(7)“Carpetorrug”meansafabricproductmarketedorintendedforuse asafloorcovering. (11)“Cookware”meansdurablehousewareitemsusedtoprepare, dispense,orstorefood,foodstuffs,orbeveragesandthatareintendedfor directfoodcontact,includingpots,pans,skillets,grills,bakingsheets,baking molds,trays,bowls,andcookingutensils. (12)“Cosmeticproduct”meansanarticleoracomponentofanarticle intendedtoberubbed,poured,sprinkled,orsprayedon;introducedinto;or otherwiseappliedtothehumanbodyoranypartthereofforcleansing, promotingattractiveness,orimprovingoralteringappearance,includingthose intendedforusebyprofessionals.“Cosmeticproduct”doesnotmeansoap, dietarysupplements,orfoodanddrugsapprovedbytheU.S.FoodandDrug Administration. (26)“Personalprotectiveequipment”isclothingdesigned,intended,or marketedtobewornbyfirefightingpersonnelintheperformanceoftheir duties,designedwiththeintentforuseinfireandrescueactivities,and includesjackets,pants,shoes,gloves,helmets,andrespiratoryequipment. (27)“Pesticide”hasthesamemeaningasdefinedin6V.S.A.§1101. (28)“PFAS-addedconsumerproduct”meansaconsumerproductthat wasmanufacturedaftertheeffectivedateofthischapterwherePFASwere intentionallyaddedtothatproductoracomponentoftheproduct. (29)“Productcomponent”meansacomponentofaproduct,regardless ofwhetherthemanufactureroftheproductisthemanufacturerofthe component. (30)“Retailer”meansapersonwhosellsaPFAS-addedproductinthe Statethroughanymeans,includingasalesoutlet,acatalogue,thetelephone, theinternet,oranyelectronicmeans.“Retailer”doesnotmeanapersonwho bothmanufacturesandsellsatretailaconsumerproductwithrespecttothe productthattheymanufacture. (2)Productsmadewithatleast50percentrecycledcontent,excluding foodpackagingandcontainersandPFASsolutions.TheSecretarymayadopt alternateminimumrecycledcontentexemptionsbyrule. (3)Productsmanufacturedpriortothephaseoutimposedbysection 7604ofthistitle. (2)Themanufacturerorpersonsellingpersonalprotectiveequipment andthepurchaserofthepersonalprotectiveequipmentshallretainthenotice foratleastthreeyearsfromthedateofthetransaction. §7605.CERTIFICATEOFCOMPLIANCE (a)TheAttorneyGeneralorSecretarymayrequestacertificateof compliancefromamanufacturer.Within60daysafterreceiptoftherequest foracertificateofcompliance,themanufacturershall: (1)Provideacertificatetotherequestorattestingthatthe manufacturer’sproductorproductscomplywiththerequirementsofthis chapter.Uponrequest,themanufacturershalldocumentthestepstakento reasonablyascertainwhetherPFASwerepresentinaproductorproduct component. (2)Notifypersonswhoaresellingaproductofthemanufacturer’sin thisStatethattheproductdoesnotcomplywiththischapterandsubmittothe requestoralistofthenamesandaddressesofthosepersonsnotified. (c)Acertificateofcomplianceshallbeinaformprescribedbythe Secretary. §7606.MANUFACTURER CERTIFICATION;RIGHTOFACTION (a)Amanufacturermayrequestacertificationfromasupplierofaninput intoaproductthatismanufactured,sold,ordistributedintheStateof Vermont.Thatcertificationmayincludethefollowing: (1)whetherPFASwereintentionallyaddedtotheproductorproduct component; (2)whetheracommercialchemicalproductcontainsPFAS; (3)howPFASwereusedinthedevelopmentoftheproductorproduct component;and (4)anyadditionalinformationreasonablynecessaryforthe manufacturertoensurecompliancewiththischapter.
