Subject: Regulated drugs; unlawful drug activity in a dwelling; flash citation 10 
Statement of purpose of bill as introduced:  This bill proposes to require that in 11 
cases when a person is arraigned on a charge of unlawful drug activity in a 12 
dwelling where the person is not a legal tenant, the State’s Attorney shall 13 
request as a condition of release that the person is prohibited from coming 14 
within a fixed distance of the dwelling. 15 
An act relating to unlawful drug activity in a dwelling by a person who is 16 
not a legal tenant 17 
It is hereby enacted by the General Assembly of the State of Vermont:  18 
Sec. 1.  18 V.S.A. § 4252a is amended to read: 19 
§ 4252a.  UNLAWFUL DRUG ACTIVITY IN A DWELLING; FLASH 20  BILL AS INTRODUCED 	H.128

                CITATION 1 
(a)  Except for good cause shown, a person cited or arrested for dispensing 2 
or selling a regulated drug in violation of this chapter shall be arraigned on the 3 
next business day after the citation or arrest if the alleged illegal activity 4 
occurred at a dwelling where the person is not a legal tenant. 5 
(b)  Unless the person is held without bail for another offense, the State’s 6 
Attorney may shall request conditions of release. The court may include as a 7 
condition of release that the person is prohibited from coming within a fixed 8 
distance of the dwelling.  9 
Sec. 2.  EFFECTIVE DATE 10 
This act shall take effect on July 1, 2025. 11
