applications. The fee is calculated at
the rate of 0.125% of project costs.

Fees range from a minimum of $250 (regardless of the project cost) to a
maximum of $20,000. All fees collected are deposited in the Green Mountain Care Board Regulatory and
Administrative Fund.
